AGENDA ITEM WORDING: Approval of a Resolution authorizing the donation of three (3)
Monroe County Community Services Department vehicles to Guidance/Care Center, Inc., and
expressly finding that such donation is in the best interest of Monroe County, Florida; and further
authorizing the Mayor, County Administrator, or Director of Community Services to execute any
necessary documents.
ITEM BACKGROUND: On January 28, 2026, the Board of County Commissioners (BOCC)
approved Agenda Item N2 declaring the subject vehicles as surplus, and indicating an intent to donate
the vehicles to the Guidance/Care Center, Inc. (hereinafter"GCC"). This resolution is presented to
clarify the determination of the BOCC that such donation is in the best interest of Monroe County,
consistent with Sections 125.38 and 274.05, Florida Statutes.
Monroe County Community Services has entered into an agreement with GCC to provide
Transportation Disadvantaged services throughout the County. As a result, the County no longer has
an operational need to retain ownership of these vehicles. Continued ownership would result in
uneconomical ongoing County costs, including maintenance, insurance, inspections, and compliance
with federal reporting requirements associated with 49 U.S.C. § 5310, entitled"Enhanced Mobility
and Seniors & Individuals with Disabilities Program," as these are grant-funded vehicles, without
corresponding operational benefit.
The Florida Department of Transportation (FDOT)has reviewed and approved the transfer of these
vehicles to GCC as an eligible subrecipient within the same service area and § 5310 program,
consistent with applicable federal and state requirements governing the transfer of transit assets. As
such, and to facilitate the transfer, FDOT has provided Lien Satisfaction letters for each vehicle as of
December 8, 2025.
GCC is a nonprofit organization that meets the definition of a"private nonprofit agency"pursuant to
Section 273.01(3), Florida Statutes, in that it is tax-exempt under Section 501(c)(3) of the Internal
Revenue Code. GCC's principal mission includes services related to public health and welfare and the
relief of human suffering in Monroe County. The donation of these vehicles will ensure the continued
provision of transportation services to vulnerable populations within Monroe County, consistent with
the original public purpose for which the vehicles were acquired.
The subject vehicles are described below in the following manner: Asset Description/VIN/MC

The vehicles are maintained in operational condition and are suitable for continued use. As set forth
above, Monroe County's Fleet Management Department has determined the Reasonable Market
Approximation for each vehicle proposed for donation, with each vehicle exceeding $5,000 and a
cumulative reasonable market approximation of approximately$129,000 for the three (3) vehicles.
Accordingly, the proposed donation serves a valid public purpose and supports the BOCC's
determination that such disposition is in the best interest of Monroe County.

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA,
AUTHORIZING THE DONATION OF THREE (3) MONROE
COUNTY COMMUNITY SERVICES DEPARTMENT
VEHICLES, WHICH HAVE BEEN DECLARED TO BE
SURPLUS PROPERTY, TO GUIDANCE/CARE CENTER,
INC., AND FINDING THAT SUCH DONATION IS IN THE
BEST INTEREST OF THE COUNTY; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS,on January 28,2026,the Board of County Commissioners(BOCC)approved
Agenda Item N2, declaring three (3) County vehicles as surplus property and indicating an intent
to donate said vehicles to the Guidance/Care Center, Inc. (hereinafter"GCC"); and
WHEREAS, the subject vehicles include the following — Vehicle 1: 2019 Ford
E450/VIN:IFDFE4FSIKDC56604/MC Fleet: Reasonable Market Approximation: $55,000;
Vehicle 2: 2017 Chevy 3500NIN: 1HA3GRBGXHN008527/MC Fleet: Reasonable Market
Approximation: $29,000; and Vehicle 3: 2019 Ford E450NIN: 1FDFE4FS5KDC03212/MC
Fleet: Reasonable Market Approximation: $45,000; and
WHEREAS, in furtherance of the approved Agenda Item N2 (surplus), BOCC confirms
that the Community Services Department has restructured its operations and no longer needs the
subject vehicles to serve County purposes, and continued ownership would result in uneconomical
ongoing County costs, including maintenance, insurance, inspections, and administrative
oversight, without corresponding programmatic benefits; and
WHEREAS, Section 125.38, Fla. Stat., provides that the BOCC, by and through a duly
adopted resolution,may convey any County-owned personal property that is no longer needed for
County purposes to a non-profit organization which may be organized for the purposes of
promoting community interest and welfare; and
WHEREAS, additionally pursuant to the above-cited state law, the BOCC may fix the
price of such conveyance,regardless of the actual value of such property,i.e.provide such property

