HomeMy WebLinkAboutOrdinance 007-2026 k r 3 4 6 7 MONROE COUNTY, FLORIDA 8 MONROE COUNTY BOARD OF COUNTY COMMISSIONERS 9 ORDINANCE NO. 007 -2026 10 11 AN ORDINANCE AMENDING THE MONROE COUNTY LAND USE 12 DISTRICT (LUD) MAP FROM SPARSELY SETTLED (SS) TO 13 SUBURBAN RESIDENTIAL (SR) FOR PROPERTY LOCATED AT 10 14 CORMORANT LANE,GEIGER KEY,DESCRIBED AS THE NORTH'/2OF 15 LOT 8 AND ALL LOTS 9 AND 10, BLOCK 4, BOCA CHICA OCEAN 16 SHORES, ACCORDING TO THE PLAT THEREOF AS RECORDED IN 17 PLAT BOOK 5,PAGE 49, OFFICIAL RECORDS OF MONROE COUNTY, 18 FLORIDA, CURRENTLY HAVING PARCEL IDENTIFICATION 19 NUMBER 00141680-000000; PROVIDING FOR SEVERABILITY; 20 PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; 21 PROVIDING FOR TRANSMITTAL TO THE STATE LAND PLANNING 22 AGENCY AND THE SECRETARY OF STATE; PROVIDING FOR 23 AMENDMENT TO THE LAND USE DISTRICT (LUD)MAP; PROVIDING 24 FOR AN EFFECTIVE DATE.' 25 26 27 WHEREAS, on July 31, 2025, the Planning and Environmental Resources Department 28 received an application from Richard and Kimi Rother("the Applicants"),to amend the Land Use 29 District Map from Sparsely Settled (SS) to Suburban Residential (SR), for property located at 10 30 Cormorant Lane, Geiger Key, described as the North 1/2 of Lot 8 and all Lots 9 and 10, Block 4, 31 Boca Chica Ocean Shores, according to the plat thereof as recorded in Plat Book 5 at Page 49 of 32 the Public Records of Monroe County, Florida, having Parcel Identification Number 00141680- 33 000000; and 34 35 WHEREAS, on October 27, 2025, the Applicants held a community meeting, as required 36 by Monroe County Land Development Code ("LDC" or "Code") Section 102-159(a) to discuss 37 the proposed Land Use District Map amendment, and provide for public participation; and 38 39 WHEREAS,the Monroe County Development Review Committee (DRC) considered the 40 proposed amendment at a regularly scheduled meeting held on December 16, 2025; and 41 42 WHEREAS, on December 17, 2025, the Chair of the DRC signed Resolution No. DRC 43 24-25 recommending approval of the proposed Land Use District amendment; and 44 1 Monroe County Planning&Environmental Resources Department File No.2025-163. 1 of 4 I WHEREAS, the Monroe County Planning Commission held a public hearing on January 2 29, 2026, for review and recommendation on the proposed Land Use District ("LUD") Map 3 amendment; and 4 5 WHEREAS, the Monroe County Planning Commission adopted Resolution No. P02-26 6 recommending to the Monroe County Board of County Commissioners approval of the proposed 7 LUD amendment; and 8 9 WHEREAS, at a regularly scheduled meeting on February 18, 2026, the BOCC held a 10 public hearing to consider adoption of the proposed LUD amendment; 11 12 WHEREAS, the Monroe County BOCC entered the following findings of fact and 13 conclusions of law: 14 15 1. The proposed LUD amendment is not anticipated to adversely impact the community 16 character of the surrounding area; 17 2. The proposed LUD amendment is not anticipated to adversely impact the 18 Comprehensive Plan adopted Level of Service ("LOS"); 19 3. The proposed amendment is consistent with the Goals, Objectives and Policies of the 20 Monroe County Year 2030 Comprehensive Plan; and 21 4. The proposed amendment is consistent with the Principles for Guiding Development 22 for the Florida Keys Area of Critical State Concern, Section 380.0552(7), Florida 23 Statutes; and 24 5. The proposed amendment is consistent with Part 11 of Chapter 163, Florida Statutes; 25 26 NOW, THEREFORE, BE IT ORDAINED BY THE MONROE COUNTY BOARD 27 OF COUNTY COMMISSIONERS: 28 29 Section 1. The foregoing title,recitals, findings of fact, and conclusions of law are true 30 and correct and are hereby incorporated as if fully set forth herein. 