ITEM BACKGROUND: At the February 15, 2012, meeting of the Monroe County Board of County
Commissioners' (`BOCC", "Board", "Monroe County", or the "County"), the BOCC approved
Resolution No. 080-2012 (attached) establishing policies and procedures for the award of Boating
Improvement(`BIF")reimbursement funding to the municipalities situated within Monroe County.
The procedures provide for submittal of annual funding requests, a project scoring and selection
process, and award of funding through Interlocal Agreements ("ILAs")based upon funding
availability.
The professional staff of the Monroe County Planning and Environmental Resources Department's
Marine Resources Office has received two (2) funding request applications (attached) for FY 2027,
including: The Village of Islamorada in the amount of$30,000.00 for regulatory buoy maintenance
(120 buoys) and the City of Key Colony Beach in the amount of$9,165.55 for regulatory buoy
replacement(10 buoys). The professional staff of the Marine Resources Office has scored the funding
requests, shown below. A detailed score sheet is also attached for reference.

The total funding request for FY 2027 is $39,165.55. Typically, a $40,000 annual budget threshold is
set for this grant program. However, a$20,000.00 budget for FY 2027 has been established. A
detailed sheet showing previous funding to all municipalities is attached. The professional staff of the
Marine Resources Office recommends funding the requests as follows:
Village of Islamorada: $14,000.00
City of Marathon: $6,000.00
Total Recommended Funding: $20,000.00
Upon BOCC approval, the professional staff will prepare an ILA with each of the above-referenced
municipalities for the work to be performed in FY 2027, and anticipates bringing said ILAs back to
the Board for BOCC approval at the Board's July 2026 public meeting.

(October 1, 2026 — September 30, 2027). The request is to help fund the program providing
the system of 120 "No Wake Zone" buoys. In 2024, the contractors estimate for program costs
doubled, and the Village's expenditures have been steadily increased over the last few years.
The assistance through the Boating Improvement Funds would cover just over 50% of
program costs with a similar cost share from the Village.

II- PROJECT SUMMARY
Project Title: FY2026 COUNTY BOATING IMPROVEMENT FUND (BIF) GRANT PROGRAM
Project description and purpose (explain the community need and project merit):
Village boundaries extend from mile marker 90.9 to mile marker 72.6 and include Plantation Key, Windley
Key, Upper Matecumbe Key and Lower Matecumbe Key. Known as the "Sportfishing Capital of the World,"
the waters off Islamorada are heavily traveled by boaters, personal watercraft, kayakers and paddle boarders.
In 2003, the Village Near Shore Water Regulation Citizens'Advisory Committee and the Monroe County
Department of Marine Resources partnered to protect residents, visitors and natural resources by instituting
300 foot no wake zones along the shoreline within the Village's offshore jurisdiction in the Atlantic Ocean and
the Gulf of Mexico. After much effort, assistance from the National Marine Sanctuary, and a lengthy permitting
process, the Florida Uniform Waterway Marker compliant system of 120 "No Wake Zone" buoys and a series
of fixed informational markers were installed in 2004 to mark the areas of shoreline where the idle speed
zones are in effect. The buoys aid in boater safety and facilitate preservation of the shoreline, nearshore
waters, flats and reefs.
In accordance with Florida law, the Village established a Buoy Maintenance Program (the "Program")to
maintain the system of buoys. Due to heavy boat traffic, environmental wear and tear, and occasional theft,
the Village experiences losses and damages to its buoy system. The Village contracts marine professionals to
regularly inspect and maintain the buoys.
The Village requests assistance funding the Program from the Monroe County Boating Improvement Funds
Grant Program for FY 26-27 in the amount of$30,000.00 (approximately 54% of the estimated Program
costs). The projected total Buoy Maintenance Program costs for FY 26-27 are estimated at$55,292.50. If
awarded, the Village's contribution is projected to be$25,292.50 (approximately 46%)of the Program costs to
be paid from its Marina Enterprise Fund. Program work includes 1) labor of certified divers to inspect buoys
and anchors, assembly and installation of new buoys and anchoring materials; 2) replacement buoys, anchor
assembly lines, property identification and numbering decals; and 3) printing educational materials.
This project remains both valuable and necessary. The buoy system continues to benefit residents, visitors,
and the coastal and marine environment. Without the properly maintained buoy system, boating on the waters
off the Village would be more dangerous and create conditions harmful to boaters, swimmers, the shoreline,
the coral reef and wildlife.

