SUBJECT: Proposed Change Order to be Approved
Attached is proposed Change Order#1 for the Bernstein Park Basketball Court Resurfacing
Project. This change order increases the final contract sum by$3,325. This project was budgeted and
the department has sufficient funds in their budget to cover this increase. The substantial completion
date is unchanged.
Monroe County Ordinance 027-1998 and subsequent amendments provide authority for the
Administrator to approve change orders within specified limits after providing Board of County
Commissioners with at least 24 hours to review them and pose any questions or objections that they
may have.
It is the Administrator's intent to approve the attached change order under that authority after the 24-
hour BOCC notification time.

Detailed description of change order and justification:
Per quote, accurate measurements of low areas can only be completed during flooding of the courts. If
additional patching is required, it will be billed through a change order at$475.00 per 5 gallons. An additional
35 gallons were needed to properly patch and level the courts to ensure safety.

SCOPE OF WORK:
The Contractor will supply and install an additional 35 gallons of acrylic patch binder to fill existing low spots and depressions throughout the
court surface.This work is intended to help minimize water retention on the court.
The Contractor will provide the necessary labor to install the patch binder,allow proper curing time,and grind the patched areas as needed to
smooth and blend the surface prior to the acrylic coating application.
Due to the depth of some patched areas,the Contractor will also install fiberglass strips over selected patch locations to provide additional
reinforcement and help reduce the chance of cracking or separation within the patched areas.
After patching and fiberglass reinforcement are completed,the Contractor will install Acrylic Resurfacer over the repaired areas to prepare the
surface for the final acrylic paint system.
Note:This work will help improve surface conditions and reduce water retainage,however,it does not change the existing court slope or
guarantee complete elimination of all standing water.

The Contractor guarantees all work against defects in workmanship or materials for a period of(1)_years from date of completion.This
guarantee excludes Normal wear and tear, physical abuse or neglect and any other conditions beyond the contractor's control,such as
sub-base settling,structural cracks,asphalt shrinkage cracks, hydrostatic pressure or water vapor pressure bubbles,intrusion of weeds or
grass,etc.Existing cracks may reappear at any time. Proper tennis shoes must be worn on court. Some sneakers,street shoes,dark
soled shoes,skateboards, roller blades,etc.will scuff and damage surface. Guarantee shall become void upon owner's failure to adhere
and comply with the payment schedule.