31 32 Section 2. The subject Land Use District Map amendment of the Monroe County Land 33 Development Code is amended as follows: 34 35 That certain parcel located at 10 Cormorant Lane, Geiger Key, currently 36 having Parcel Identification No. 00141680-000000, is changed from 37 Sparsely Settled ("SS") to Suburban Residential ("SR"); and as shown on 38 Exhibit 1., attached hereto and incorporated herein. 39 40 Section 3. To the extent of any internal or external conflicts, inconsistencies, and/or 41 ambiguities within this Ordinance or between this Ordinance and any other 42 ordinance,resolution, law,regulation,provision, approval, decision,text, or 43 interpretation, the more restrictive law, regulation, provision, approval, 44 decision, text, and interpretation shall always apply and control. 45 46 Section 4. Subject to Section 3. above, the interpretation of this Ordinance and all 47 provisions of the Monroe County Comprehensive Plan, Florida Building 48 Code, Monroe County Codes, Florida Statutes, and floodplain management 2of4 I regulations whose interpretation arise out of, relate to, or are interpreted in 2 connection with this Ordinance, shall be liberally construed and enforced in 3 favor of Monroe County, and such interpretation shall be entitled to great 4 weight in adversarial administrative proceedings, at trial, in bankruptcy, and 5 on appeal. 6 7 Section 5. This Ordinance neither ratifies nor approves, nor shall be interpreted as 8 ratifying or approving, any violation or violations of the Monroe County 9 Code of Ordinances, Monroe County Land Development Code, Monroe 10 County Comprehensive Plan, floodplain management regulations, Florida 11 Building Code, Florida Statutes, Florida Administrative Code, or any other 12 law,rule,or regulation,whether Federal or of the State or of Monroe County, 13 and shall not be construed as ratifying or approving of any such violation of 14 law(s), rule(s), or regulation(s). 15 16 Section 6. Approval of this Resolution shall not estop or waive,nor shall be construed 17 as estopping or waiving, Monroe County's right to enforce, seek 18 enforcement of, and require compliance with the Monroe County Codes, 19 Monroe County Comprehensive Plan, floodplain management regulations, 20 Florida Building Code, Florida Statutes, Florida Administrative Code, or 21 any other law, rule, or regulation, whether at law or in equity. 22 23 Section 7. Inconsistency, Partial Invalidity, Severability, and Survival of 24 Provisions. If any portion of this Resolution, or any part or portion thereof, 25 is held to be invalid or unenforceable by any administrative hearing officer 26 or court of competent jurisdiction,the invalidity or unenforceability of such 27 provision, or any part or portion thereof, shall neither limit nor impair the 28 operation, enforceability, or validity of any other provision of this 29 Resolution, or any remaining part(s) or portion(s) thereof. All other 30 provisions of this Resolution, and remaining part(s) or portion(s) thereof, 31 shall continue unimpaired in full force and effect. 32 33 Section 8. Repeal of Inconsistent Provisions. All ordinances or parts of an ordinance 34 in conflict with this Ordinance are hereby repealed to the extent of said 35 conflict. The repeal of an ordinance herein shall not repeal the repealing 36 clause of such ordinance or revive any ordinance which has been repealed 37 thereby. 38 39 Section 9. Transmittal. This Ordinance shall be transmitted to the State Land 40 Planning Agency pursuant to Chapters 163 and 380, Florida Statutes. 41 42 Section 10. Filin2 and Effective Date. This Ordinance shall be filed in the Office of 43 the Secretary of the State of Florida but shall not become effective until a 44 notice is issued by the State Land Planning Agency or Administration 45 Commission finding the amendment in compliance with Chapters 163 and 3 of 4 - • 3.80, .Florida Statutes and after• any applicable :challenges have been resolved::...-.• .