Description of how project may promote public water access:
The Buoy Maintenance Program promotes public water access by providing 120 highly visible buoys marked
with GPS identifiers that may assist boaters to determine their position, warn of dangers and obstruction in
navigation and alert boaters and operators of the Federal, State and Local Regulations. Buoys are safer than
fixed signs, reduce the severity of boater/sign collisions, and are less expensive to erect and maintain. The
buoy system may especially promote public water access for boaters planning to snorkel from their vessels as
well as kayakers, canoers, paddle boarders and open-water swimmers by improving the safety in the 300-foot
from shoreline area.
The project also promotes safe boating practices and protection of Islamorada's fragile sea life by exhibiting
on every buoy: "IDLE SPEED NO WAKE 300' FROM SHORE".

The applicant will provide any pertinent documentation to assist with the review and evaluation of the funding request
such as site plans (verifying property ownership), design plans, permits, etc.
In 2008, pursuant to the Florida Administrative Code and Islamorada's Ordinance 03-10, the Village's
waterway marker plan was approved by the Florida Fish &Wildlife Conservation Commission's Office of
Boating Safety&Waterway Management. FWC Permit No. 04-018 (attached). The permit lists the marker
identification numbers, latitude/longitude and sign text for each of the 120 approved buoys in the system.
In February 2026, the Tri-Annual Inspection was completed. The Village continues to distribute educational
brochures and rack cards to increase public safety awareness of local boating issues and regulations.

The funding request is for Fiscal Year 2026-2027 for project costs incurred and paid from October 1, 2026
through September 30, 2027. This is an ongoing, multi-year project that has continued without interruption
since its creation in 2003 through a partnership with the Monroe County and with the assistance of the
National Marine Sanctuary.

Weather is always a factor on work performed and the timeliness of completion. Sunny days and
clear water make it easier to work and find anchors. We consider weather conditions when
heading out to work on buoys.

Waterway Management Unit
PERMIT CONDITIONS AND PROVISIONS:
1 Permit is approved contingent upon the consent of and, if necessary, the issuance of appropriate permits by the
United States Army Corps of Engineers and the United States Coast Guard.
2 It is unlawful to place markers on private submerged lands or other property or structure not owned by the
person or governmental entity placing them without first receiving the written consent of the owner of the
submerged lands, other property, or structure as to the placement of the markers. A copy of such written

consent, if required, must be provided to the FWC's Boating and Waterways Section. (Pursuant to Section
327.40, F.S., the placement of any uniform waterway marker on state-owned submerged lands does not subject
such lands to the lease requirements of Chapter 253, F.S.)
3 Permit provides for the placement of one-hundred and twenty-two (122) uniform waterway regulatory markers at
the coordinate positions identified on both the map and in the application.
4 Permit authorizes the placement of markers and does not authorize any invasion of private rights, grant any
exclusive privileges, or obviate the necessity of complying with any other federal, state or local laws or
regulations.
5 All markers associated with this permit must be installed within a reasonable period of time. Upon completion of
the installation of markers, the Permittee will notify the FWC's Boating and Waterways Section in writing within 30
days. If the latitude and longitude of any marker installed is different from that listed in the application, a
request for a permit amendment must be submitted. Such a request must include the final "as-built" latitude and
longitude in degrees and decimal minutes (referenced to the WGS-84 datum) for the markers installed.

