This Amendment adds six (6) more months of grant administration oversight for the Community Development Block Grant - Coronavirus (CDBG-CV) grant due to the recent grant increase and extension the County received. This Amendment is 100% funded by a CDBG-CV Grant administered by the Florida Department of Commerce. ITEM BACKGROUND: Monroe County was awarded a Community Development Block Grant — Coronavirus (CDBG-CV) Grant in December 2022 in the amount of$2,956,534.00 for park rehabilitation upgrades at Rowell's Waterfront Park. A Grant Modification#1 was executed in April 2024 which extended the Agreement's expiration date to September 30, 2024. A Grant Modification #2 was executed in July 2025 which extended the grant expiration date to March 31, 2026, and also revised the Project Narrative. A Grant Modification #3 was approved by the BOCC at the May 20, 2026 meeting which increased the total grant amount from$2,956,533.59 to$5,036,533.59, increased the scope of work,and extended the grant expiration date from March 31, 2026, to December 31, 2026, in order to complete the project. A Task Order for Grant Administration Services was issued to Hale Innovation, LLC in March 2023 whereby the Consultant was to assist the County with CDBG-CV Grant Program Commencement Documentation, Grant Program Regular Interval Reporting, and Grant Program Closeout Documentation. Due to the various project delays and grant extensions, two amendments have been issued to Hale Innovation which extended their grant administration services for the project. This Third Amendment to the Task Order extends their services an additional six (6) months until the end of December, which is when the current CDBG-CV grant expires. The total contract amount including this Third Amendment is $110,400.00 and is 100% funded by the CDBG-CV grant. PREVIOUS RELEVANT BOCC ACTION: 02/17/21 —BOCC held a Public Hearing for input on application for CDBG-CV grant funds to enhance Rowell's Park. 10/20/21 —BOCC approved a Language Access Plan for the CDBG-CV program in Monroe County. 12/07/22 - BOCC approved a CDBG-CV Grant in the amount of$2,956,534.00 for Rowell's Park Phase II. March 2023 —A Task Order with Hale Innovation, LLC for grant administration services was executed by the County Administrator. April 2024 - Kevin Wilson approved Modification#1 which extended the CDBG-CV Agreement's expiration date to September 30, 2024. June 2024—The First Amendment to the Task Order with Hale Innovation, LLC for grant administration services was executed by the County Administrator. 7/16/25 - BOCC approved an Agreement with Pedro Falcon Contractors for the Rowell's Park Phase II Redevelopment Reduced Scope project. 7/16/25—BOCC approved Modification#2 to CDBG-CV grant which extended the expiration date to March 31, 2026 and revised the Project Narrative. 9/10/25 —BOCC approved a First Amendment to Agreement w/Pedro Falcon which added legal language requested by the Florida Department of Commerce. October 2025—The Second Amendment to the Task Order with Hale Innovation, LLC for grant administration services was executed by the County Administrator. 5/20/26—BOCC aproved Modfication #3 which extended the expiration date to December 31, 2026, and increased grant amount to $5,036,533.59. All terms and conditions of the Agreement apply to this Task Order, unless this Task Order amends, adds, or modifies a provision or an Article of the Agreement, which will be specifically referenced in this Task Order and the amendment, addition, or modification shall be precisely described. These additions apply only to the project referenced in this Task Order. This Task Order is effective on the 6th day of March , 2023. WHEREAS,Rowell's Waterfront Park is currently being redeveloped and the County has received funding through the Community Development Block Grant Coronavii-us Aid (CDBG-CV) program for Phase II of the project; and WHEREAS,the County desires to have assistance with the administration of the CDBG-CV grant in order to ensure compliance with the grant requirements and the Consultant has the needed expertise to provide this service. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the parties agree as follows: 1. In accordance with Article 11, SCOPE OF BASIC SERVICES of the Agreement, the Consultant will provide Grant Administration Services for oversight of the Rowell's Waterfront Park CDBG-CV grant administered by the Florida Department of Economic Opportunity (FDEO). Services provided shall include: a. CDBG-CV Grant Program Commencement Documentation — The Consultant shall prepare commencement documentation including HUD Form 2880, DEO SERA Security Agreement/Confidentiality Form(s), Forms SC-30 and 31, and any other necessary forms. The County will review and supply needed signatures and Consultant shall submit the forms as directed by FDEO. b. CDBG-CV Grant Program Regular Interval Reporting— The Consultant shall prepare regularly required administration documentation including Request for Funds, Quarterly Progress Reports, Quarterly Fair Housing Reports, Semi-annual Minority 1 and Business Enterprise Reports, Annual Section 3 Reports, and any other necessary forms. The County will review and supply needed signatures and the Consultant shall coordinate with the County to submit form(s)via the Subrecipient Enterprise Resource Application (SERA) online system. c. CDBG-CV Grant Program Closeout Documentation — The Consultant shall provide assistance upon completion of construction with documentation of compliance with all grant requirements. The Consultant shall prepare all required documentation including Administrative Closeout Report and any other necessary forms. The County will review and supply needed signatures and the Consultant shall coordinate with the County to submit all required closeout documentation as required by FDEO. 2. In accordance with Article VII Paragraph 7.1 of the Agreement, the County shall pay the Consultant a lump sum total of Thirty-Eight Thousand, Four-Hundred and 00/100 Dollars ($38,400.00)paid on a monthly lump sum basis in the amount of$2,400.00 per month for sixteen (16) months. WHEREAS, the parties executed a Task Order on March 6, 2023, whereby the Consultant is to provide assistance with the administration of the Community Development Block Grant Coronavirus Aid(CDBG-CV) grant for Rowell's Waterfront Park redevelopment; and WHEREAS, the parties executed a First Amendment to the Task Order on June 24, 2024, which extended the Consultant's services for an additional sixteen months due to a delay in the project timeframe; and WHEREAS, the project has again continued past the projected timeframe necessitating an extension of time for the Consultant to provide grant administration services in order to ensure compliance with the grant requirements. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the parties agree as follows: 1. In accordance with Article II, SCOPE OF BASIC SERVICES of the Agreement, the Consultant will continue to provide Grant Administration Services for oversight of the Rowell's Waterfront Park CDBG-CV grant administered by the Florida Department of Commerce, formerly the Florida Department of Economic Opportunity (FDEO).
