ITEM BACKGROUND: Monroe County Land Development Code (LDC) Section 135-3(g) states: Powers and duties. The HPC has the following powers and duties: (13) Provide an annual report to the BOCC detailing the actions of the HPC dining the prior year and the current state of historic preservation in the unincorporated area of the county. The HPC Annual Report, as adopted through HPC Resolution No. HP 08-2026, has been included as an attachment. PREVIOUS RELEVANT BOCC ACTION: On June 09, 1999, the BOCC adopted Ordinance No. 022-1999, which amended the text of the Monroe County Land Development Regulations to establish regulations for the preservation of historical properties and archaeological, historical or cultural landmarks, create a Historic Preservation Commission, establish the powers and duties of the Historic Preservation Commission, adopt standards and guidelines for the review of development projects, and added definitions and provided for certificates of appropriateness. On August 17, 2005, the BOCC adopted Ordinance No. 019-2005, which amended the text of the Monroe County Land Development Code (LDC) to create the Tavernier Historic District Overlay and amended the text related to Certificates of Appropriateness, adopted the Tavernier Historic Preservation Guidelines by reference,amended the Land Use District Map to designate the Tavernier Historic District as the Tavernier Historic District Overlay, established the Tavernier Historic District Overlay, and adopted standards and guidelines for the review of development projects,added definitions and provided for certificates of appropriateness for certain development within the Tavernier Historic District. INTRODUCTION: 20 21 Pursuant to Monroe County Land Development Code (LDC) Section 135-3(g), the Historic 22 Preservation Commission ("HPC" or "Commission") possesses certain powers and duties 23 which include: (13) 24 "Provide an annual report to the BOCC detailing the actions of the HPC during the prior 25 year and the current state of historic preservation in the unincorporated area of the 26 county". 27 28 Hereinafter is a reporting of the 2025 calendar year and current state of historic preservation 29 in unincorporated Monroe County. 30 31 II. KEY FACTS: 32 33 Members: 34 35 Pursuant to LDC Section 135-3(b),the HPC consists of five members appointed by the Monroe 36 County Board of County Commissioners ("BOCC"). Each member shall be a resident of the 37 county at the time of appointment and during his term in office. 38 39 Through Year 2025, two HPC members resigned (Edward Blanco and Barbara Bauman) and 40 two new replacement members were added. The Commission currently consists of: 41 42 • Brian Shea, Chair: urban/regional planner 43 • Kate DeLoach, Vice Chair: layman 44 • Brad Bertelli, Member: historian 45 • Erica Poole, Member: architect 46 • Leslie Calero, Member: art and antiquities expert 47 48 Staff. 49 50 Pursuant to LDC Section 135-3(d), the Planning Director shall designate staff to advise and 51 provide clerical support to the HPC. Pursuant to LDC Section 135-10(a),the BOCC may enter 52 into an agreement with the Historic Florida Keys Foundation ("Foundation") assigning to the 53 Foundation, some or all, the duties of the Planning Director under this article. BOCC Staff Report Araival Report of the HPC Page 1 of 7 I Through Fiscal Year 2025, the BOCC had an agreement with the Foundation to review HPC 2 agenda items for compliance with local, state,and federal historic and preservation regulations. 3 The Executive Director of the Foundation, Diane Silvia, acted as the HPC Coordinator. 4 Planning staff provided administrative and clerical support to the HPC and the Foundation and 5 a Planning Department Staff member was assigned as a liaison to the HPC to provide guidance 6 to the HPC with regards to other land development regulations which may impact items under 7 review by the Commission. BOCC Staff Report Araival Report of the HPC Page 2 of 7 I The CLG program was enacted as part of the National Historic Preservation Act Amendments 2 of 1980 and links federal, state, and local governments into a preservation partnership for the 3 identification, evaluation and protection of historic properties.i 4 5 In coordination with the HPC, staff submitted the 2024-2025 Certified Local Government 6 Annual Report to the Florida Department of State Bureau of Historic Preservation ("Bureau") 7 on November 3rd, 2025. Monroe County received a letter from the Bureau, dated December 8 16, 2025, confirming with receipt of the CLG annual report and the County's status. 9 10 Bureau's designation for Monroe County's CLG status in 2025: Good Standing. 11 12 Grants: 13 14 Pursuant to LDC Section 135-3(g)(12), the HPC has the power and duty to identify and 15 recommend to the BOCC sources for grant assistance from state, federal, and private sources 16 for the purpose of historic preservation. 