ITEM BACKGROUND: This is a 15-month no cost time extension to the contract.In 2023 the County held neighborhood meetings with the residents on the top 9 canals: 1) Canal 105 (Tavernier); 2) Canal 255 (Big Pine Key); 3) Canal 315 (Big Pine Key); 4) Canal 295 (Big Pine Key); 5) Canal 474 (Geiger Key); 6) Canal 297 (Big Pine Key); 7) Canal 290 (Big Pine Key); 8) Canal 287 (Big Pine Key); and 9) Canal 82 (Rock Harbor) to receive input on the potential projects. Residents on most canals voted yes to move forward with the projects and related operations and maintenance assessment. Residents on Canal 290 (Big Pine Key) and Canal 287 (Big Pine Key)voted not to move forward with the restoration and related operations and maintenance assessment and therefore Canal 266 (Big Pine Key) and Canal 299 (Big Pine Key) were substituted therefor. The design and permitting work is funded by Florida Department of Environmental Protection(FDEP) Stewardship Grant#LPA-0428. Once fully designed and permitted, the construction will be funded by RESTORE and Stewardship funds. PREVIOUS RELEVANT BOCC ACTION: 09/15/21: Approval to advertise professional services for the engineering, design, surveys, permitting, procurement, and Construction,Engineering and Inspection(CEI) services for up to 10 canal restoration projects listed in the Monroe County Canal Work Plan. 12/08/21: Approval to negotiate for professional services for the engineering, design, surveys, permitting, procurement, and CEI services for up to 10 canal restoration projects listed in the Monroe County Canal Work Plan. 01/21/22: Approval to enter into a $0 contract with Wood Environment and Infrastructure Solutions, Incorporated for professional services for the engineering, design, surveys, permitting,procurement, and CEI services for up to ten (10) canal restoration projects listed in the Monroe County Canal Work Plan. Task Orders for projects will be issued as funds become available 11/15/22: Approval to enter into a $0 Amendment No. 1 to the contract with Wood Environment and Infrastructure Solutions, Inc. for professional services for ten canal restoration projects to change the name to WSP USA Environment & Infrastructure, Incorporated; retroactive to September 22, 2022. 02/15/23: Approval to enter into a $677,537 Task Order No 1, to the contract with WSP USA Environment and Infrastructure Inc. (Wood) for professional services for ten canal restoration projects, to design,permit and procure nine canal restoration projects,funded by FDEP Stewardship Grant#LPA- 0428. 03/20/2024: Approval to enter into a no cost Task Order No. IA, to the contract with WSP USA Environment and Infrastructure, Incorporated (formerly Wood) for professional services for ten canal restoration projects, to substitute two canals for design,permitting, and assistance with procurement of a general contractor, funded by FDEP Stewardship Grant #LPA-0428 as amended by #LPA-0428, Amendment#1; retroactive to November 15, 2023. 01/15/2025: Approval to enter into a$0 Amendment No. 2 to the contract with WSP USA Environment and Infrastructure, Incorporated (formerly Wood) for professional services for ten canal restoration projects and for a name change to WSP USA, Incorporated; retroactive to January 1, 2025. ("CONSULTANT") executed on the 21" day of January, 2022, is entered into as follows: WITNESSETH: WHEREAS, the COUNTY and CONSULTANT desire to amend the Agreement in order to extend the period of performance. NOW, THEREFORE, in consideration of mutual promises, covenants and contracts stated herein, and for other good and valuable consideration, the sufficiency of which is hereby acknowledged, COUNTY and WSP USA, Incorporated agree as follows: 1. Subsection 3.1 of the Agreement is hereby deleted in its entirety, and the following language is substituted therefor: Except as noted below, this Agreement shall begin on the 21't day of January 2022 and will conclude on April 26, 2027. A task and deliverable schedule will be provided in each Task Order. 2. CONSULTANT agrees to be bound by all the terms and conditions of the Agreement. 3. This Amendment 3 is retroactive to January 21, 2026. 4. Both of the signatories to this Amendment have the full requisite authority to enter into this Amendment on behalf of their respective bodies. 5.
