HomeMy WebLinkAboutResolution 145-2025 RESOLUTION NO. 145- 2025 A RESOLUTION OF THE BOARD OF GOVERNORS OF FIRE AND AMBULANCE DISTRICT 1 OF MONROE COUNTY, FLORIDA, CONFIRMING AND RATIFYING THE BOARD OF COUNTY COMMISSIONERS' DESIGNATION OF THE COUNTY ADMINISTRATOR, OR HER DESIGNEE, AS THE PLAN ADMINISTRATOR OF THE "MONROE COUNTY, FLORIDA VOLUNTEER FIREFIGHTER AND EMERGENCY MEDICAL SERVICES LENGTH OF SERVICE AWARD PLAN" TO FULFILL THE DUTIES AS SET FORTH IN CHAPTER 11, "EMERGENCY MANAGEMENT AND EMERGENCY SERVICES," ARTICLE VI, "LENGTH OF SERVICE AWARD PLAN PROVIDING BENEFITS TO ELIGIBLE VOLUNTEER FIREFIGHTERS AND EMERGENCY MEDICAL SERVICES VOLUNTEERS;" PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the authority vested in the Board of Governors on behalf of the Fire and Ambulance District 1 of Monroe County, under the provisions of Section 22-129 and Section 11-25, Monroe County Code of Ordinances, the designation of the County Administrator, or her designee, as the Plan Administrator of the Length of Service Award Plan(LOSAP)is hereby confirmed and ratified; and WHEREAS, on June 9, 1999, the Board of County Commissioners adopted Ordinance No. 026-1999 thereby creating the LOSAP, and such law was codified within the Monroe County Code of Ordinances at Chapter 11, "Emergency Management and Emergency Services," Article VI, "Length of Service Award Plan Providing Benefits to Eligible Volunteer Firefighters and Emergency Medical Services Volunteers," specifically within Sections 11-221 through 11-229; and WHEREAS, throughout Article VI, "Length of Service Award Plan Providing Benefits to Eligible Volunteer Firefighters and Emergency Medical Services Volunteers," of the Monroe County Code, there are various powers and duties assigned to the Plan Administrator; and WHEREAS, Section 11-221, "Definitions," of the Monroe County Code, provides 1 that a "Plan administrator means the board or such other person or entity as shall be from time to time designated by the board to administer this plan," and `Board means the Monroe County Board of County Commissioners;" and WHEREAS, historical records indicate that the Fire and Ambulance District 1 of Monroe County and the Board of County Commissioners have jointly overseen the LOSAP, and it is appropriate for the Board of Governor's to ratify the Board of County Commissioners' designation of Plan Administrator at this time; and WHEREAS, consistent with said designation, the Board of Governor's confirms and ratifies the County Administrator, or her designee, as the LOSAP Plan Administrator vesting in her, or her designee, all powers and duties of the LOSAP Plan Administrator including, but not limited to those expressly set forth in Section 11-223, "Administration," of the Monroe County Code; and WHEREAS, to the extent that Fire and Ambulance District 1 funds are used in furtherance of the LOSAP, all signature authority to contract and/or engage professional services of consultants, attorneys, accountants, specialists, and other persons is vested in the Plan Administrator(i.e. County Administrator, or her designee), and hereby confirms that such purchasing authority for purposes of the dollar thresholds established by the Monroe County Purchasing Policy has previously been delegated pursuant to the Board of Governor's Resolution No. 494-2023, dated October 18, 2023; and WHEREAS, the Board of Governors finds and determines that confirming and ratifying the Board of County Commissioners' designation of the County Administrator, or her designee, as the LOSAP Plan Administrator is in the best interest of Fire and Ambulance District 1 of Monroe County, Florida. NOW THERFORE,BE IT RESOLVED BY THE BOARD OF GOVERNORS OF FIRE AND AMBULANCE DISTRICT 1 OF MONROE COUNTY, FLORIDA: Section 1: That the Board of Governors of Fire and Ambulance District 1 of Monroe County,Florida, hereby confirms and ratifies the designation of the County Administrator, or her designee, as the LOSAP Plan Administrator. 2 Section 2: That the Board of Governors of Fire and Ambulance District 1 of Monroe County, Florida, hereby authorizes, grants, and vests the County Administrator, or her designee, with powers to act on its behalf with regard to her, or her.designee's, role as the LOSAP Plan. Administrator. Section 3: That the Board of Governors of Fire and Ambulance District 1 of Monroe County, Florida, intends that such powers .and authority: confirmed, ratified, and granted hereunder will continue until expressly rescinded by resolution of the Board of Governors. Section 4: That if any clause,section,other part or application of this:resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,in part or in application, it shall not affect the validity of the remaining portion or applications of this resolution: Section 5: That this resolution shall be in full force and effect immediately upon its adoption.