17 18 Grants recommended to the BOCC and/or applied for by Monroe County in 2025: None. 19 20 Text Amendments: 21 22 Pursuant to LDC Section 135-3(g)(7), the HPC has the power and duty to recommend land 23 development regulations, comprehensive plan amendments, and municipal code amendments 24 to the Planning Director to assist in the preservation of historic properties. 25 26 Text amendments recommended to the Planning Director in 2025: None. 27 28 Rules of Procedure Amendments: 29 30 Pursuant to LDC Section 135-3(g)(1), the HPC has the power and duty to adopt and amend 31 rules of procedure to the extent such that they are not inconsistent with this Land Development 32 Code, the Comprehensive Plan, or state laws. 33 34 Amendments to rules of procedure in 2025: None. 35 36 Florida Master Site File: 37 38 Pursuant to LDC Section 135-3(g)(10), the HPC has the power and duty to identify historical 39 buildings, sites, structures, objects and archeological sites in the unincorporated areas of the 40 county which may become part of the Florida Master Site File. 41 42 The Florida Master Site File is the State of Florida's official inventory of historical and cultural 43 resources, including archaeological sites, historical structures, historical cemeteries, historical 44 bridges, and historic districts, landscapes, and linear features.2 45 46 Total number of sites inventoried in unincorporated Monroe County in 2025,added by Historic 47 Florida Keys Foundation: 3. 48 • 3 on Crane Boulevard, Upper Sugarloaf Key 49 50 Ad Valorem Tax Exemption: Certified Local Goverranents.https://dos.fl.gov/historical/preservation/certified-local-governments/ Florida Master Site File.https://dos.fl.gov/historical/preservation/inaster-site-file/ BOCC Staff Report Amival Report of the HPC Page 3 of 7 I Pursuant to LDC Section 135-32, the BOCC may grant an ad valorem tax exemption of 100 2 percent of the assessed value of all improvements that result from the restoration, renovation, 3 or rehabilitation of such properties, after the BOCC's receipt of a recommendation from the 4 Division of Historical Resources of the Florida Department of State ("Division"). 5 6 Pursuant to LDC Section 135-33(a), only property described as historic property in Section 7 135-31 and located within the unincorporated county is eligible for an application for the ad 8 valorem tax exemption authorized by Section 135-32. 9 10 Pursuant to LDC Section 135-31, historic property, means a building, site, structure or object 11 that is designated as an archeological, historical or cultural landmark under Article I of this 12 chapter. 13 14 Pursuant to LDC Section 135-33(b), the Division is hereby designated as the representative of 15 the BOCC for reviewing application for the tax exemption authorized by Section 135-32. 16 17 Number of Ad Valorem Tax Exemption projects /improvements in 2025: None. 18 19 National Register of Historic Places: 20 21 Pursuant to LDC Section 135-3(g)(8), the HPC has the power and duty to make 22 recommendations on nominations of historic property to the National Register of Historic 23 Places. 24 25 Pursuant to LDC Section 135-2,National Register of Historic Places means the list of historic 26 properties significant in American history, architecture, archeology, engineering, and culture, 27 maintained by the Secretary of the Interior,as established by the National Historic Preservation 28 Act of 1966 (16 USCA 470), as amended. 29 30 Number of recommendations on nominations to the National Register of Historic Places in 31 2025: None. 32 33 Certificates of Appropriateness: 34 35 Pursuant to LDC Section 135-2, Certificate of appropriateness means an authorization for 36 work to be done to a designated historic property or structure or any property or structure 37 within the Tavernier Historic District. 38 39 There are two types of certificates: 40 41 (1) Regular Certificate of Appropriateness (RCOA): issued by the Planning Director for 42 ordinary repairs or maintenance to a designated historic property or structure, or any 43 property or structure within the Tavernier Historic District and as described in subsection 44 135-6(a)(2); and 45 (2) Special Certificate of Appropriateness (SCOA): issued by the Historic Preservation 46 Commission for the renovation, rehabilitation, restoration, or demolition of a contributing 47 or designated historic property or structure, for new construction within the Tavernier 48 Historic District, or for permission to dig or otherwise excavate in the case of an 49 archeological landmark. All renovation, rehabilitation, restoration, or demolition of 50 contributing or designated historic public property or structures shall also be approved by 51 the BOCC, following recommendation by the Historic Preservation Commission. In an effort to streamline and increase the efficiency of 14 the building permit review process,Planning Department staff worked with IT administrators, 15 through 2024 and 2025,to reduce the number and types of building permit applications which 16 were previously automatically assigned Planning staff review by the software where Planning 17 staff review was not needed. 