Permittee must comply with the marker specifications and placement requirements detailed in Rules 68D-23.106,
68D-23.108 and 68D-23.109, F.A.C. The permit number 04-018 and reference to the regulatory instrument
(Ordinance # 03-10) creating the restricted area must be displayed on each marker. These numbers and/or
letters must be displayed in black block characters measuring at least one inch in height. Retroreflective
materials must be used for all white background and international orange displays on markers.
7 Permittee must immediately report discrepancies of markers covered by this permit and make corrections to
discrepancies within 30 days. Reports of discrepant markers and/or notice of corrective action completed will be
made by calling FWC's Boating and Waterways Section at (850) 488-5600.
8 Permittee must comply with Rule 68D-23.110, F.A.C., which requires permit holders to properly maintain the
markers and to conduct periodic inspections to determine their condition. An inspection of the markers is
required every three (3) years from the date of permit issuance. Within five (5) business days following the
completion of the inspection, notify the FWC's Boating and Waterways Section at
Waterway.Management@MyFWC.com that the inspection has been performed and whether or not any markers
were determined to be discrepant. All discrepancies documented during an inspection must be reported to the
FWC's Boating and Waterways Section and corrected within 30 days. Please be advised that FWC may request a
copy of the inspection documentation at any time.
9 The permittee, by accepting this permit and placement of the uniform waterway markers, does hereby, to the
extent authorized by law, agree and promise to hold harmless the State of Florida, its employees, agents or
successors, from fault with respect to any claim or claims arising from alleged negligence in the placement,
maintenance, operation and removal of any and all marker(s) placed pursuant to the permit. The permittee
further agrees to indemnify the State of Florida for any and all legal fees and costs incurred in defense of any suit
brought against the state as a result of alleged negligence by the Permittee in the placement, maintenance,
operation, or removal of the uniform waterway marker(s).
10 In the event the regulatory instrument (Ordinance 03-10 as adopted on June 12, 2003 which imposes the
requirement or boating restriction) covered by this permit is amended, repealed, rescinded, revoked, or
otherwise becomes a nullity, the permittee must, within 30 days, notify the FWC's Boating and Waterways Section
of the change. The permittee must in the case of an amendment to the instrument, file an amended permit
application showing the markers to be removed, replaced, modified, or added in order to implement the
amendment to the instrument, or in the case of the repeal, rescission, revocation, or other nullification of the
instrument, remove from the waters of this state and the shores thereof all markers implementing that
instrument.
11 Permittee shall comply with Rule 68D-23.106(4), F.A.C., in the event of discontinuance or removal of any marker
covered by this permit.
12 Failure to comply with the requirements or conditions of this permit shall be cause for immediate revocation of
the permit.
13 The issuance of the permit authorizing the placement of markers does not obligate the FWC or its officers to
enforce the regulations or operating restrictions noticed by the markers.
14 The FWC retains the right to modify or rescind this permit should information become available indicating the
permitted activity is likely to create a serious threat to public safety or that the recipient does not need the permit
(in its current form). If you have any questions regarding this permit or its applicability, please contact FWC's

A person whose substantial interests are affected by FWC's action may petition for an administrative
proceeding (hearing) under sections 120.569 and 120.57 of the Florida Statutes. A person seeking a
hearing on FWC's action shall file a petition for hearing with the agency within 21 days of receipt of
written notice of the decision. The petition must contain the information and otherwise comply with
section 120.569, Florida Statutes, and the uniform rules of the Florida Division of Administration, chapter
28-106, Florida Administrative Code. If the FWC receives a petition, FWC will notify the Permittee. Upon
such notification, the Permittee shall cease all work authorized by this permit until the petition is
resolved. The enclosed Explanation of Rights statement provides additional information as to the rights of
parties whose substantial interests are or may be affected by this action.

Project Title: Key Colony Beach Aids to Navigation
Project description and purpose (explain the community need and project merit):
To purchase 4 "idle speed no wake" cans buoys, 6 "idle speed no wake" pencil buoys and 6 "idle speed no
wake"wraps to repair faded buoys. This project includes the installation of 6 of buoys that are missing and
swapping out 4 buoys that need replacement/repair.
The City of Key Colony Beach maintains a "no wake idle speed" perimeter which protects turtle nesting
beaches from erosion and provides a safe haven for paddle sports along a very busy channel. The buoys
protect both private and city park property.

This project promotes public water access by providing ease of navigation while protecting resources that are
enjoyed by the boating public. A no wake, idle speed zone provides a safe use area for paddleboards and
kayaks along a very busy channel while protecting the shoreline from erosion.

