The County and Company hereby enter into this Addendum to Quote #4 0 8 7 8 of Company and agree to the following: The County and Company hereby enter into this Addendum to modify any Agreement,Proposaldtuotc or Estimate offered by the Contractor for the goods or services to be provided(hereinafter referred to as" Agreement")and agrees to the following; Proposal in the Amount of$96 .00 to provide materials and labor to furnish and replace the continuous hinge and sweep neoprene for the door at the Monroe County Tax Office in Key Largo,Florida. The County shall have the right to unilaterally cancel this contract upon violation of this provision by Company.Failure of the Company to abide by the terms of this provision shall be deemed a material breach of this contract and the County may 2 enforce the terms of this provision in the form of a court proceeding and shall, as a prevailing party,be entitled to reimbursement of all attorney's fees and costs associated with,that proceeding.This provision shall survive any termination or expiration ofthe contract.The Company is encouraged to consult with its advisors about Florida Public Records Law in order to comply with this provision. n- aiver ot Ilamyni . Notwithstanding the provisions of Section 768.28, Florida Statutes, the participation of the County and Company in this Agreement and the acquisition of any commercial liability insurance coverage, self-insurance coverage, or local government liability insurance pool coverage shall not be deemed a waiver,of immunity to the extent of liability coverage, nor shall any contract entered into by the County be required to contain any provision for waiver. liarnge . Delays in the completion of work resulting from the failure of the Contractor to maintain the required insurance shall not extend any deadlines specified in this Agreement and any penalties and failure to perform assessments shall be imposed as if the work had not been suspended, except for Company's failure to maintain the required insurance. Commercial General Liability Insurance with minimum limits of$500,000 Combined Single Limit(CSL) If split limits are provided,the minimum limits acceptable shall be $250,000 per Person, $500,000 per occurrence and$50,000 property damage.
