HomeMy WebLinkAboutCudjoe Transfer Station Assessment, 1st Amendment 03/31/2026 FIRST AMENDMENT TO TASK ORDER FOR PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES BETWEEN MONROE COUNTY AND CPH CONSULTING, LLC. FOR THE CUDJOE KEY TRANSFER STATION STRUCTURAL ASSESSMENT & REPAIRS In accordance with the Agreement for Professional Architectural and Engineering Services, made and entered into on January 18, 2023, between MONROE COUNTY, (“County”) and CPH CONSULTING, LLC. (“Consultant”), collectively ("the parties") where professional services are allowed if construction costs do not exceed $7,725,000.00, or for study activity if the fee for professional services for each individual study under the contract does not exceed $7,725,000.00, or for study activity if the fee for professional services for each individual study under the contract does not exceed $500,000.00 (“Agreement”), as provided in Subsection 287.055(2)(g), Florida Statutes, as amended by Section 2, Chapter 2024-204, Laws of Florida, pursuant to which Recital No. 2 and Attachment A, Subsection 1.01 of the Contract is hereby modified, the parties enter into this First Amendment to Task Order (“First Amendment”). All terms and conditions of the Agreement apply to this First Amendment, unless this First Amendment amends, adds, or modifies a provision or an Article of the Agreement, in which case, the provision or Article will be specifically referenced in this First Amendment and the amendment, addition, or modification will be precisely described. 31stMarch This First Amendment is effective on the ________ day of _____________________ 2026. WHEREAS, the parties executed a Task Order on January 26, 2026, whereby the Consultant performed a Structural Assessment of the Cudjoe Key Transfer Station tipping floor which had sustained damage due to a recent structure fire; and WHEREAS, the Structural Assessment Report has been received and reviewed by the County and the County now desires to have the Consultant provide design drawings and construction observation services for the repair of the Cudjoe Key Transfer Station tipping floor. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the parties agree as follows: 1. In accordance with Article II, SCOPE OF BASIC SERVICES of the Professional Architectural and Engineering Services Agreement, the Consultant shall provide engineering design services through construction administration for the repairs to the Cudjoe Key Transfer Station tipping floor. The Scope of Work shall include the following: a) Preparation of Repair Construction Documents. Construction documents shall include: i. Partial Demolition Plans ii. Framing Plans, Schedules, and Details iii. Structural Repair Details Page 1 of 3 iv. Cost Estimate v. Specifications for all applicable sections b) Bidding Support Services. i. The Consultant shall review and respond to Requests for Information (RFIs) ii. The Consultant shall evaluate bids and provide recommendations to County on award of the Contractor iii. The Consultant shall review and advise proposed product substitutions by the Contractors iv. The Consultant shall provide assistance with Addenda c) Permitting Support Services. i. The Consultant shall provide signed and sealed permit documents for the permitting agencies as needed ii. The Consultant shall coordinate the permit submittals and track each to the completion of the process where applicable iii. The Consultant shall review and respond to comments from the permitting agencies including making any required revisions to the design in order for permits to be issued d) Construction Observation Services. i. The Consultant shall review and respond to Requests for Information (RFIs) ii. The Consultant shall review product submittals and/or shop drawings from the Contractor iii. The Consultant shall conduct one (1) site visit to meet with the County’s Insurance Inspector iv. The Consultant shall conduct one (1) final observation site visit at or near completion of the project to confirm compliance with construction drawings 2. In accordance with Article VII, Subparagraph 7.1.1 of the Agreement, the County shall pay the Consultant a Not-to-Exceed total of Thirty-Nine Thousand, Five Hundred and 00/100 Dollars ($39,500.00) paid on a percent complete basis for the following tasks: a)Structural Repair Design -$28,500.00 lump sum upon receipt of documentation and approval by the Director of Facilities and Project Management. b) Construction Observation - $8,500.00 lump sum upon project completion and approval by the Director of Facilities and Project Management. c) Reimbursable Expenses - $2,500.00 not-to-exceed upon receipt of backup documentation and approval by the Director of Facilities and Project Management. The Total Not-To-Exceed amount of this Task Order including this First Amendment is Forty-Seven Thousand, Five Hundred and No Cents ($47,500.00).
