AGENDA ITEM WORDING: Approval of a Resolution supporting the mission of the Older
American Advisory Board; clarifying that the advisory board is a citizen-led volunteer group in nature
and does not operate as a formal advisory board of the County; and rescinding Resolution Nos. 038-
1988, 260-2002, and such other formal motions and actions taken by the Monroe County Board of
County Commissioners in relation to the Older American Advisory Board to clarify the independence
of the County. TIME APPROXIMATE 1:30 P.M.
ITEM BACKGROUND: The federal law known as the Older Americans Act was originally enacted
in 1965 and most recently amended in 2020. It requires States to designate Area Agencies on Aging
and establish advisory councils to support planning and services for older adults in order to receive
federal funds pursuant to the law. While historical records are limited, it is believed that the Monroe
County Board of County Commissioners facilitated the formation of the Monroe County Older
Americans Advisory Board (OAAB)prior to the current Area Agency designation structure to support
compliance with the Older Americans Act and the receipt of federal funding. However, no evidence of
local legislative formation, either by ordinance or resolution of the County, could be found to clarify
the inception of the Monroe County OAAB.
The State of Florida, through the Department of Elder Affairs, has designated the Alliance for
Aging, Inc. as the Area Agency on Aging for Planning and Service Area 11, which includes Monroe
County, and that agency maintains the required advisory council. Under this designation structure, the
County engages with the Alliance for Aging, Inc. to receive federal funding passed down to it from
the State.
This resolution expresses BOCC's support for the OAAB's mission, but specifically clarifies that
OAAB is not a formal advisory board of the County, rescinds prior actions by the BOCC to eliminate
any ambiguity regarding its association, and confirms that the County will not provide staff support
for the citizen-led volunteer group. Additionally, this resolution confirms that the BOCC has not
delegated powers, duties, or assigned fact-finding functions to OAAB. Last, it establishes clear
independent governance expectations while encouraging continued community engagement on issues
affecting older adults, albeit on equal footing with other citizen-led volunteer groups within the
community.
PREVIOUS RELEVANT BOCC ACTION: BOCC approved an item reflecting annual
appointments to the OAAB on 05/20/2015; however, no citizen appointments have been made since
that time. BOCC approved OAAB's revisions to its by-laws on 04/16/2008. BOCC approved
Resolution No. 260-2002 supporting OAAB and AARP's concerns regarding water rates on
06/19/2002. The earliest ascertainable record is BOCC's adoption of Resolution No. 038-1988 that
amended a section within the existing OAAB by-laws related to membership on 01/19/1988.

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA,
SUPPORTING THE MISSION OF THE OLDER AMERICAN
ADVISORY BOARD AND CLARIFYING THAT THE
ADVISORY BOARD IS A CITIZEN-LED VOLUNTEER
GROUP IN NATURE, AND DOES NOT OPERATE AS A
FORMAL ADVISORY BOARD OF THE COUNTY;
RESCINDING RESOLUTION NOS. 038-1988, 260-2002, AND
SUCH OTHER FORMAL MOTIONS AND ACTIONS
TAKEN BY THE MONROE COUNTY BOARD OF COUNTY
COMMISSIONERS IN RELATION TO THE OLDER
AMERICAN ADVISORY BOARD IN ORDER TO CLARIFY
THE INDEPENDENT ROLE AND RESPONSIBILITIES OF
THE COUNTY MOVING FORWARD; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the United States Congress originally passed the Older Americans Act in
1965; and
WHEREAS, the Older Americans Act, as amended in 2020 (hereinafter "Act"), requires
state agencies on aging to perform certain activities and provide reasonable assurances in order to
receive federal funding under the Act; and
WHEREAS, among those activities and assurances is the requirement that each state
agency on aging must select area agencies on aging, and those area agencies must then establish
an advisory council to facilitate community planning with regard to social services, as well as
research and development projects in the field of aging; and
WHEREAS, for the past several years, the State of Florida through the Department of
Elder Affairs, has designated the Alliance for Aging, Inc. as the area agency on aging for the
planning and service area 11 (PSA-11), inclusive of Monroe County; and
WHEREAS, Alliance for Aging, Inc. has established the required advisory council to
ensure compliance with state and federal laws; and