GENERAL TERMS AND CONDITIONS
These GENERAL TERMS AND CONDITIONS by and between Performance Health Supply,LLC d/b/a ROLYANO BUOYS("Seller")and the party identified on such quote("Buyer")shall apply to the
purchase of Products(as defined below).The terms and conditions contained herein shall supersede any conflicting terms contained in any purchase order,invoice or other documentation used or
submitted by either party in connection with the purchase of Products covered by this quote,except as expressly agreed to in writing signed by both par-ties.
Buyer desires to purchase a product to be produced by Seller at any location where the company does business and operates and Seller desires to sell and supply such goods to Buyer on the terms
and conditions set forth herein.Capitalized terms have the definitions set forth herein.
1.PRODUCT:A buoy,and corresponding accessories,manufactured as ROLYANO BUOYS("Product").
2.QUALITY:The Product shall meet the quality specifications set forth by ROLYANO BUOYS on its website located at vvvvw Rollyard Ww,mxoiryi.
3.QUANTITY:Seller shall supply and sell,and Buyer shall take or pay for no less than the quantity identified in the quote of Product pursuant to the terms herein.
4.PRICE:The price per Product delivered from Seller to Buyer shall be as identified in the quote.All payments shall be in United States Dollars("Price")is exclusive of any applicable excise duty,tariffs
taxes and/or VAT at the prevalent rates.
5-PAYMENT:Payment terms are subject to the approval of Seller and shall be as identified in the Seller quote.The Buyer shall pay the Seller's Invoice on presentation net thirty(30)days.
6-TERMS OF DELIVERY:All product orders will be delivered FOB Seller's facility,with Buyer assuming the cost and risk of transportation.Shipment must be inspected upon arrival.Buyer shall take
immediate action on damaged freight by either:(1)noting it on the freight bill or(2)refusing the shipment.Seller is not responsible for damage incurred during shipping.

7.RISK&TITLE:Except In the case of a manufacturer defect,bath title and risk of loss to Product shall pass from Seller to Buyer upon loading into the Buyer's,or its designee's transportation vehicle.
S.CAN POLICY:All sales shall be final.Once an order is submitted by the Buyer,the order cannot be cancelled.Except as expressly provided in Section 9 below,in no event shall
Seller accept returned Products from Buyer.
9.WARRANTY:Seller warrants that all goods shall be free from manufacturing defects for a period of one year from the date of shipment.OTHER THAN THE FOREGOING WARRANTY,SELLER
MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND,EXPRESS OR IMPLIED,AS TO MERCHANTABILITY,FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER MATTER RELATING TO THE
PRODUCTS.Upon a determination by Seller that a product is defective,Seller sole and exclusive obligation shall be to provide Buyer with a replacement product or a full refund of the purchase price,
at the sole discretion of Seller,and to reimburse Buyer for any return freight costs.In no event shall Seller be liable for any other costs or expenses including but not limited to lost profits or direct,
indirect,consequential,incidental or punitive damages.
10.TERMINATION:Either party may terminate this Agreement based upon a material breach of the other's obligations under the terms of this Agreement.The terminating party shall so notify the
other party,and termination shall become effective sixty(60)calendar days after receipt of such written notice unless the breaching party has within such time cured the breach or,for matters that
cannot be fully cured within such time,commenced,and continued to diligently pursue appropriate corrective action.
11.INSURANCE:Seller will maintain the required site Insurance consistent with its operating requirements.
12.ASSIGNMENT:Neither party may assign this quote without the prior written consent of the other party,provided,however,that either party may,without being released from its obligations
hereunder,(i)assign this quote to any of its Affiliates,provided such Affiliate assumes in writing,all of the assignor's obligations hereof,and(ii)assign this quote in connection with a merger,
consolidation,or other business combination,or in connection with the disposition of all,or substantially all of the assets of a party,or the disposition of the relevant portion of a party's business and
assets to which this Agreement relates."Affiliate"means an entity controlling a party,controlled by a party,or under common control with a party.
13.FORCE MAJEURE:Neither party shall be held liable for any delay or failure in performance of any part of this quote,to include but not be limited to purchase commitments,from any cause beyond
its control or without its fault or negligence,such as acts of Gad,acts of civil or military authority,government regulations,embargoes,pandemics/epidemics,war,terrorist acts,riots,insurrections,
fires,explosions,earthquakes,nuclear accident,floods,power blackouts,volcanic action,and major environmental disturbances.
14.CONFIDENTIALITY:Each party understands the importance of maintaining the other party's confidential information and agrees never to use or disclose such information except as necessary to
carry out the other party's obligations under this quote/order.The provisions of this section shall survive the termination of this quote/order.
15.APPLICABLE LAW:This quote/order shall be governed and construed in accordance with the laws of the state of Illinois,without regard to the choice of law principles thereof.

