Scholl,District 3 - Holly Merrill Raschein,District 5 Regular Meeting June 10, 2026 Agenda Item Number: Q2 26-32185 BULK ITEM: Yes DEPARTMENT: Community Services TIME APPROXIMATE: N/A STAFF CONTACT: Cathy Crane AGENDA ITEM WORDING: Approval of a Resolution amending Resolution No. 96-2026 to revise the previously approved donation of four(4) Monroe County Community Services Department vehicles to the Monroe Association for Retarded Citizens, Inc. d/b/a MARC House ("MARC House") to the donation of only one (1) vehicle, and to expressly find that such donation is in the best interest of Monroe County pursuant to Sections 125.38 and 274.05, Florida Statutes; further authorizing the Mayor, County Administrator, or Director of Community Services to execute any necessary documents. The vehicles no longer proposed for donation are currently excluded from Monroe County Community Services inventory and shall be restored to inventory by the Monroe County Clerk of Court and Comptroller. ITEM BACKGROUND: On April 15, 2026, the Board of County Commissioners (BOCC) approved Agenda Item Q4 and adopted Resolution No. 96-2026 authorizing the donation of four(4) Monroe County Community Services Department vehicles to the Monroe Association for Retarded Citizens, Inc., d/b/a MARC House ("MARC House"), with a cumulative Monroe County Fleet Management Department Reasonable Market Approximation of$99,500. After subsequent operational review, MARC House determined that three (3) of the vehicles identified in Resolution No. 96-2026 were not required by them, and MARC House has declined acceptance of said vehicles. Accordingly, Monroe County desires to amend Resolution No. 96-2026 to authorize donation only of the following vehicle to MARC House: 2016 MAN MV-1/VIN# - 57WMD2C68GM100492 /MC Fleet: Reasonable Market Approximation: $24,500. The remaining vehicles previously identified in Resolution No. 96-2026 shall remain under County ownership pending identification and approval of an eligible adopting agency by the Florida Department of Transportation ("FDOT") or other lawful disposition method. As a result of the prior BOCC action, the vehicles no longer proposed for donation are currently excluded from Monroe County Community Services inventory and must be restored to inventory by the Monroe County Clerk of Court and Comptroller. 2019 FORD E450/VIN:I FDFE4FS9KDC03214/Monroe County Fleet Management Department Reasonable Market Approximation: $45,000 2013 FORD E350/VIN:IFDEE3FS4DDB27376/Monroe County Fleet Management Department Reasonable Market Approximation: $14,000 2016 FORD E350 /VIN:IFDEE3FS2GDC46340 /Monroe County Fleet Management Department Reasonable Market Approximation: $16,000 FDOT has approved transfer of the above-referenced vehicle to MARC House consistent with applicable Section 5310 program requirements. MARC House is a Florida registered nonprofit organization that meets the definition of a"private nonprofit agency"pursuant to Section 273.01(3), Florida Statutes, in that it is tax-exempt under Section 501(c)(3) of the Internal Revenue Code. MARC House's mission includes providing services to individuals with developmental and intellectual disabilities, consistent with public health and welfare and the relief of human suffering within Monroe County. The vehicle is maintained in operational condition and is suitable for continued use. Monroe County's Fleet Management Department has determined the reasonable market approximation for the vehicle proposed for donation as approximately $24,500. Accordingly, the proposed donation serves a valid public purpose and supports the Board's determination that such disposition is in the best interest of Monroe County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1: That the foregoing WHEREAS clauses are hereby ratified and confirmed as 2 being true and correct and are hereby incorporated herein as if fully set forth below. Section 2: That Resolution No. 96-2026 is hereby amended to authorize the donation of only of the following vehicle to the Monroe Association for Retarded Citizens, Inc., d/b/a MARC House: 2016 MAN MV-1 / VIN:57WMD2C68GM100492 / Monroe County Fleet Management Department Reasonable Market Approximation: $24,500.And that the Commission further hereby expressly finds and determines that donation of the vehicle described herein serves a valid public purpose and is in the best interest of Monroe County pursuant to Sections 125.38 and 274.05, Florida Statutes, the Monroe County Purchasing Policy, and any other applicable provisions of law. Section 3: That the remaining vehicles previously identified in Resolution No. 96-2026 shall retain County ownership, pending identification and approval of an eligible adopting agency by the Florida Department of Transportation ("FDOT") or other lawful disposition method. Section 4: That the vehicles no longer proposed for donation and currently excluded from Monroe County Community Services inventory shall be restored within the property inventory schedule managed by the Monroe County Clerk of Court and Comptroller. Section 5: That the Mayor, County Administrator, or Director of Community Services Department, each independently of the other, are hereby authorized to execute any necessary documents to effectuate the transfer authorized herein. Section 6: That all resolutions or parts of resolutions in conflict with this Resolution are hereby rescinded to the extent of such conflict. Section 7: That if any clause, section, other part, or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portion or applications of this Resolution. Section 8: That this Resolution shall be in full force and effect immediately upon its adoption. Stat., provides that the BOCC, by and through a duly adopted resolution, may convey any County-owned personal property that is no longer needed for County purposes to a non-profit organization which may be organized for the purposes of promoting community interest and welfare; and 1 WHEREAS, additionally pursuant to the above-cited state law, the BOCC may fix the price of such conveyance,regardless of the actual value of such property,i.e.provide such property as a donation, as long as such information is set out in the resolution authorizing the conveyance; and WHEREAS, MARC House is a Florida registered nonprofit organization that meets the definition of a"private nonprofit agency"pursuant to Section 273.01(3), Fla. Stat., in that it is tax- exempt under Section 501(c)(3) of the Internal Revenue Code; and WHEREAS, MARC House's mission includes providing services to individuals with developmental and intellectual disabilities, consistent with public health and welfare and the relief of human suffering within Monroe County; and WHEREAS,the subject vehicles, in particular,where purchased, at least in part-- if not in full, through the use of the Florida Department of Transportation (FDOT) funding, and as a lienholder, FDOT has approved the donation of the subject vehicles to MARC House as it is an eligible entity within the same service area and program as the County, pursuant to the requirements of 49 U.S.C. § 5310, entitled "Enhanced Mobility and Seniors & Individuals with Disabilities Program," and FDOT has since provided lien satisfaction letters to facilitate this donation; and WHEREAS, consistent with Sections 274.05 through 274.07, Fla. Stat., as well as the Monroe County Purchasing Policy, assets that have been declared surplus but hold a fair market value of$5,000 or more may be donated to a private nonprofit agency only after the BOCC makes a determination that the donation is in the best interest of the County; and WHEREAS,having considered the foregoing,the BOCC hereby finds and determines that the donation described herein serves a public purpose and is in the best interest of Monroe County, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: 2 Section 1: That the foregoing "WHEREAS"clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution.