WHEREAS, although historical records from 1965 have been difficult to assemble, it is
believed that before the Alliance for Aging, Inc. was selected as the area agency on aging, the
Board of County Commissioners (hereinafter `BOCC") facilitated the formation of the Monroe
County Older American Advisory Board, to ensure compliance with the Act and the County's
receipt of federal funds; and
WHEREAS, starting in 2000 and possibly even earlier, the Alliance for Aging, Inc. was
designated as the area agency on aging, and created its own advisory council, thus the nature of
the Monroe County Older American Advisory Board became unclear; and
WHEREAS, exhaustive efforts were made to discover the Monroe County Older
American Advisory Board originating legislation, no resolution nor ordinance was found to
provide an independent authority or purpose for its continuation, and there is no evidence to
support that the Monroe County Older American Advisory Board plays any part in the decision-
making process of the BOCC; and
WHEREAS, in the absence of any formally delegated duties or advisory board functions,
the Monroe County Older American Advisory Board is tantamount to a citizen-led volunteer group
that acts independently from the BOCC, and is not subject to Florida's Sunshine Law; and
WHEREAS, in past transactions, the BOCC has accepted the group's bylaws which were
authored by the Monroe County Older American Advisory Board, itself, intermittently ratified
nominations or appointed its members; and in one instance, passed a resolution in support of an
issue raised by the Monroe County Older American Advisory Board and the AARP Chapters in
the Florida Keys; and
WHEREAS,the BOCC fully supports the mission of the Monroe County Older American
Advisory Board as a civilian-led volunteer group that provides guidance and general
recommendations to service providers and coordinators in relation to programs for older adults
within Monroe County; and
WHEREAS, it is important that the BOCC clarify that it has not created the Older

American Advisory Board to act as an instrumentality on behalf of Monroe County; furthermore,
the BOCC has not delegated powers, duties, or assigned fact-finding functions to the Monroe
County Older American Advisory Board, nor is there any ascertainable legislative history that
depicts an intent to create or vest powers in the Monroe County Older American Advisory Board
as one of the official advisory boards to the BOCC; and
WHEREAS,moving forward and in furtherance of resolving any ambiguities, the BOCC
hereby rescinds all past actions approved by the BOCC as they relate to the Monroe County Older
American Advisory Board, and clarifies that such volunteer group is not a formal advisory board
of Monroe County, nor the BOCC; and
WHEREAS,the BOCC further clarifies that Monroe County(BOCC) employees will not
be assigned as support staff to the volunteer group, and any role or function assigned to the BOCC
as detailed in the group's bylaws are non-binding upon the BOCC or Monroe County (to wit: the
BOCC will not appoint members to, nor remove members from, the volunteer group, etc.); and
WHEREAS, the BOCC encourages the citizen-led volunteer group to continue its efforts
to fulfill its important mission, and welcomes its involvement in County programs and operations
on equal footing as other citizen-led volunteer groups within the community; and
WHEREAS, the BOCC hereby finds and determines that the actions described herein
serve the best interests of the residents, visitors, and business owners in Monroe County, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Section 1: That the foregoing"WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution.
Section 2: That the County Commission hereby rescinds Resolution No. 038-1988,
Resolution No. 260-2002, and such other formal motions and actions taken by the County
Commission in relation to the Monroe County Older American Advisory Board in order to clarify
that such volunteer organization or entity is not created by law,and is not an advisory board created
by the Monroe County Board of County Commissioners to provide services to Monroe County,
Florida.

