A Public Hearing to Consider Approval of a Resolution Approving an Extension of the Reservation of
Two (2) Moderate-Income Affordable Housing ROGO Allocations, as Requested by Habitat for
Humanity of the Upper Keys, Inc, for Proposed Affordable Housing Dwelling Units at 116 and 117
Poinsetta Drive, Lots 14 & 15, Block 6, Holiday Homesites, Key Largo, Monroe County, Florida,
Currently Having Parcel Identification Numbers 00530730-000000 and 00530740-000000 until June
15, 2027, for Building Permit Issuance.
ITEM BACKGROUND:
Habitat for Humanity of the Upper Keys, Inc ("the Applicant") has requested an extension of the
reservation of two (2) moderate income affordable ROGO allocations pursuant to Monroe County
Land Development Code ("LDC") Section 138-24(b)(2), for properties located 116 and 117 Poinsetta
Drive, Key Largo, Monroe County, Florida, currently having Parcel Identification Numbers
00530730-000000 and 00530740-000000 until June 15, 2027. Habitat for Humanity of the Upper
Keys, Inc., is a 501(c)3 not-for-profit organization engaged in the construction of affordable housing
in the Upper Keys. The Applicant would be required to obtain all necessary development approvals
from Monroe County and all applicable state and federal regulatory and other governmental
requirements by this date.
On June 15, 2022, the BOCC approved Resolution No. 178-2022, which reserved two (2)
affordable housing allocations on the subject properties until June 15, 2026.
On June 15, 2022, the BOCC approved Resolution No. 177-2022 approving a county deed to donate
two lots (Lots 14 & 15 of the Holiday Homesites Subdivision) for the construction of two affordable
housing dwelling units to Habitat for Humanity of the Upper Keys indicating units to be built upon by
July 1, 2027.
Habitat for Humanity of the Upper Keys, Inc, submitted building permit applications SFDUP-AFF-
2025-0009 and SFDUP-AFF-2025-0010 for the construction of the aforementioned Affordable
Housing units.
Per Section 138-24(b)(1)(2), the BOCC may reserve affordable ROGO allocations for nonprofit
community development organizations; specific affordable or employee housing projects...receiving
some form of direct financial assistance from the county upon written request from the project sponsor
and approved by resolution of the BOCC.
The proposed development also qualifies for financial assistance from the County through a waiver of
impact fees and was approved for a building permit fee waiver on May 20, 2026.
Monroe County Land Development Code Section 138-24:
(b) Reservation of affordable housing allocations. Notwithstanding the provisions of Section 138-26
for awarding of affordable housing allocations, the BOCC may reserve by resolution some or all of
the available affordable housing allocations for award to certain sponsoring agencies or specific
housing programs consistent with all other requirements of this chapter. Building permits for these
reserved allocations shall be picked up within six months of the effective reservation date, unless
otherwise authorized by the BOCC in its resolution. The BOCC may, at its discretion,place
conditions on any reservation as it deems appropriate. These reservations may be authorized by the
BOCC for:
(1) The county housing authority, nonprofit community development organizations,pursuant to
Section 139-1(e), and other public entities established to provide affordable housing by entering into a
memorandum of understanding with one or more of these agencies;
(2) Specific affordable or employee housing projects participating in a federal/state housing financial
assistance or tax credit program or receiving some form of direct financial assistance from the county
upon written request from the project sponsor and approved by resolution of the BOCC;
(3) Specific affordable or employee housing projects sponsored by nongovernmental not-for-profit
organizations above upon written request from the project sponsor and approved by resolution of the
BOCC;
(4) Specific affordable or employee housing programs sponsored by the county pursuant to procedures
and guidelines as may be established from time to time by the BOCC;
(5) Specific affordable or employee housing projects by any entity, organization, or person, contingent
upon transfer of ownership of the underlying land for the affordable housing project to the county, a
not-for-profit community development organization, or any other entity approved by the BOCC, upon
written request from the project sponsor and approved by resolution of the BOCC; or
(6) Rental employee housing projects situated on the same parcel of land as the nonresidential
workplace for the tenants of these projects, upon written request from the property owner and
approved by resolution of the BOCC.
PREVIOUS RELEVANT BOCC ACTION:
On May 18, 2022, the BOCC directed staff to prepare a resolution to effectuate the transfers of the
two county-owned parcels (Block 6, Lots 14 & 15, Holiday Homesites Subdivision) to Habitat for
Humanity of the Upper keys, Inc. for the construction of two affordable housing dwelling units.
On June 15, 2022, BOCC approved Resolution No. 177-2022 approving a County Deed to donate two
lots with a reverter clause for the affordable dwelling units not built by July 1, 2027.
On June 15, 2022, BOCC approved Resolution No. 178-2022 approving reservation of two (2)
affordable housing allocations through June 15, 2026.
On May 20, 2026, BOCC approved item M7 for Building Permit Fees Waiver.

