11 COMMISSIONERS OF MONROE COUNTY, FLORIDA,
12 AMENDING THE COUNTY'S CODE OF ORDINANCES BY
13 AMENDING CHAPTER 13, "FIRE PREVENTION AND
14 PROTECTION," ARTICLE I, "IN GENERAL," BY
15 ENACTING SECTION 13-1, "ADOPTION OF MINIMUM
16 FIRE PREVENTION AND LIFE SAFETY CODES," TO
17 INCORPORATE BY REFERENCE THE STATE-
18 MANDATED MINIMUM FIRESAFETY CODE AS
19 FURTHER DESCRIBED THEREIN; AND BY AMENDING
20 ARTICLE II, "FIRE MARSHAL," SECTION 13-27,
21 "APPOINTMENT, JOB DESCRIPTION," BY RETITLING
22 THE SECTION TO "LOCAL FIRE OFFICIAL"TO UPDATE
23 TERMINOLOGY; PROVIDING FOR CONFLICTS;
24 PROVIDING FOR SEVERABILITY; PROVIDING FOR
25 CODIFICATION; AND PROVIDING FOR TRANSMITTAL
26 AND AN EFFECTIVE DATE.

29 WHEREAS, the Monroe County Board of County Commissioners (BOCC) recognizes
30 that the work of ordinance codification is an ongoing process that requires continuous effort by
31 various County officials and staff, and it is the goal of the BOCC to ensure that the Monroe County
32 Code of Ordinances is kept current and of maximum use and clarity; and
33
34 WHEREAS, the Legislature of the State of Florida has, in Chapter 125, "County
35 Government," of the Florida Statutes, conferred upon local governments the authority to adopt
36 laws and regulations designed to promote the public health, safety, and general welfare of its
37 citizenry; and
38
39 WHEREAS,pursuant to Article V111 of the Florida Constitution and Section 125.66, Fla.
40 Stat.,Monroe County possesses the police powers to enact ordinances in order to protect the health,

41 safety, and welfare of the County's citizens; and

43 WHEREAS, additionally, Section 125.01(1)(d), Fla. Stat., states that counties have the
44 power to"[p]rovide fire protection, including the enforcement of the Florida Fire Prevention Code,
45 as provided in ss. 633.206 and 633.208, and adopt and enforce local technical amendments to the
46 Florida Fire Prevention Code as provided in those sections and pursuant to s. 633.202"; and
47
48 WHEREAS, Monroe County has previously adopted ordinances establishing standards
49 and procedures for fire prevention and protection to safeguard life, property, and the general
50 welfare of the public; and
51
52 WHEREAS, Chapter 13, "Fire Prevention and Protection,"Article I, "In General," of the
53 Monroe County Code, Section 13-1 was scheduled to be a reserved section pursuant to County
54 Ordinance No. 026-2007, and it is now deemed advisable to utilize that available section to
55 establish that the Florida Fire Prevention Code, and such rules and regulations issued by the State
56 Fire Marshal, is the minimum fire and life safety standards applicable within the unincorporated
57 areas of Monroe County, Florida; and
58
59 WHEREAS, pursuant to Section 633.118, Fla. Stat., "[t]he chiefs of county, municipal,
60 and special-district fire service providers; other fire service provider personnel designated by their
61 respective chiefs; and personnel designated by local governments having no organized fire service
62 providers are authorized to enforce this chapter [633] and all rules prescribed by the State Fire
63 Marshal within their respective jurisdictions"; and
64
65 WHEREAS, in the past, the Board of County Commissioners had to designate specific
66 personnel to enforce Chapter 633, Fla. Stat., since it did not have an internal fire service
67 department, as referenced within Section 633.118, Fla. Stat., and made such designation through
68 the formal appointment of a County Fire Marshal as set forth in Chapter 13, "Fire Prevention and
69 Protection,"Article 11, "Fire Marshal," of the Monroe County Code; and

71 WHEREAS, currently, such designation is not necessary because the County Fire Chief,
72 and other fire service personnel as designated by the County Fire Chief, possess the inherent
73 authority to enforce said laws and rules of the State Fire Marshal, and updates are recommended
74 to avoid potential confusion between the County's Code of Ordinances and state laws; and