18 19 To ensure building permit applications which require a historical review for compliance were 20 not filtered away in this automatic filtering, Planning staff created an additional dataset of all 21 properties in unincorporated Monroe County which require review for compliance with LDC 22 Chapter 135 Historic and Cultural Resources. IT staff used this dataset to code software 23 parameter conditions to flag all such properties and continue to automatically assign 24 Planning/Historical review for these building permits. 25 26 Planning staff tested the software with the historic parameters and verified the condition 27 successfully worked as intended. The Community Development / Opal software has been 28 automatically assigning Planning/Historical reviews for building permit applications of 29 relevant properties since June 2025. 30 31 Updates to the Tavernier Historic District Preservation Guidelines: 32 33 On September 14, 2023, the BOCC entered into a contract with the Archaeological & 34 Historical Conservancy for professional services to update the Tavernier Historic District 35 Preservation Guidelines written in 2005 to meet current conditions, pursuant to a Small 36 Matching Grant from the State of Florida, Department of State, Division of Historical 37 Resources (Grant No. 24.h.sm.100.003). At which time, County staff identified significant 38 insufficiencies in the regulatory implementation and recommended revisions of the revised 39 guidelines. Planning Commission Resolution No. P11-24 was issued on August 12th, 2024, 40 recommending denial of the adoption of the revised guidelines. 41 42 Planning staff and Historic Florida Keys Foundation staff with guidance from the HPC worked 43 diligently throughout 2025 to improve the drafted updated Tavernier Historic District 44 Preservation Guidelines to be more useful and provide more thorough guidance to the general 45 public. Staff are preparing to submit the improved updated Tavernier Historic District 46 Preservation Guidelines to the Planning Commission for consideration in early 2026. 47 48 Indian Key State Historic and Archeological District: 49 50 The Indian Key State Historic and Archeological District is currently part of the State Park 51 system. The HPC recently considered and approved two SCOAs (one of which was approved 52 January, 2026 and another in September, 2024) for improvements to access infrastructure in BOCC Staff Report Araival Report of the HPC Page 6 of 7 I the State Park, including restoring trails and rebuilding a dock damaged in Hurricane Irma in 2 2017. The restoration of this site is an on-going project. The HPC and staff look forward to the 3 forthcoming restoration of access to this irreplaceable site. 4 5 IV.CHALLENGES 6 7 Staffing Change: 8 9 County staff navigated a challenging change in HPC organization when the contract with 10 Historic Florida Keys Foundation came to an end on September 30, 2025. Existing County 11 staff members were onboarded to provide staffing and administrative responsibilities for the 12 HPC. The loss of an expert professional preservationist from the Foundation as part of HPC 13 staffing was challenging. However, County staff have successfully maintained continuity of 14 the duties and responsibilities of the HPC during this transition and County staff are further 15 examining methods to increase efficiency in review of RCOAs and SCOAs. 16 17 V. 2026 PROJECTS: 18 19 County staff and HPC members will continue to fulfill the duties outlined in LDC Sec. 135-3. 20 Additionally, the HPC has requested assistance from the Planning and Environmental 21 Resources Department to implement the following projects in 2026: 22 23 Webpage: 24 25 As part of the input provided by HPC members on the updated Tavernier Historic District 26 Preservation Guidelines, members indicated interest in an overall guide for residents and 27 applicants regarding the Certificate of Appropriateness process. Planning staff have taken this 28 guidance and are reviewing the functionality of a County webpage, similar to the webpage for 29 the Special Vacation Rental Program, dedicated to directing the public towards historic 30 resources and guidance. 31 32 Planning Staff GIS Training: 33 34 To increase efficiency and software functionality, Planning staff have coalesced important 35 historical spatial data as layers and tools in GIS. Planning staff are actively training how to use 36 and share these tools to improve and streamline building permit review,property analyses, and 37 customer service. 38 39 Identifying Properties with Historical Significance: 40 41 The HPC has requested Planning staff to begin preparing a review of properties throughout 42 unincorporated Monroe County with buildings at least 50 years old.
