ITEM BACKGROUND: The Winston Waterways Road Elevation Resiliency and Adaptation Project is being designed. It was determined that to construct the stormwater management system to comply with state permitting requirements, easements will be needed from specific parcel owners for the purpose of installing stormwater drainage inlets on the parcel adjacent to the right of way. Easement documents and letters have been sent out to 26 property owners, and a virtual public meeting was conducted on April 21, 2026 to address questions from property owners. The undeveloped parcel adjacent to Cardinal Lane with ID No. 00546390-000000 is owned by the State of Florida. The process to obtain an easement for this parcel involves applying to the State and submitting, among other items, a resolution from the Board of County Commissioners requesting the easement. PREVIOUS RELEVANT BOCC ACTION: The Board of County Commissioners approved an engineering design contract with HDR Engineering, Inc. For the Winston Waterways Road Elevation project at the October 2024 BOCC meeting. WHEREAS, Monroe County has undertaken the engineering design and permitting of the Winston Waterways Road Elevation Resiliency and Adaptation Project to address the impacts of climate change on roads in the Winston Waterways Community in Key Largo, including Cardinal Lane; and WHEREAS, in order to construct the project, the County will require private property easements from certain property owners adjacent to roads that are narrower than 50 ft. wide, including Cardinal Lane; and WHEREAS, the project will benefit property owners by reducing the impacts of climate change on roadway flooding, which will maintain access to their properties and is in the public interest; and WHEREAS, the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida owns an undeveloped parcel of land adjacent to Cardinal Lane with Parcel ID No. 00546390-000000 upon which a 5 ft. X 10 ft. easement is needed to install a stormwater drainage inlet that will be part of the project. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Monroe County, Florida, that: 1. Monroe County requests that the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida grant Monroe County a 5 ft. wide by 10 ft. wide easement on Parcel 00546390-000000, more fully described in Attachment A, for the purpose of installing a stormwater drainage inlet that will be part of the stormwater management system for the Winston Waterways Road Elevation Resiliency and Adaptation Project.