Section 3: That all resolutions or parts of resolutions in conflict with this resolution are
hereby rescinded to the extent of such conflict.
Section 4: That if any clause, section, other part or application of this resolution is held
by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it
shall not affect the validity of the remaining portion or applications of this resolution.
Section 5: That this resolution shall be in full force and effect immediately upon its
adoption.

Vacancies
1. In case of any vacancy on this Board, the

RESOLUTION NO. 260 -2002
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA SUPPORTING THE OLDER AMERICAN ADVISORY BOARD AND
AARP CHAPTERS IN FLORIDA KEYS CONCERNS REGARDING WATER RATES
WHEREAS, new water rates have been established by the Florida Keys Aqueduct Authority
(FKAA); and
WHEREAS,the new FKAA plan applies a $10 per month base facility charge; and
WHEREAS, there used to be a FKAA 20% discount for senior citizens which was eliminated;
and
WHEREAS, the period to determine eligibility for discount has been January through
March; and
WHEREAS, FKAA uses the maximum amount of Social Security Income of $18,432 for
determining the eligibility of senior citizens to have the base fee waived; and
WHEREAS, Social Security currently pays a maximum of $19,920 for a one person
household and $29,880 for a two person household composed of a senior and a spouse 60 years or
older; and
WHEREAS, individuals on a fixed income who are disabled were not previously considered
under the FKAA plan; and
WHEREAS, FKAA had previously provided no late charge penalty against seniors; and
WHEREAS, currently now have a late charge penalty of $4 or 10% of the balance,
whichever is greater; and
WHEREAS, the rate for the low volume consumer is the same as the rates for the big
volume consumer and there is no incentive,therefor to conserve water; and
WHEREAS, the Older Americans Advisory Board and HARP Chapters in the Florida Keys
have raised concerns about the above factors; and
WHEREAS, the Older Americans Advisory Board and HARP Chapters in the Florida Keys
have proposed certain changes to the FKAA Plan; and
WHEREAS,said proposed changes include the following:
• restoring the 20% discount to senior citizens, determining eligibility year-round,
• raising the maximum Social Security payment level to $19,920 for a one person
household and $29,880 for a two person (senior and spouse 60 years or older)
household, and changing this annually in accordance with changes by Social Security,
• providing a discount to disabled people on fixed income ($20,268 maximum income for
one person and $30,564 maximum for one person with spouse),
• eliminating the $10 per month base facility charge for both senior and disabled people
on fixed income with the levels of income as previously stated or elimination of the $10
per month base facility charge for seniors and disabled people on fixed income,
regardless of level of income,
• eliminating the late charge penalty for seniors and disabled people on fixed income, and
• providing rates which have an incentive built in for low consumers; now, therefore
BE IT RESOLVED THAT THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA is in full support of the concerns and recommendations of the Older
Americans Advisory Board and HARP Chapters in the Florida Keys regarding water rates.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida,
at a regular meeting of said Board held on the 19 th day of June, 2002.

A RESOLUTION AMENDING ARTICLE I ENTITLED
"MEMBERSHIP" OF THE BYLAWS OF THE MONROE
COUNTY OLDER AMERICANS ADVISORY BOARD.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that Article I entitled "Membership" of
the Bylaws of the Monroe County Older Americans Advisory Board is
hereby amended to read as follows :
"Article I
Membership
The membership of this Board shall consist of 16
members and one (1) ex officio member, who shall be
residents of Monroe County. They shall be allocated as
follows :
1 . Three (3) citizens from the Upper Keys .
2 . Three (3) citizens from the Middle Keys .
3 . Three (3) citizens from Big Pine Key.
4 . Three (3) citizens from Key West.
5 . Four (4) presidents , one from each of the
areas listed in items 1 through 4 , above .
6 . One (1) ex officio member who shall be a
County Commissioner as designated by the
Board of County Commissioners of Monroe
County, Florida.
All members must be 55 years of age or over,
except the ex officio County Commissioner member. "
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 19th day of January, 1988 .
