AGENDA ITEM WORDING: Approval to accept proposal from Marsh USA and purchase
Pollution Liability Insurance at the cost not to exceed $90,000 for a 3-year policy and authorize the
Risk Manager to sign all necessary forms.
ITEM BACKGROUND: Pollution Liability Insurance will provide coverage to the County for
potential liability associated with an accidental discharge of pollutants from one of its fuel storage
tanks and the potential liability associated with a pollution incident at other scheduled County
locations.
The County's Pollution coverage expired May 1, 2026. The current policy was issued by Ironshore
Specialty Insurance Company with a 3-year term running from May 1, 2023, to May 1, 2026. The 3-
year premium was $80,773 ($26,924.33 annually). The policy has per incident limit of$5M and an
annual aggregate of$5M. A deductible of$50,000 applies to all losses. Marsh has proposed to renew
this coverage with a cost not to exceed$90,000 for a 3-year period of 5/l/2026-5/l/2029. Marsh
serves as the agent for this policy.
PREVIOUS RELEVANT BOCC ACTION: April 19, 2023, BOCC approved proposal of pollution
liability policy.