On behalf of Habitat for Humanity of the Upper Keys, Inc.,we respectfully submit this
formal request for an extension of the reservation of two (2) Moderate Income Category
Affordable ROGO allocations granted under Resolution No. 177-2022, currently set to
expire on June 15, 2026.
As you are aware, this allocation supports the development of two affordable housing
units on Lots 14 and 15, Block 6, Holiday Homesites Subdivision in Key Largo in
accordance with Section 138-24(b)(2) of Monroe County code. Despite our diligent
efforts to advance this project, several unforeseen challenges have affected our timeline,
including funding timelines, environmental mitigation plans, and project
design/engineering.
We remain fully committed to the timely completion of these much-needed affordable
housing units, and we continue to work in coordination with Monroe County staff and
other relevant agencies to meet all regulatory requirements. However, in order to finalize
the building permits and initiate construction without jeopardizing the allocated ROGO

units, we respectfully request that the reservation period be extended by an additional 12
months, until June 15, 2027.
This extension will allow us to finalize remaining pre-construction obligations and ensure
compliance with all applicable provisions of the Monroe County Comprehensive Plan,
Land Development Code,Florida Building Code, and related floodplain and
environmental regulations. We have already applied for building permits for these two
parcels (SFDUP-AFF-2025-0009 and SFDUP-AFF-2025-0010). We are ready to begin
construction as soon as these are approved.
We kindly ask that this request be placed on the agenda for review and approval by the
Board of County Commissioners at the next available regular meeting.
Please let us know if any additional documentation or procedural steps are required in
order to process this request. We appreciate your continued support in helping to bring
affordable housing to the Upper Keys community.

15 HOMESITES SUBDIVISION] FOR THE CONSTRUCTION OF
16 TWO (2) AFFORDABLE HOUSING DWELLING UNITS TO
17 HABITAT FOR HUMANITY OF THE UPPER KEYS.

20 WHEREAS,the Board of County Commissioners of Monroe County,at a regular meeting
21 on the 181h of May 2022 in Key West, Florida, first heard this matter, and
22
23 WHEREAS, pursuant to Article 8 of the Florida Constitution and Section 125.01(1)(t),
24 Florida Statutes, Monroe County possesses the police powers to enact Resolutions in order to
25 protect the health, safety, and welfare of the County's citizens; and
26
27 WHEREAS, Section 125.38, Florida Statutes, specifically states that the donation of a
28 land to a non-profit organization promoting community interest and welfare be done by
29 Resolution; and
30
31 WHEREAS, pursuant to Section 125.379, Florida Statutes, the Board of County
32 Commissioners adopted Resolution 404-2015 approving an inventory of County-owned real
33 property that may be appropriate for affordable housing, as reviewed and recommended by the
34 Monroe County Affordable Housing Advisory Committee; and
35
36 WHEREAS, Section 125.379, Florida Statutes, provides that the Board of County
37 Commissioners may donate properties identified as appropriate for use as affordable housing on
38 the inventory list adopted by the County to a nonprofit housing organization for the construction
39 of permanent affordable housing; and
40
41 WHEREAS, Habitat for Humanity of the Upper Keys, Inc. desires to acquire two County
42 owned parcels for the purpose of building affordable housing and such desire was set forth at the
43 Board of County Commissioners meeting on May 18, 2022, with Habitat for Humanity of the
44 Upper Keys requesting the two parcels; and

I WHEREAS,the two parcels are not needed by the County for other County purposes; and

3 WHEREAS, the County seeks to donate the land to Habitat for Humanity for a nominal
4 sum ($1.00); and
5
6 WHEREAS, adoption of this Resolution will further the health, safety, and welfare of the
7 citizens of Monroe County.

