Colina AGENDA ITEM WORDING: Approval by the BOCC to reclassify an existing Certificate of Public Convenience and Necessity(COPCN) issued to the Key Largo Volunteer Ambulance Corps., to wit: COPCN#25-03, as null and void as of July 1, 2026. ITEM BACKGROUND: Monroe County was recently notified that Key Largo Volunteer Ambulance Corps. ("Key Largo Volunteer Ambulance") is currently working as a contractor under the valid ALS license (#ALS10111) issued to the independent special district known as the Key Largo Fire Rescue &Emergency Medical Services District (holding COPCN#26-04). It follows that the Florida Department of Health(DOH) lists the former ALS license (#ALS4402) that was held by Key Largo Volunteer Ambulance as null and void. Generally speaking, emergency medical services providers must be approved by the DOH (via a valid ALS/BLS license) or be exempt from such approval. Additionally,pursuant to Section 1 1-174, Monroe County Code, all COPCN holders must comply with certain local obligations and requirements. The relevant excerpts of Section 11-174, entitled"Rights and duties granted," of the Monroe County Code are follows: "(a) Class A and class B certificates granted by the board shall be valid for two calendar years and shall be personal to the applicant and not transferable. In the case of a corporation or business entity, a new certificate must be applied for if 25 percent of the outstanding share of the corporation or other incidents of ownership of the business association are transferred or undergo a change in ownership. (b) Class A certificates permit the certificate holder to provide basic life support and/or advanced life support services, whichever is applicable, within his assigned zone and interhospital transfers and/or intercounty transfers throughout the county, irrespective of zones,provided the service complies with all applicable laws, ordinances and rules and regulations. (d) Acceptance of a class A certificate by the applicant shall obligate the applicant to: (1)Provide continuous basic life support and/or advanced life support services, whichever are applicable, on a 24-hour, seven-day-week basis within his assigned zone; (2)Provide mutual assistance responses to adjoining zones, when requested to do so by the dispatch center for calls when the certificate holder for that zone is unable to respond or has vehicles insufficient in number to render the services needed; (3) Respond to all calls issued to it, unless all vehicles are in service on other ambulance business, incapacitated, or insufficient in number to render services needed; (4) Abide by all requirements of this article, and rules and regulations adopted by the board, and all state and local laws; (5)Provide access to the applicant's business for inspection by the administrator at reasonable times; (6) Keep posted at his place of business a copy of the fee schedule required by this article; (7)Notify the administrator of any changes in the fee schedule; (8)Notify the administrator at least 30 days prior to termination or reduction of any service." Consistent with Section 401.25, Fla. Stat., and the Monroe County Code, without approval by DOH, Key Largo Volunteer Ambulance cannot independently meet the obligations of the Class A COPCN holders. As such, MCFR respectfully requests that the BOCC reclassify the existing COPCN#25-03 as null and void, as of July 1, 2026. It appears that this is a natural step forward in the consolidation efforts of Key Largo Fire Rescue & Emergency Medical Services District, and there are no foreseeable operational gaps in service for that region. PREVIOUS RELEVANT BOCC ACTION: On 04/15/2026, BOCC approved issuance of a new COPCN to Key Largo Fire Rescue & Emergency Medical Services District(Item U10). On 03/25/2025, BOCC approved issuance of a renewal COPCN to Key Largo Volunteer Ambulance Corps. for the period commencing on 04/20/25 and expiring on 04/19/27 (Item Cl 5). INSURANCE REQUIRED: Yes.
