AGENDA ITEM WORDING: Approval of a resolution requesting that the Board of Trustees of the
Internal Improvement Fund of the State of Florida(BOT_TIIF) grant the County a permanent 5 ft. x
10 ft. easement on an undeveloped parcel of land with Parcel ID No. 00546390-000000, adjacent to
Cardinal Lane in the Winston Waterways Community for the purposes of installing a stormwater
drainage inlet on the parcel as part of the Winston Waterways Road Elevation Resiliency and
Adaptation Project.
ITEM BACKGROUND: The Winston Waterways Road Elevation Resiliency and Adaptation Project
is being designed. It was determined that to construct the stormwater management system to comply
with state permitting requirements, easements will be needed from specific parcel owners for the
purpose of installing stormwater drainage inlets on the parcel adjacent to the right of way. Easement
documents and letters have been sent out to 26 property owners, and a virtual public meeting was
conducted on April 21, 2026 to address questions from property owners.
The undeveloped parcel adjacent to Cardinal Lane with ID No. 00546390-000000 is owned by the
State of Florida. The process to obtain an easement for this parcel involves applying to the State and
submitting, among other items, a resolution from the Board of County Commissioners requesting the
easement.
PREVIOUS RELEVANT BOCC ACTION: The Board of County Commissioners approved an
engineering design contract with HDR Engineering, Inc. For the Winston Waterways Road Elevation
project at the October 2024 BOCC meeting.

COMMISSIONERS OF MONROE COUNTY,
FLORIDA, REQUESTING AN EASEMENT
FROM THE BOARD OF TRUSTEES OF THE
INTERNAL IMPROVEMENT TRUST FUND OF
THE STATE OF FLORIDA ON LOT 2 BLOCK 2,
AMENDED PLAT OF WINSTON WATERWAYS
PLAT BOOK 4 PAGE 144 HAVING PARCEL
IDENTIFICATION NUMBER 00546390-000000,
FOR THE PURPOSE OF CONSTRUCTING THE
WINSTON WATERWAYS ROAD ELEVATION
RESILIENCY AND ADAPTATION PROJECT IN
KEY LARGO.
WHEREAS, Monroe County has undertaken the engineering design and
permitting of the Winston Waterways Road Elevation Resiliency and Adaptation Project
to address the impacts of climate change on roads in the Winston Waterways Community
in Key Largo, including Cardinal Lane; and
WHEREAS, in order to construct the project, the County will require private
property easements from certain property owners adjacent to roads that are narrower than
50 ft. wide, including Cardinal Lane; and
WHEREAS, the project will benefit property owners by reducing the impacts of
climate change on roadway flooding, which will maintain access to their properties and is
in the public interest; and
WHEREAS, the Board of Trustees of the Internal Improvement Trust Fund of
the State of Florida owns an undeveloped parcel of land adjacent to Cardinal Lane with
Parcel ID No. 00546390-000000 upon which a 5 ft. X 10 ft. easement is needed to install
a stormwater drainage inlet that will be part of the project.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Monroe County, Florida, that:
1. Monroe County requests that the Board of Trustees of the Internal
Improvement Trust Fund of the State of Florida grant Monroe County a 5 ft.
wide by 10 ft. wide easement on Parcel 00546390-000000, more fully
described in Attachment A, for the purpose of installing a stormwater drainage
inlet that will be part of the stormwater management system for the Winston
Waterways Road Elevation Resiliency and Adaptation Project.

PERMANENT ACCESS EASEMENT
I/We, Board of Trustees of The Internal Improvement Trust Fund of the State of Florida, as sole owner(s),
whose address is 3900 Commonwealth Blvd., Mail Station 108, Tallahassee, FL 32399, hereafter
"Grantor", in consideration of the mutual covenant, promises and terms and conditions set forth herein,
together with good and valuable consideration,the adequacy and receipt of which are hereby acknowledged
do hereby voluntarily, grant, create, convey and release to Monroe County, a political subdivision of the
State of Florida, whose address is 1100 Simonton Street Key West, FL 33040, hereafter "Grantee", an
appurtenant permanent non-exclusive access easement over, on, under, upon and across the Property (as
hereinafter defined) owned by me/us in Monroe County, Florida, for the specific and limited purposes
described as follows:
A permanent easement for surface and sub-surface construction installation of a 5-foot
by 10-foot easement: As described in Exhibit A attached.
This easement is granted for the purpose of locating, establishing, constructing and maintaining a drainage
structure over, on, under and across the Property and includes the right of entry upon, inspection,passage
over, excavation, placement of excavated earth, placement of fill, as may be necessary or useful for the
construction and maintenance of drainage improvements and appurtenances.
This Easement shall remain against the Property in perpetuity and shall be automatically assigned by any
deed or other conveyance conveying a portion of the Property relating to this Easement, even though
conveyance makes no reference to this Easement as such. Grantor shall include any and all heirs,
successors or assigns of the Grantor, and all subsequent owners of the Property. The term Grantee shall
include any successor or assignee of Grantee. This Easement may only be amended by written agreement
between the parties hereto or their heirs,assigns,or successors-in-interest,which shall be filed in the public
records in Monroe County,FL.
