ITEM BACKGROUND: On April 15, 2026, the Board of County Commissioners (`BOCC") discussed the administration of County-supported health and human services, and directed County staff to develop an alternative framework intended to support residents with significant supportive service needs within Monroe County. The BOCC further directed County staff to coordinate with the Florida Department of Health in Monroe County("DOH-MC") regarding administration of medical-related services funding and to utilize the Monroe County Community Services ("Social Services") Department for administration of non-medical Special Needs Core Services. The Resolution defines "Special Needs Core Services" as direct support services that are significant and specifically tailored to serve Monroe County residents who fall within one or more of the enumerated categories: a) persons with developmental disabilities under Chapter 393, Florida Statutes; b)persons receiving substance abuse services under Chapter 397, Florida Statutes; c)persons with physical disability and persons receiving disability-related services under Chapter 413,Florida Statutes; d) victims of domestic violence and persons receiving domestic violence abuse-related services under Chapter 741, Florida Statutes; and e)persons, including youth, who meet the definition of"homeless" as set forth in Section 420.621, Florida Statutes. As referenced herein, each chapter or section of the Florida Statutes cited above is intended to include such chapter or section as same may be amended from time to time. The Resolution establishes minimum requirements for the framework/program, as well as minimum requirements for funding eligibility (both eligible recipients and eligible expenses). Additionally, the Resolution makes a finding consistent with Section 2-25, "Contracts with nongovernmental organizations for performance of valid county purposes," of the Monroe County Code, whereby the BOCC finds and determines that non-profit organizations or non-governmental organizations awarded a contract or funding under this framework/program performs a valid County function and purpose in the course of its activity, to wit: health and welfare programs, and that the interests of citizens of the County are served by contracting with the organization to either directly perform such Special Needs Core Services, or provide essential support to entities rendering Special Needs Core Services, on behalf of the BOCC. The BOCC delegates authority to the Director of Community Services to interpret, expand on, or add to these minimum requirements, as same is deemed necessary and appropriate to effectuate the stated goals of the BOCC in the Resolution, and as approved for consistency, legal form, and sufficiency by the County Attorney, or designee. Any funding allocation in support of the framework/program will be determined annually through the Monroe County budget process and shall remain subject to available funding, annual budget appropriations, applicable agreements, and final approvals as required by law. Through this Resolution, the BOCC further directs that medical-related services would be administered through DOH-MC and incorporated within the Core Contract between Monroe County and the Florida Department of Health, subject to available funding, annual budget appropriations, applicable agreements, and final BOCC approval as required by law. The DOH-MC may, at its discretion, utilize these funds to augment their services, to meet the health needs of the community, through third party providers PREVIOUS RELEVANT BOCC ACTION: On April 15, 2026, Item S8, the BOCC discussed human services funding and gave direction to staff to develop a Special Needs Core Services funding framework/program and coordinate with the Florida Department of Health in Monroe County regarding administration of medical-related services funding. Grant: No County Match: No RESOLUTION NO. -2026 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, ESTABLISHING A SPECIAL NEEDS CORE SERVICES FUNDING FRAMEWORK; ESTABLISHING MINIMUM REQUIREMENTS FOR FUNDING INCLUDING, BUT NOT LIMITED TO, A DEFINITION OF SPECIAL NEEDS CORE SERVICES, ELIGIBILITY REQUIREMENTS, AND INELIGIBLE USES; AUTHORIZING THE MONROE COUNTY COMMUNITY SERVICES (SOCIAL SERVICES) DEPARTMENT TO DEVELOP, IMPLEMENT, AND ADMINISTER NECESSARY ASPECTS OF THE FRAMEWORK; AND TRANSITIONING MEDICAL- RELATED SERVICES FUNDING TO THE FLORIDA DEPARTMENT OF HEALTH IN MONROE COUNTY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Board of County Commissioners of Monroe County, Florida ("BOCC") recognizes the importance of supporting essential community-based services for residents with significant supportive service needs within Monroe County; and WHEREAS,on April 15, 2026, at its duly-noticed regular public meeting, the BOCC held a discussion to determine the best path forward in light of recent State Department of Government Efficiency Priorities and Reporting and financial support historically given to non-profit organizations in the County; and WHEREAS, the BOCC considered multiple options to maintain levels of service to Monroe County residents, and directed County staff to coordinate with its existing inter- governmental partner, the Department of Health for Monroe County("DOH-MC"), to facilitate a process whereby medical-related services are supported, at the discretion of the DOH-MC; as well as utilize the Monroe County Community Services (Social Services) Department ("Social Services") to offer support for "Special Needs Core Services" that may not be covered by DOH- MC; and WHEREAS, the BOCC directed that funding for medical-related services would be 1 administered through DOH-MC and incorporated within the Core Contract between Monroe County and the Florida Department of Health, subject to available funding, annual budget appropriations, applicable agreements, and final BOCC approval as required by law; the DOH- MC may,at its sole discretion,utilize these funds to meet the public health needs of the community through augmentation or supplementation of new or existing services that may include the use of third party providers; and WHEREAS,Monroe County Community Services (Social Services)Department("Social Services") already administers County, state, and federally funded programs that provide eligible residents with nutrition assistance, utility assistance, and transportation services pursuant