FIRST AMENDMENT TO
MONROE COUNTY ART IN PUBLIC PLACES AWARD AGREEMENT
This First Amendment to Monroe County Art in Public Places Award Agreement, Office

of Monroe County Public Defender Building, is made and entered into this 28day of January,
2026, by and between the BOARD OF COUNTY COMMISSIONERS FOR MONROE
COUNTY, hereinafter “County”/“BOCC”, the address of which is 1100 Simonton Street, Key
West, Florida 33040, and MICHAEL MARRERO, LLC, hereinafter “Artist”/“Contractor”, the
address of which is 1212 Catherine Street, Key West, Florida 33040 (collectively, “parties”).

EREAS, the parties hereto did on August 20, 2025, enter into a Monroe County Art in
Public Places Award Agreement (“Award Agreement”) for the creation and installation of a unique
piece of artwork at the Office of Monroe County Public Defender Building (Key West)in Monroe
County, Florida; and
WHEREAS, pursuant to the Award Agreement, the Artist was to create and install a site-
specific unique layered Wood Relief Sculpture, entitled “Simonton Street Stories” and measuring
approximately 4’ (four feet) × 6’ (six feet) in accordance with Paragraph 2, Scope of Services, of
the Award Agreement. The layered wood relief sculpture is designed tocelebrate the rich,
interconnected history of 316 Simonton Street in Key West through a dynamic visual narrative
that honors both the building’s political legacy and the beloved community memories it holds; and
WHEREAS, due to unforeseen delay in the delivery of needed materials, the Artist has
been unable to finish the creation of artworkwithin the term prescribed by Paragraph 1 of the
Agreement; and
WHEREAS, the parties have found the Award Agreement to be mutually beneficial; and
WHEREAS, the parties find it would be mutually beneficial to amend the original Award
Agreement and enter into this First Amendment.

OW, THEREFORE, IN CONSIDERATION of the mutual promises and covenants set
forth below, the parties agree as follows:
1.P
aragraph 1, AGREEMENT PERIOD, of the Award Agreement is hereby amended to
provide an additional one hundred, twenty-three (123) days to the term of the
Agreement from the date of the approval of this First Amendment by the Board of
County Commissioners to May 31, 2026 for the Artist to complete the creation and
installation of the artwork entitled “Simonton Street Stories” at the Office of Monroe
County Public Defender Building (Key West) in Monroe County, Florida.
