11 AN ORDINANCE AMENDING THE MONROE COUNTY FUTURE LAND
12 USE MAP FROM RESIDENTIAL MEDIUM (RM) TO COMMERCIAL
13 (COMM), FOR PROPERTY LOCATED AT 106261, 106271, AND 106281
14 OVERSEAS HIGHWAY, KEY LARGO, DESCRIBED AS LOTS 18-20,
15 BLOCK 3, OCEAN ISLE ESTATES, ACCORDING TO THE PLAT
16 THEREOF, AS RECORDED IN PLAT BOOK 5, AT PAGE 14, OF THE
17 PUBLIC RECORDS OF MONROE COUNTY, FLORIDA, CURRENTLY
18 HAVING PARCEL IDENTIFICATION NUMBERS 00538800-000000,
19 00538810-000000, AND 00538820-000000; AS REQUESTED BY FLO-
20 GROWN HOME BUYERS, LLC; PROVIDING FOR SEVERABILITY;
21 PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS;

29 WHEREAS,on April 1,2025,the Monroe County Planning and Environmental Resources
30 Department ("Department") received an application from Island Construction Management, Inc.
31 ("Agent"), on behalf of FLO Grown Home Buyers, LLC ("Applicant") to amend the Monroe
32 County Future Land Use Map ("FLUM") from Residential Medium ("RM") to Commercial
33 ("COMM") for property located at 106261, 106271, and 106281 Overseas Highway, Key Largo,
34 ("subject property" or the "Property") currently having Parcel Identification Numbers 00538820-
35 000000, 00538810-000000, 00538800-000000; and
36
37 WHEREAS,the Applicant has also requested a corresponding Land Use District("LUD")
38 Map amendment from Improved Subdivision ("IS")to Commercial 1 ("C 1")for the Property; and
39
40 WHEREAS, on July 7, 2025, the Applicant held a community meeting, as required by
41 Monroe County Land Development Code ("LDC" or "Code") Section 102-158(a) to discuss the
42 requested FLUM amendment and the corresponding LUD Map amendment, and provide for public
43 participation; and
44

I WHEREAS, the Monroe County Development Review Committee ("DRC") considered
2 the proposed amendment at a regularly scheduled public meeting held on August 26, 2025; and
3
4 WHEREAS, on August 27, 2025, the DRC Chair signed Resolution No. DRC 15-25,
5 recommending approval of the proposed map amendment; and
6
7 WHEREAS, the Monroe County Planning Commission held a public hearing on the 22nd
8 day of October 2025, for review and recommendation on the proposed FLUM amendment; and
9
10 WHEREAS, the Monroe County Planning Commission adopted Resolution No. P31-25
11 recommending to the Monroe County Board of County Commissioners (`BOCC", "Monroe
12 County", "Board", or the "County") approval of the proposed map amendment; and
13
14 WHEREAS, at a regular public meeting held on the 10th day of December 2025, the
15 Monroe County BOCC held a public hearing to consider the transmittal of the proposed FLUM
16 amendment, considered the Department's professional staff report and provided for public
17 comment and public participation in accordance with the requirements of state and local law and
18 the procedures adopted for public participation in the planning process; and
19
20 WHEREAS, the State Land Planning Agency (Florida Department of Commerce or
21 "FloridaCommerce") reviewed the amendment and issued an Objections, Recommendations and
22 Comments ("ORC")report on February 17,2026, and was received by the County on February 17,
23 2026 and
24
25 WHEREAS,the ORC report did not identify any objections,but did identify one comment
26 to the proposed amendment; and
27
28 WHEREAS, the County has 180 days from the date of receipt of the ORC to adopt the
29 proposed amendment, adopt the amendment with changes or not adopt the amendment; and
30
31 WHEREAS, at a regularly scheduled meeting on the 1 lth day of March 2026, the BOCC
32 held a public hearing to consider adoption of the proposed FLUM amendment;
33
34 WHEREAS,the BOCC made the following findings of fact and conclusions of law:
35
36 1. The proposed FLUM is not anticipated to adversely impact the community character
37 of the surrounding area; and
38 2. The proposed FLUM is not anticipated to adversely impact the Comprehensive Plan
39 adopted Level of Service (LOS); and
40 3. The proposed amendment is consistent with the Goals, Objectives and Policies of the
41 Monroe County Year 2030 Comprehensive Plan; and
42 4. The proposed amendment is consistent with the Principles for Guiding Development
43 for the Florida Keys Area of Critical State Concern, Section 380.0552(7), Florida
44 Statutes; and
45 5. The proposed amendment is consistent with Part 11 of Chapter 163, Florida Statutes;
46 and

1 6. The proposed amendment will not result in an adverse change in community character
2 to the sub-area which a proposed amendment affects or to any area in accordance with
3 the Key Largo Livable Communikeys Master Plan pursuant to findings of the BOCC.

5 NOW, THEREFORE, BE IT ORDAINED BY THE MONROE COUNTY BOARD
6 OF COUNTY COMMISSIONERS:

8 Section 1. The foregoing recitals, findings of fact, and conclusions of law are true and correct
9 and are hereby incorporated as if fully set forth herein.

