ITEM BACKGROUND: This is a contract renewal for the period July 13, 2026, through July 12, 2027, for the operation and maintenance of the County-owned air curtain on Canal #266 in the Doctor's Arm Subdivision on Big Pine Key. The work is funded by an existing assessment for the O&M services. PREVIOUS RELEVANT BOCC ACTION: 07/17/24: Approval of amendment 2 for $15,000 to the contract with Avis Plumbing and Air Conditioning, Incorporated to extend the contract for one year for the operations and maintenance of the air curtain on Canal #266 on Big Pine Key from July 13, 2024 - July 12, 2025; and authorize the Acting County Administrator to execute. 06/18/25: Approval of Amendment #3 for $15,000 to the contract with Avis Plumbing and Air Conditioning, Incorporated to extend the contract for one year for the operations and maintenance of the air curtain on Canal #266 on Big Pine Key from July 13, 2025 - July 12, 2026; and authorize the County Administrator to execute. AMENDMENT NO. 4 TO THE CONTRACT FOR CANAL 266 AIR CURTAIN OPERATIONS AND MAINTENANCE SERVICES BETWEEN MONROE COUNTY AND AVIS PLUMBING AND AIR CONDITIONING, INCORPORATED This Fourth Amendment to the Agreement for Continuing Services for the Operation, Maintenance and Monitoring of the Installed Air Curtain System in Canal #266 dated July 12, 2022 (Agreement) is made and entered into this 15th day of July, 2026 between Monroe County ("County"), a political subdivision of the State of Florida, the address of which is 1100 Simonton Street, Suite 2-205, Key West, Florida 33040 and Avis Plumbing And Air Conditioning Incorporated("CONTRACTOR"),the address of which is 831 Southwest 44th Street, Cape Coral, Florida 33914, (collectively , the "Parties"). WITNES SETH: WHEREAS, on July 12, 2022, the County and Contractor entered into an Agreement for Continuing Services for the Operation, Maintenance and Monitoring of the installed Air Curtain System in Canal #266, located in the Doctor' s Arm Subdivision on Big Pine Key, Florida; and WHEREAS, on July 17, 2024, a First Amendment to the Agreement was entered into between the Parties; and WHEREAS, on July 17, 2024, a Second Amendment to the Agreement was entered into between the Parties; and WHEREAS, on May 21, 2025, a Third Amendment to the Agreement was entered into between the Parties; and WHEREAS, the County requires Continuing Services for the Operation, Maintenance and Monitoring of the Installed Air Curtain System in Canal #266; and WHEREAS, the CONTRACTOR desires and is able to continue providing Operations, Maintenance and Monitoring Services for the existing air curtain system owned by Monroe County; and WHEREAS, it serves a legitimate public purpose for CONTRACTOR to continue to provide operations and maintenance and monitoring services for Monroe County. NOW THEREFORE, in consideration of the mutual promises and covenants contained herein, it is agreed as follows: Section 3. CONTRACT AMOUNT A. The total amount for this Amendment No.4 shall not exceed Fifteen Thousand Dollars ($15_000.00). The COUNTY shall pay the CONTRACTOR a lump sum amount of$6,000 for the CONTRACTOR's performance of the Contract for Operation and Maintenance of the Air Curtain. This includes a quarterly lump sum amount of $1,500. The total CONTRACT amount shall not exceed Seventy-five Thousand Dollars ($75,000.00). B. The Amendment No. 4 Amount includes $9,000 for deposits, utilities, replacement parts and equipment, and pre and post storm preparedness activities. The COUNTY shall reimburse the CONTRACTOR for the actual power consumption cost and replacement of parts, subject to paid receipts provided by the CONTRACTOR. Fees and deposits shall be reimbursed by the COUNTY at actual costs plus 5% overhead and Profit. Replacement parts and equipment costing greater than $100.00 require advance approval of the County prior to purchase and installation, which shall be provided by email from the County's project manager. The County, at its option, may elect to pay the power costs directly to the utility company if the meter remains in the County's name. Section 4. TERM OF AGREEMENT This Amendment No. 4 shall authorize a one-year extension to the Contract, from July 13, 2026, to July 12, 2027, unless terminated earlier under Paragraph 5 of this Agreement.
