AGENDA ITEM WORDING:
Approval to advertise an ordinance amending Section 18-27(h) of the Monroe County Code of
Ordinances, entitled Rules of Conduct and Operational Procedures for Certain Parks, Providing for
Admission Fees for Non-Exempt Users;Providing for Parking, Trailer Parking, and Boat Ramp Launch
and Retrieval Fees at Harry Harris Park by Resolution; Providing for Enforcement of Violations.
ITEM BACKGROUND:
This amendment provides for exempt users and provides for fees to be set by resolution, rather than
within the ordinance, which would streamline the process for future fee modifications without requiring
ordinance amendments to be approved by the BOCC. Additionally, the applicable hours for parking
fees will be included on the resolution to provide greater clarity.
PREVIOUS RELEVANT BOCC ACTION:
On Dec 14, 2016, the BOCC approved raising non-resident fees at Harry Harris Park during holidays.
On March 17,2021 Discussion and direction on staffing and whether to revise our County policy on
park fees at Harry Harris Park on regular days and holidays.
On December loth, Parks and Beaches presented a discussion and direction item regarding the
implementation of parking fees at applicable parks and beaches.
On May 20th, the Parks and Beaches Department presented an updated discussion and direction item
following Legal's review of the parking fee proposal.

RESOLUTION NO.
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY,
FLORIDA, SETTING FEES FOR PARKING,
TRAILER PARKING, AND BOAT RAMP LAUNCH
AND RETRIEVAL FEES AT HARRY HARRIS PARK.
WHEREAS, the Monroe County Board of County Commissioners (BOCC) found
it in the interest of public welfare to continue charging user fees for vehicle parking,trailer
parking, and boat ramp launch and retrieval at Harry Harris Park to offset park operations
and maintenance costs; and
WHEREAS, 18-27(h) of the Monroe County Code authorizes the BOCC to set the
foregoing user fees at Harry Harris Park by resolution; and
WHEREAS, the BOCC now wishes to set reasonable user fees through this
resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Section 1. Recitals. The foregoing recitals, findings of fact, and conclusions of law are true and
correct and are hereby incorporated as if fully stated herein.
Section 2. Fees. The BOCC hereby approves the following fees:
(1) Harry Harris Non-Trailer Parking (7:30 to 4:OOPM only) $5 per hour for the first two
hours, then $2 per hour thereafter.
(2) Boat Trailer Parking (7:30 AM to sunset only) $40 per day, and $60 per day on
weekends that is contiguous with a holiday. (Boat launch fees are not included)
(3) Boat Ramp Launch (7:30 AM to sunset only) $10 for each launch and retrieval, drop-in
and pull-out. (Parking fees are not included)
Section 3. Effectiveness. This Resolution shall become effective on the date it is passed and
adopted.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe
County, Florida, at a regular meeting of said Board held on the day of

FLORIDA, AMENDING SECTION 18-27(h) OF THE
MONROE COUNTY CODE OF ORDINANCES,
ENTITLED RULES OF CONDUCT AND
OPERATIONAL PROCEDURES FOR CERTAIN
PARKS, PROVIDING FOR ADMISSION FEES FOR
NON-EXEMPT USERS; PROVIDING FOR
PARKING, TRAILER PARKING, AND BOAT RAMP
LAUNCH AND RETRIEVAL FEES AT HARRY
HARRIS PARK BY RESOLUTION;PROVIDING FOR
ENFORCEMENT OF VIOLATIONS; PROVIDING
FOR SEVERABILITY; PROVIDING FOR REPEAL
OF ALL ORDINANCES INCONSISTENT
HEREWITH; PROVIDING FOR INCORPORATION
INTO THE MONROE COUNTY CODE OF
ORDINANCES; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Monroe County Board of County Commissioners (BOCC) found
it in the interest of public welfare to continue charging non-resident parking fees for vehicle
parking, trailer parking, and boat ramp launch and retrieval at Harry Harris Park to offset
park operations and maintenance costs; and
WHEREAS, the BOCC now wishes to amend Section 18-27(h) of the Monroe
County Code, entitled Rules of Conduct and Operational Procedures for Certain Parks,
Admission Fees for non-Monroe County-residents only to modify rules for charging vehicle
parking, trailer parking, and boat ramp launch and retrieval fees at Harry Harris Park, and
to subsequently set reasonable fees by resolution rather than by amending Ordinance 18-
27(h) each time a fee change is needed; and
WHEREAS, the BOCC wishes to codify these amendments to section 18-27(h) of the
Monroe County Code.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT THE MONROE
COUNTY CODE OF ORDINANCES IS HEREBY AMENDED AS FOLLOWS:
SECTION 1: That Section 18-27(h)of the Monroe County Code is hereby deleted
in its entirety and replaced with:

(h)Vehicle parking, trailer parking, and boat ramp launch and retrieval at Harry Harris Park:
(1) Fees. The County may charge fees to non-exempt users for vehicle parking,
trailer parking, and boat ramp launch and retrieval at Harry Harris Park,to offset
park operations and maintenance costs. Such fees may not be imposed for profit
or general revenue purposes and must not unduly restrict public access to the
park.
(2) Exemptions. Monroe County residents and property owners are exempt from the
fees listed in this subparagraph(h).
Individuals who do not have a vehicle registered in Monroe County must register
with the County or its designated parking enforcement specialist to receive the
benefit of this exemption. Acceptable proof of residency or property ownership
includes, but is not limited to, a Monroe County property tax bill showing that
all taxes have been paid and are current or a copy of a long-term lease and/or
utility bills for the associated Monroe County address (with proper I.D.
provided).
Active-duty military members and disabled veterans (with proper I.D.
provided) may also register with the County or its designated parking
enforcement specialist to receive the benefit of this exemption.
(3) A schedule of parking fees and fines for parking violations shall be set by
resolution approved by the Board of County Commissioners.
(4) The County may use parking pay stations, applications, or the equivalent to
collect fees.

(5) The County may contract with parking enforcement specialists,who need not be
certified law enforcement officers.
(6) The County may enforce violations of this section by issuing a citation to the
owner of the vehicle in accordance with Fla. Stat. § 316.1967. The County may
not enforce violations of this section against vehicles displaying a valid disabled
parking permit at Harry Harris Park that is transporting the person to whom the
displayed permit is issued.
SECTION 2: SEVERABILITY. If any portion of this ordinance is for any reason
held invalid or declared to be unconstitutional, inoperative or void, such holding shall not
affect the remaining portions of this ordinance. If this ordinance or any provision thereof
shall be held to be inapplicable to any person,property or circumstances, such holding shall
not affect its applicability to any other person,property or circumstances.
SECTION 3: CONFLICT WITH OTHER ORDINANCES. All ordinances or
parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said
conflict.
SECTION 4: INCLUSION IN CODE OF ORDINANCES. The provisions of
this ordinance shall be included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately
renumbered to conform to the uniform numbering system of the Code.
SECTION 5: TRANSMITTAL AND EFFECTIVE DATE. This Ordinance
shall be filed with the Department of State and shall be effective as provided in section
125.66(2), Florida Statutes.