76 WHEREAS, it follows that Chapter 13, "Fire Prevention and Protection," specifically
77 Article II, "Fire Marshal," Section 13-27, "Appointment, job description," is hereby renamed to
78 "Local Fire Official," and updated to be consistent with the County's current practices and
79 operational needs; and

81 WHEREAS, additionally, the County's local fire official, i.e. the Fire Chief, may
82 designate other Monroe County Fire Rescue personnel, such as a local fire marshal and deputy fire
83 marshal(s) who are licensed to perform the specific duties enumerated by the Department of
84 Financial Services,Division of the Fire Marshal,and are an integral component of Monroe County
85 Fire Rescue operations to ensure effective administration, enforcement, and oversight of fire
86 prevention activities; and

88 WHEREAS, on January 28, 2026, the Monroe County Board of County Commissioners
89 held a public hearing, and provided for public comment and public participation in accordance
90 with the requirements of state law; and
91
92 WHEREAS, the Board of County Commissioners hereby finds and determines that the
93 actions described herein serve the best interests of the citizenry in Monroe County, Florida.

95 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
96 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

98 Section 1: Ratification. That the foregoing"WHEREAS"clauses are hereby ratified
99 and confirmed as being true and correct and are hereby made a specific part of this Ordinance.

101 Section 2: Amendment to Section 13-1, Monroe County Code. That the Code of
102 Ordinances of Monroe County, Florida, shall be amended by amending Chapter 13, "Fire
103 Prevention and Protection,"Article I,"In General,"by enacting a new section numbered as Section
104 13-1 entitled, "Adoption of minimum fire prevention and life safety codes,"to read as follows:

106 Sec. 13-1. ReseB,ed. Adoption of minimum fire prevention and life safety codes.
107 (a) The Florida Fire Prevention Code, and such rules and regulations issued by the State Fire
108 Marshal consistent with Chapter 633,Fla. Stat., are deemed adopted and enforceable as the
109 minimum fire prevention and life safey codes (hereinafter "minimum firesafety code")
110 applicable within the unincorporated areas of Monroe County, Florida. The minimum
111 firesafety code shall be applied to every building and structure except as provided by law.
112 02� Such minimum firesafety code shall operate in conjunction with the Florida Building Code.
113 In the event that a dispute arises regarding the enforcement of the Florida Fire Prevention
114 Code as related to the enforcement of the Florida Building Code, the dispute shall be
115 resolved through the procedures set forth in Chapters 633 and 553, Fla. Stat.
116 LcJ All references to the laws, rules, and regulations cited herein shall be applicable as same
117 may be amended from time to time. This Chapter 13, "Fire Prevntion and Protection," of
118 the Monroe County Code shall be liberally construed to protect the public health, safety,
119 and welfare. Additionally, nothing in this Chapter shall be construed to provide any
120 independent cause of action or claim for relief of any kind whatsoever except as expressly
121 _provided herein.

124 Section 3: Amendment to Section 13-27, Monroe County Code. That the Code of
125 Ordinances of Monroe County, Florida, shall be amended by amending Chapter 13, "Fire
126 Prevention and Protection," Article II, "Fire Marshal," Section 13-27, "Appointment, job
127 description,"by retitling the Section to "Local Fire Official,"to read as follows:

132 (a) The chief of Monroe County Fire Rescue is hereby designated as the local fire
133 official for the county. The Monroe County Fire Chief("Fire Chief) may also designate
134 such other Monroe County Fire Rescue personnel who hold the state-mandated
135 certifications and credentials, including but not limited to a local fire marshal and deputy
136 fire marshal(s),to perform the duties of the local fire official. Such personnel shall possess
137 the authority to enforce the minimum firesafety code as set forth in Section 13-1, Monroe
138 County Code,and perform the duties established by state law and as further set forth herein.
139 To the extent permitted by law, the prior actions of the county fire marshal, and his or her
140 deputy fire marshals, are hereby ratified.

Prevention and Protection,"Article I, "In General,"by enacting Section 13-1, "Adoption of
Minimum Fire Prevention and Life Safety Codes,"to incorporate by reference the State
mandated minimum Fire Safety Code as further described therein; and by amending
Article II, "Fire Marshal," Section 13-27, "Appointment, Job Description,"by retitling
the Section to "Local Fire Official"to update terminology; providing for conflicts;
providing for severability;providing for codification; and providing for transmittal
and an effective date.