to specific grants programs and county budgeted funds; and WHEREAS, the BOCC sought to utilize this County department to offer support for "Special Needs Core Services"within the categories of nutrition assistance, utility assistance, and transportation services, to expand the funding opportunities to special needs populations that may not meet the strict eligibility requirements of the County's existing grant programs; and WHEREAS, the BOCC directed County staff to propose a definition for "Special Needs Core Services" and provide a policy outline of how Social Services could be expanded within the existing services categories (nutrition assistance, utility assistance, and transportation services) to support populations identified as requiring"Special Needs Core Services"in Monroe County; and WHEREAS, after research, collaboration, and deliberation, County staff hereby proposes the following definition: "The term Special Needs Core Services shall mean direct support services that are significant and specifically tailored to serve Monroe County residents who fall within one or more of the enumerated categories: a) persons with developmental disabilities under Chapter 393, Florida Statutes; b) persons receiving substance abuse services under Chapter 397, Florida Statutes; c)persons with physical disability and persons receiving disability-related services under Chapter 413, Florida Statutes; d) victims of domestic violence and persons receiving domestic violence abuse-related services under Chapter 741, Florida Statutes; and e) persons, including youth, who meet the definition of"homeless" as set forth in Section 420.621, Florida Statutes;" and WHEREAS, the BOCC directed County staff to establish a Special Needs Core Services 2 funding framework to support persons requiring "Special Needs Core Services," to be administered through the Monroe County Community Services (Social Services) Department, subject to eligibility requirements, available funding, annual budget appropriations, applicable agreements, and in compliance with all applicable federal, state, and local laws, as well as local resolutions and policies; and WHEREAS,the funding framework contemplated herein is intended to be complementary and supplemental to all other funding that non-profit and non-governmental organizations may already access (or may access in the future) within the existing Social Services grant programs, including nutrition assistance, utility assistance, and transportation services, provided all applicable eligibility, funding, and program requirements are met; and WHEREAS, under this funding framework, it is the intent of the BOCC to create new opportunities for non-profit and non-governmental organizations that provide"Special Needs Core Services," and the BOCC recognizes that this is a new undertaking that requires robust development, implementation, and administration in accordance with relevant State and County laws and regulations; and WHEREAS, the BOCC finds that establishing a Special Needs Core Services funding framework/program as provided herein is in the best interest of the health, safety, and welfare of the residents of Monroe County, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1: That the foregoing"WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2: That the County Commission hereby establishes the Special Needs Core Services funding framework/program with the following minimum requirements: l. Funding opportunities under this framework/program will be noticed and offered to the public on an annual basis, pending receipt of an annual appropriation, or more frequently as may be reasonable when funds are available, and consistent with the County's procurement ordinance and policy. 2. Funding awards will be made in a manner consistent with the Monroe County Purchasing Policy, as may be amended from time to time. 3. Only non-profit organizations and non-governmental organizations 3 are eligible to apply for funding under the framework/program.Nothing herein shall authorize direct funding assistance to individual residents. 4. Eligible recipients must utilize awarded funding for services provided within Monroe County,Florida, and must satisfy any additional eligibility, contractual, reporting, operational, insurance, or compliance requirements established within the framework/program documents. 5. The framework/program implementation and administration documents will be drafted consistently with these policy directions. Section 3: That the County Commission hereby establishes the minimum eligibility requirements for recipients under the newly created Special Needs Core Services funding framework/program: l. Eligible entities are non-profit organizations and non-governmental organizations that provide Special Needs Core Services. That term is defined as direct support services that are significant and specifically tailored to serve Monroe County residents who fall within one or more of the enumerated categories: a) persons with developmental disabilities under Chapter 393, Florida Statutes; b) persons receiving substance abuse services under Chapter 397, Florida Statutes; c) persons with physical disability and persons receiving disability-related services under Chapter 413, Florida Statutes; d) victims of domestic violence and persons receiving domestic violence abuse-related services under Chapter 741, Florida Statutes; and e)persons, including youth, who meet the definition of"homeless" as set forth in Section 420.621, Florida Statutes. As referenced herein, each chapter or section of the Florida Statutes cited above is intended to include such chapter or section as same may be amended from time to time. 2. Eligible expenses are only those expenses incurred to serve Special Needs Core Services clients and that fall within the categories of nutrition assistance, utility assistance, and transportation services. For avoidance of doubt, the funding from this framework/program must not be utilized for the following (excluded expenses): salaries, meeting space expenses, child care services, athletic or recreational programs, cultural or arts programs, educational or academic programs, housing development projects, rental assistance, mortgage assistance, clothing distribution, school supplies, hygiene products, literacy programs, truancy prevention programs, holiday gift programs, or any other use inconsistent with the purposes established under this resolution. The exclusionary expenses provision contained herein will not be interpreted to prohibit otherwise eligible expenses that specifically qualify as nutrition assistance, utility assistance, or transportation services under this framework/program. 