AGENDA ITEM WORDING: Approval of a Resolution rescinding Resolution No. 281-2025 and
removing the property known as the Ruth Ivins Center located at 3333 Overseas Highway, Marathon,
Florida 33050, from surplus property designation.
ITEM BACKGROUND:
Monroe County owns a building located at 3333 Overseas Highway, Marathon, Florida 33050,
commonly referred to as the Ruth Ivins Center. The State of Florida Department of Health has been a
tenant of this building since approximately 1995.
On August 20, 2025, the BOCC adopted Resolution 281-2025 declaring the Ruth Ivins Center as
surplus and approving the sale of the property.
Since that date, County staff determined that the property remains appropriate for use. On April 15,
2026, the Board approved a five-year lease on the property with the Department of Health.
Additionally, County staff determined the site may be appropriate for use by additional tenants, such
as Constitutional offices.
PREVIOUS RELEVANT BOCC ACTION:
August 20, 2025: BOCC declared the property as surplus and authorized the sale of the property.
April 15, 2026: BOCC approved a 5-year lease of the Ruth Ivins Center to the Florida Department of
Health.

A RESOLUTION of THE BOARD of COUNTY
COMMISSIONERS of MONROE COUNTY, FLORIDA,
DECLARING of PROPERTY KNOWN AS THE RUTH
IVINS CENTER LOCATED AT 3333 OVERSEAS HWY.,
MARATHON, FLORIDA 33050 AS SURPLUS PROPERTY
AND THE APPROVAL To ADVERTISE THE RUTH IVINS
CENTER FOR SALE; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Florida Statute 125.35(1)(c) does not allow for the sale of any real property
unless notice is published once a week for at least two weeks in some newspaper of general
circulation published within the county, calling for bids for purchase of the real estate so advertised
to be sold. In the case of a sale, the bid of the highest bidder complying with the terms and
conditions set forth in such notice shall be accepted, unless the board of county commissioners
rejects all bids because they are too low. The board of county commissioners may require a deposit
to be made or a surety bond to be given, in such form or in such amount as the board determines,
with each bid submitted; and
WHEREAS, the COUNTY owns an office building known as the Ruth Ivins Center
located at 3333 overseas Highway Marathon, Florida 33050; and
WHEREAS, the COUNTY developed and leased the Ruth Ivins Center to the Monroe
County Health Department, which is now relocating into another county owned space leaving the
Ruth Ivins Center vacated; and
WHEREAS, it is in the COUNTY's best interest to declare the property known as the
Ruth Ivins Center as surplus property and advertise the property for sale.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD of COUNTY
COMMISSIONERS of MONROE COUNTY, FLORIDA:
Section 1: That the foregoing"WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this resolution.
Section 2 That the County Commission has approved the resolution to declare the ;

21 WHEREAS, the Board of County Commissioners ("Monroe County", the "County",
22 "BOCC", or the "Board") owns real property with improvements located at 3333 Overseas
23 Highway, Marathon, Florida 33050, referred to as the Ruth Ivins Center ("the property" or"Ruth
24 Ivins Center"); and
25
26 WHEREAS, the BOCC, on August 20, 2025, adopted Resolution 281-2025, deeming the
27 Ruth Ivins Center as surplus property and authorizing sale of the property; and
28
29 WHEREAS, County staff, upon further review, determined the property remains suitable
30 for County use; and

32 WHEREAS, on April 15, 2026, the BOCC granted a five-year lease to the Florida
33 Department of Health at the Ruth Ivins Center and County staff believes the site has the
34 possibility to house additional tenants (such as Constitutional offices); and
35
36 WHEREAS, it is in the best interest of the County to rescind the prior resolution that
37 designated the property as surplus and to retain the property for ongoing county operations;

39 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
40 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

42 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true
43 and correct and are hereby made a specific part of this resolution.

45 2. The Monroe County BOCC hereby finds that the above-referenced real property and
46 improvements remain useful for County business and hereby rescinds Resolution No.
47 281-2025.

49 3. That all resolutions or parts of resolutions in conflict with this resolution are hereby
50 rescinded to the extent of such conflict.

52 4. That if any clause, section, other part or application of this resolution is held by any
53 court of competent jurisdiction to be unconstitutional or invalid, in part or in

55 this resolution.