9 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
10 COMMISSIONERS OF MONROE COUNTY,FLORIDA:

12 The County shall, by passage of this Resolution, record a County Deed (attached to
13 this Resolution) in the public records of Monroe County transferring title of two
14 parcels from Monroe County to Habitat for Humanity of the Upper Keys Inc. This
15 deed is issued based upon the need of Habitat for Humanity for affordable lands to
16 build needed affordable housing and the availability of these non-needed County
17 surplus lands. This transfer of title is intended by the County to be a donation with
18 a nominal sale price of$1.00. The deed shall contain a reverter clause that would
19 return ownership of any lot conveyed, at the option of the County, if an affordable
20 dwelling unit has not been built upon that lot by July 1, 2027.

26 allocation recipients to promptly transform allocation awards/reservations into finished and occupied
27 affordable/workforce housing units; and

30 BOCC to authorize reservations for"specific affordable or employee housing projects participating in a
31 federal/state housing financial assistance or tax credit program or receiving some form of direct financial

35 WHEREAS, Habitat for Humanity of the Upper Keys, Inc., is proposing to develop the two
36 properties with one affordable housing unit on each site; and

38 WHEREAS,Habitat for Humanity of the Upper Keys,Inc.,is in process of obtaining ownership
39 of the subject properties through a County Deed Bargain and Sale from Monroe County; and
40
41 WHEREAS,the reservation of affordable housing allocations for the anticipated project does not
42 exempt the project from applicable requirements of the Monroe County Land Development Regulations,
43 Building Code and other regulatory requirements; and

I WHEREAS, Habitat for Humanity of the Upper Keys, Inc., shall obtain all required approvals
2 from the Monroe County Planning&Environmental Resources Department for the project;and

4 WHEREAS, Habitat for Humanity of the Upper Keys, Inc., shall obtain its for the
5 affordable housing dwelling units by June 15,2026; if the permit for a reserved ROGO allocation housing
6 unit is not issued by that time,the allocation will revert to the County;

19 from the Monroe County Planning & Environmental Resources Department for the project; and

21 WHEREAS, Habitat for Humanity of the Upper Keys, Inc., shall obtain building permits for
22 the affordable housing dwelling units by June 15, 2027; if the permit for a reserved ROGO allocation
23 housing unit is not issued by that time, the allocation shall revert to the County;
24
25 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
26 COMMISSIONERS OF MONROE COUNTY, FLORIDA:
27
28 Section 1. Recitals and Legislative Intent. The foregoing findings and determinations are true
29 and correct and are hereby incorporated as if fully set forth herein.

31 Section 2. Construction and Interpretation.This Resolution is necessary for the health, safety,
32 and welfare of the residents of and visitors to the county. This Resolution and its
33 interpretation shall be liberally construed and enforced in favor of Monroe County to
34 effectuate its County public purpose(s). The construction and interpretation of this
35 Resolution and all Monroe County Comprehensive Plan provision(s), Florida
36 Statute(s), and Monroe County Code(s) provision(s) whose interpretation arises out
37 of, relates to, or is interpreted in connection with this Resolution shall be liberally
38 construed and enforced in favor of Monroe County and such construction and
39 interpretation shall be entitled to great weight in adversarial administrative
40 proceedings, at trial, bankruptcy, and on appeal.

42 Section 3. The Monroe County Planning & Environmental Resources Department
43 ("Department") shall reserve two (2) moderate income category affordable ROGO
44 allocations, for the project at Lots 14 and 15 of the Holiday Homesites Subdivision,
45 Key Largo, currently having property identification numbers 00530730-000000 and
46 00530740-000000 , until June 15, 2027.

I Section 4. The developer must obtain the building permits for the two (2) affordable housing
2 units on or before June 15, 2027.

4 Section 5. The developer shall comply with the Monroe County Comprehensive Plan, Land
5 Development Code, Florida Building Code, floodplain management regulations, and
6 any and all other requirements of Monroe County and/or State and/or Federal oversight
7 agencies.

9 Section 6. The Department and Monroe County Building Department and Floodplain
10 Management Office professional staff are hereby authorized to process expeditiously
11 permit related applications for the above referenced project when received.

13 Section 7. Inconsistency, Partial Invalidity, Severability, and Survival of Provisions. If any
14 portion of this Resolution, or any part or portion thereof, is held to be invalid or
15 unenforceable by any administrative hearing officer or court of competent jurisdiction,
16 the invalidity or unenforceability of such provision,or any part or portion thereof, shall
17 neither limit nor impair the operation, enforceability, or validity of any other provision
18 of this Resolution, or any remaining part(s) or portion(s)thereof. All other provisions
19 of this Resolution, and remaining part(s) or portion(s) thereof, shall continue
20 unimpaired in full force and effect.