3. Priority shall be given if the non-profit organization or non- governmental organization utilizes the funding that is awarded under this framework/program for a monetary match to leverage or bring additional funding into Monroe County. To seek priority on this basis, the non-profit organization or non-governmental organization must provide documentation to demonstrate that the County's monetary award is required in order to receive the corresponding state- or federally-sourced matching funds. 4. If it is determined that an awardee under this framework/program has used the funding in a manner that is inconsistent with the terms and conditions of the award, and inconsistent with this resolution, the awardee will be ineligible for 4 funding under this framework/program. Section 4: That the County Commission assigns the Community Services (Social Services) Department, and authorizes the Director of Community Services Department, or designee,to develop the Special Needs Core Services framework/program documents,implement, and administer all aspects of the framework/program. This includes, but is not limited to, developing internal policies and procedures, requests for proposals or applications and associated materials, reviewing eligibility documents, verification of compliance with all requirements, reporting standards, monitoring requirements, and related operational processes necessary to administer funding in accordance with this resolution and applicable law and local policies, such as the Monroe County Purchasing Policy. The Commission further delegates authority to the Director of Community Services to interpret, expand on, or add to these minimum requirements, as same is deemed necessary and appropriate to effectuate the stated goals of the Commission in this resolution, and as approved for consistency, legal form, and sufficiency by the County Attorney, or designee. For any proposed material deviation by the Director of Community Services from the stated goals and policy directions contained herein, the Commission requires formal approval of same prior to implementation. Material deviations requiring Commission approval will be detennined by the County Attorney, or designee. Section 5: That the County Commission in establishing the Special Needs Core Services funding framework/program hereby confirms compliance with Section 2-25, "Contracts with nongovernmental organizations for performance of valid county purposes," of the Monroe County Code, and finds that any non-profit organization or non-governmental organization awarded a contract or funding under this framework/program performs a valid County function and purpose in the course of its activity,to wit: health and welfare programs, and that the interests of citizens of the County are served by contracting with the organization to either directly perform such Special Needs Core Services, or provide essential support to entities rendering Special Needs Core Services, on behalf of the Board of County Commissioners. This resolution will serve as the authorizing resolution pursuant to Section 2-25, Monroe County Code, as may be amended from time to time, for each contract awarded under the framework/program. Consistent with Section 2- 25,Monroe County Code,an awardee under this framework/program must"present both a detailed report of its annual activities, designating those activities of the organization to which County funds were applied, and a copy of the organization's annual audit report, certified by a certified public accountant licensed to do business in the state;" and if Section 2-25, Monroe County Code, is amended or repealed, the framework/program must follow the most up to date Section 2-25, Monroe County Code.Nothing contained herein may be interpreted to circumvent Monroe County Code Sections: 2-25, 2-346 through 2-349 (known as the County's Purchasing and Contracts ordinances), nor the County's Purchasing Policy, as each may be amended from time to time. Additionally, nothing contained herein may be interpreted as an entitlement or the creation of an entitlement to funding. Any funding allocation shall be determined annually through the Monroe County budget process and shall remain subject to available funding, annual budget appropriations, applicable agreements, and final approvals as required by law. Section 6: That the County Commission further directs that nothing in this resolution may be interpreted to prohibit a non-profit organization or non-governmental organization from accessing previously existing Social Services grant programs,including but not limited to nutrition assistance, utility assistance, and transportation services, provided the organization and/or individuals served meet all applicable program eligibility requirements, funding source 5 requirements, contractual requirements, and County policies, as may be amended from time to time. Section 7: That the County Commission directs that public health related services would be administered through DOH-MC and incorporated within the Core Contract between Monroe County and the Florida Department of Health, subject to available funding, annual budget appropriations, applicable agreements, and final BOCC approval as required by law. At the discretion of DOH-MC, these funds may be utilized to meet the public health needs of the community through augmentation or supplementation of new or existing services that may include the use of third party providers, subject to Florida law. DOH-MC retains discretion and authority to determine whether the funding received under the terms of resolution will be utilized to provide, modify, or discontinue any service, program or activity that it is authorized to provide under applicable Florida Statutes. Section 8: That all resolutions or parts of resolutions in conflict with this resolution are hereby rescinded to the extent of such conflict. Section 9: That if any clause, section, other part or application of this resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this resolution. Section 10: That this resolution shall be in full force and effect immediately upon its adoption.