11 Section 2. The analysis, findings of fact, conclusions of law, and determinations in or
12 referenced within the February 17, 2026-dated Monroe County Planning and
13 Environmental Resources Department professional staff report from Department
14 Planning Policy Advisor Barbara Powell and Department Senior Director Devin
15 Tolpin, A.LC.P.,2 C.F.M.3 accompanying this BOCC agenda item is/are approved
16 and adopted, as the BOCC's own analysis, findings of fact, conclusions of law, and
17 determinations, and the BOCC hereby incorporates said professional staff report in
18 its entirety as if fully set forth herein.

20 Section 3. The Future Land Use Map of the Monroe County Year 2030 Comprehensive Plan
21 is amended as follows:
22
23 The property located at 106261, 106271, and 106281 Overseas Highway,
24 Key Largo, currently having Parcel Identification Numbers 00538820-
25 000000, 00538810-000000, and 00538800-000000 ("subject property" or
26 the "Property"), is changed from Residential Medium ("RM") to
27 Commercial ("COMM") as shown on Exhibit 1., attached hereto and
28 incorporated herein.

30 Section 4. To the extent of any internal or external conflicts, inconsistencies, and/or
31 ambiguities, within this Ordinance or between this Ordinance and the Monroe
32 County Code of Ordinances, Florida Building Code, Florida Statutes, Florida
33 Administrative Code, Monroe County Land Development Code, Monroe County
34 Comprehensive Plan, or any other approval of the Monroe County Board of County
35 Commissioners, Monroe County Planning Commission, Monroe County
36 Development Review Committee, Monroe County Planning & Environmental
37 Resources Department, Monroe County Building Department, Monroe County
38 Floodplain Management Office, or other department or office of Monroe County,
39 the more restrictive rule, regulation, law, provision, interpretation, and text shall
40 always apply.

42 Section 5. Subject to Section 4. above, the interpretation of this Ordinance and all provisions
43 of the Monroe County Comprehensive Plan, Florida Building Code, Monroe
44 County Codes, Florida Statutes, and Foodplain management regulations whose
2 American Institute of Certified Planners(A.LC.P.)—Certification.
3 Association of State Floodplain Managers(A.S.F.M.)—Certified Floodplain Manager(C.F.M.).

I interpretation arise out of, relate to, or are interpreted in connection with this
2 Ordinance, shall be liberally construed and enforced in favor of Monroe County,
3 and such interpretation shall be entitled to great weight in adversarial administrative
4 proceedings, at trial, in bankruptcy, and on appeal.

6 Section 6. This Ordinance neither ratifies nor approves,nor shall be interpreted as ratifying or
7 approving, any violation or violations of the Monroe County Code of Ordinances,
8 Monroe County Land Development Code, Monroe County Comprehensive Plan,
9 floodplain management regulations, or any law,rule, or regulation, and shall not be
10 construed as ratifying or approving of any such violation of law(s), rule(s), or
11 regulation(s).

13 Section 7. Approval of this Ordinance shall not estop or waive, nor shall be construed as
14 estopping or waiving, Monroe County's right to enforce, seek enforcement of, and
15 require compliance with the Monroe County Codes, Monroe County
16 Comprehensive Plan, floodplain management regulations, Florida Building Code,
17 Florida Statutes, Florida Administrative Code, or any other law, rule, or regulation,
18 whether at law or in equity.

20 Section 8. Severability, Partial Invalidity, and Survival of Provisions. If any provision of
21 this Ordinance, or any section, subsection, or part or portion thereof, is held to be
22 invalid or unenforceable by any administrative hearing officer or court of
23 competent jurisdiction, the invalidity or unenforceability of such provision, or part
24 or portion thereof, shall neither limit nor impair the operation, enforceability, or
25 validity of any other provisions of this Ordinance, or any remaining section(s),
26 subsection(s),part(s), or portion(s)thereof. All other provisions,parts, and portions
27 thereof shall continue unimpaired in full force and effect.

29 Section 9. Repeal of Inconsistent Provisions. All ordinances or parts of an ordinance in
30 conflict with this Ordinance are hereby repealed to the extent of said conflict. The
31 repeal of an ordinance herein shall not repeal the repealing clause of such ordinance
32 or revive any ordinance which has been repealed thereby.

34 Section 10. Transmittal. This Ordinance shall be transmitted by the Director of Planning to
35 the State Land Planning Agency pursuant to Chapters 163 and 380,Florida Statutes.

37 Section 11. Filin2 and Effective Date. This Ordinance shall be filed in the Office of the
38 secretary of the State of Florida but shall not become effective until a notice is
39 issued by the State Land Planning Agency or Administration Commission finding
40 the amendment in compliance, and if challenged, until such challenge is resolved
41 pursuant to Chapter 120, Florida Statutes.

43 Section 12. Inclusion in the Comprehensive Plan. The foregoing amendment shall be
44 incorporated in the Monroe County Comprehensive Plan and included on the Future
45 Land Use Map.
