AGENDA ITEM WORDING:
Discussion and direction to allow staff to explore options for completion of sixteen remaining
workforce housing units to be built at 95295 Overseas Highway, Key Largo, Florida(RE400484390-
000000) and to apply to preserve development potential pursuant to the Live Local Act required prior
to July 1, 2026.
ITEM BACKGROUND:
On June 18, 2025, the Board approved the expenditure of$6,867,100.00 of accumulated surplus
tourist development tax revenue for the acquisition of land containing 11 new affordable housing
units. The land associated with the project included 16 additional units on the land located at 95295
Overseas Highway, Key Largo, Florida, RE400484390-000000.
To optimize the use of the property it may be beneficial for the County to explore partnership
opportunities to support future development of additional housing on the property. An adjacent
landholder has offered to include these units within their project area. Staff would like to explore this
possibility; but, because of the original structure of the conditional use for the entire 28 units, known
as Southcliff Estates, staff needs authorization to submit an application to the Planning Department for
this potential opportunity.
Staff have been working with the Monroe County Housing Authority on a potential lease for the
existing units. This lease has not been fully negotiated at this point, and the Monroe County Housing
Authority supports the County's effort to explore other opportunities to find the best solution for this
development.
Florida Statute Section 125.01055(7), commonly known as the Live Local Act,provides opportunities
for the development of multifamily and mixed-use residential housing. The Act is scheduled to sunset
on July 1, 2026.
To preserve the site's development potential under the Live Local Act, staff is seeking authorization to
submit the Live Local Act Authorization Application to the Monroe County Planning Department.
PREVIOUS RELEVANT BOCC ACTION:
December 11, 2024, Resolution No. 544-2024 was adopted, establishing the Monroe County
Affordable Tourism Housing Program for purposes of funding affordable housing development
projects which provide affordable housing available to Employees of Private Sector Tourism-Related
Business int he County in accordance with Ch. 24-219, Section 4, Laws of Fla.
June 18, 2025, Resolution No. 229-2025 was adopted approving the acquisition of 95295 Overseas
Highway, Key Largo, Florida.