WHEREAS, moneys from vessel registration fees designated for the use of the
counties is distributed by the tax collector to the Board of County Commissioners,
pursuant to F.S. 328.72, hereafter referred to as State Boating Improvement Funds; and
WHEREAS, State Boating Improvement Funds are for the sole purposes of
providing recreational channel marking and other uniform waterway markers, public boat
ramps, lifts, and hoists, marine railways, and other public launching facilities, derelict
vessel removal, and removal of vessels and floating structures deemed a hazard to public
safety and health for failure to comply with F.S.327.53; and
WHEREAS, State Boating Improvement Fund revenues provide approximately
$250,000 annually; and
WHEREAS, the County approved Ordinance No.034-2002 to impose an annual
registration fee on vessels registered, operated, or stored in the water within its
jurisdiction pursuant to F.S.328.66, hereafter referred to as County Boating Improvement
Funds; and
WHEREAS, County Boating Improvement Funds shall be expended for the
patrol, regulation, and maintenance of the lakes, rivers, and waters and for other boating-
related activities of municipalities or counties; and
WHEREAS, County Boating Improvement Fund revenues provide
approximately $400,000 annually; and
WHEREAS, State and County Boating Improvement Funds are utilized by the
County for County channel marker and boat ramp maintenance, derelict vessel removals,
pumpout program costs, and other boating and waterway related projects Keys-wide; and
WHEREAS, the County may provide Boating Improvement Fund dollars to the
various municipalities for boating and waterway projects in accordance with the allowed
uses described in F.S.327.53 and F.S.328.66; and
WHEREAS, the County approved Resolution No.371-2011 which established
criteria for the general use of Boating Improvement Funds and procedures for the
reimbursement of Boating Improvement Funds to the municipalities; and
WHEREAS, the County desires to revise the policy established by Resolution
No.371-2011, refining the purpose of reimbursement funding to the municipalities from
Boating Improvement Funds, establishing funding request submission procedures, and
providing for a selection process for the award of reimbursement funding;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT:
Section 1. Resolution No.371-2011 is hereby rescinded.
Section 2. The Monroe County Board of County Commissioners shall expend
State and County Boating Improvement Funds only for County boating and waterway
related projects, and municipal boating and waterway related projects in the form of
reimbursement funding, in accordance with the allowed uses of Boating Improvement
Funds as described in F.S. 328.72 and F.S. 328.66.
Section 3. The Monroe County Board of County Commissioners and
municipalities within Monroe County shall only perform boating and waterway related
projects that serve the general boating public.
Section 4. The Monroe County Board of County Commissioners may provide
reimbursement funding from Boating Improvement Funds to the various municipalities
for the purpose of providing for repair and maintenance of existing infrastructure, as well
as for capital improvement projects. The following procedures are established:
Funding Requests. Reimbursement funding requests shall be received by the
County no later than April 1 of the fiscal year for funding from the upcoming
fiscal year. Funding request forms will be available accompanied by
guidelines including the following criteria:
1- Projects for consideration must occur over public upland or public bay
bottom.
2- Funding shall not be provided for projects previously completed.
3- Requests for repair and maintenance funding for projects involving
revenue producing infrastructure (such as, but not limited to, mooring
fields or marinas or fee generating boat ramps) which should be
completely self-funding are discouraged. Requests for project funding for
revenue producing infrastructure shall include evidence and written
analysis by the applicant of unmet costs, such as a current annual financial
report, indicating total revenue, total expenses, and unmet availability of
funds for repairs and maintenance. Boater Improvement Funds should not
be used to simply supplant repair and maintenance funding.
4- Requests for new improvement funding for projects that may involve
future revenue producing infrastructure should include a fiscal analysis
and assurance from the municipality that the improvement will be self-
supportive and include operating and maintenance funding for future
needs.

5- Project Selection. Municipality funding request forms received shall be
reviewed by County Growth Management staff(Staff) after April 1 of the
fiscal year. Staff shall score each funding request and make selection
recommendations based on community need, project merit, and funding
availability. Staff recommendations may include awarding all of, or a
portion of the amount requested. Staff shall provide funding requests and
selection recommendations to the BOCC by June of each fiscal year. The
BOCC shall evaluate the staff s recommendations and provide Board
approval in ranking order, based on funding availability.
6- Funding Awards. After the Board approved projects are known, each
applicant shall enter into an Inter-local Agreement (ILA) with the County
indicating the municipality shall expend the funds and show evidence of
expenditures, prior to reimbursement.