as a donation, as long as such information is set out in the resolution authorizing the conveyance;
and
WHEREAS, GCC is a Florida registered nonprofit organization that meets the definition
of a "private nonprofit agency" pursuant to Section 273.01(3), Fla. Stat., in that it is tax-exempt
under Section 501(c)(3) of the Internal Revenue Code; and
WHEREAS, GCC's principal mission includes providing services to the community
related to public health and welfare and the relief of human suffering, as well as the provision of
Transportation Disadvantaged services throughout the County; and
WHEREAS,the subject vehicles, in particular,where purchased, at least in part-- if not in
full, through the use of the Florida Department of Transportation(FDOT) authorized funding, and
as a lienholder,FDOT has approved the donation of the subject vehicles to GCC as it is an eligible
subrecipient within the same service area and program as the County,pursuant to the requirements
of 49 U.S.C. § 5310, entitled "Enhanced Mobility and Seniors & Individuals with Disabilities
Program," and FDOT has since provided lien satisfaction letters to facilitate this donation; and
WHEREAS, consistent with Sections 274.05 through 274.07, Fla. Stat., as well as the
Monroe County Purchasing Policy, assets that have been declared surplus but hold a fair market
value of$5,000 or more may be donated to a private nonprofit agency only after the BOCC makes
a determination that the donation is in the best interest of the County; and
WHEREAS,having considered the foregoing,the BOCC hereby finds and determines that
the donation described herein serves a public purpose and is in the best interest of Monroe County,
Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Section 1: That the foregoing"WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution.

Section 2: That the County Commission has found that the following subject vehicles
are no longer needed for County purposes (each vehicle has been duly declared as surplus
property), and that the GCC is an eligible non-profit organization in need of such property to
enhance mobility for transportation disadvantaged individuals:
Vehicle 1: 2019 Ford E450/VIN:IFDFE4FS1KDC56604/MC Fleet: Reasonable Market
Approximation: $55,000;
Vehicle 2: 2017 Chevy 3500/VIN: 1HA3GRBGXHN008527/MC Fleet: Reasonable
Market Approximation: $29,000; and
Vehicle 3: 2019 Ford E450NIN: 1FDFE4FS5KDC03212/MC Fleet: Reasonable Market
Approximation: $45,000.
Section 3: That the County Commission hereby finds and determines that the donation
described herein is in the best interest of Monroe County, Florida,pursuant to the requirements of
Sections 125.38 and 274.05, Fla. Stat., the Monroe County Purchasing Policy, and any other
applicable provisions of law.
Section 4: That the Mayor, County Administrator, or Director of Community Services
Department, each independently of the other, are hereby authorized to take all necessary action(s)
and execute any necessary documents, including but not limited to title transfer documents, to
fulfill the goals of this resolution as stated herein.
Section 5: That all resolutions or parts of resolutions in conflict with this resolution are
hereby rescinded to the extent of such conflict.
Section 6: That if any clause, section, other part or application of this resolution is held
by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it
shall not affect the validity of the remaining portion or applications of this resolution.
Section 7: That this resolution shall be in full force and effect immediately upon its
adoption.

ITEM BACKGROUND: F.S. 274.05-274.07 and Monroe County Purchasing Policy state that
the Board of County Commissioners shall approve the disposal of items that have been declared to be
surplus by the Property Manager within the office of the Clerk of the Courts. Each of the items on
the attached list has been certified by its department to be of no value. Once disposal is approved,
the items will be removed from the Fixed Asset Inventory List.

ITEM BACKGROUND. On January 28, 2026, the Board of County Commissioners (BOCC)
approved Agenda Item N2 declaring the subject vehicles as surplus, and indicating an intent to donate
the vehicles to the Guidance/Care Center, Inc. (hereinafter"GCC"). This resolution is presented to
clarify the determination of the BOCC that such donation is in the best interest of Monroe County,
consistent with Sections 125.38 and 274.05, Florida Statutes.
Monroe County Community Services has entered into an agreement with GCC to provide
Transportation Disadvantaged services throughout the County. As a result,the County no longer has
an operational need to retain ownership of these vehicles. Continued ownership would result in
uneconomical ongoing County costs, including maintenance, insurance, inspections, and compliance
with federal reporting requirements associated with 49 U.S.C. § 5310, entitled "Enhanced Mobility
and Seniors& Individuals with Disabilities Program," as these are grant-funded vehicles, without
corresponding operational benefit.
The Florida Department of Transportation (FDOT) has reviewed and approved the transfer of these
vehicles to GCC as an eligible subrecipient within the same service area and § 5310 program,
consistent with applicable federal and state requirements governing the transfer of transit assets. As
such, and to facilitate the transfer, FDOT has provided Lien Satisfaction letters for each vehicle as of
December 8, 2025.
GCC is a nonprofit organization that meets the definition of a"private nonprofit agency"pursuant to
Section 273.01(3), Florida Statutes, in that it is tax-exempt under Section 501(c)(3) of the Internal
Revenue Code. GCC's principal mission includes services related to public health and welfare and the

relief of human suffering in Monroe County. The donation of these vehicles will ensure the continued
provision of transportation services to vulnerable populations within Monroe County, consistent with
the original public purpose for which the vehicles were acquired.
