ITEM BACKGROUND: The County has not updated its Stormwater Master Plan since 2001. The Consultant will complete the Monroe County Storm Water Master Plan Project "SWMP" to include an electronic copy of the completed SWMP. The scope is organized into three components: Task 1 S WMP Requirements fulfills grant-required SWMP tasks; Task 2 Stormwater Policy and Supporting Document Updates revises the County's stormwater policy framework and support documents; and Task 3 Stormwater Utility Feasibility and Decision Support provide stormwater utility feasibility decision support. TASK ORDER#16 FOR CATEGORY C ON-CALL PROFESSIONAL ENGINEERING SERVICES FOR ENVIRONMENTAL ENGINEERING SERVICES BETWEEN MONROE COUNTY AND WSP USA INC. FOR STROMWATER MASTER PLAN PROJECT IN MONROE COUNTY, FLORIDA This Task Order#16 is entered into on this 15t" day of July 2026, in accordance with the Continuing Contract for On-Call Professional Environmental Engineering Services made and entered on the 18t" day of May 2022 and Amendment No. 2 dated January 24t", 2025, between Monroe County, hereinafter referred to as the "County" and WSP USA Inc. hereinafter referred to as "Consultant" where design services are allowed if construction costs do not exceed $7,725,000.00, or for study activity if the fee for professional services for each individual study under the contract does not exceed $500,000.00 ("Agreement"), as provided in Subsection 287.055(2)(g), Florida Statutes, as amended by Section 2, Chapter 2024-204, Laws of Florida, pursuant to which Recital No. 2 of the Contract is hereby modified. All terms and conditions of the referenced Contract for On-Call Professional Engineering Services apply to the Task Order unless the Task Order modifies an Article or Provision of the Agreement in which case the Article or Provision will be specifically referenced in this Task Order, and the modification shall be precisely described. WITNESSETH WHEREAS, the Florida Division of Emergency Management's (Division) Bureau of Mitigation prioritizes flood risk management as an integral part of its mission. The goals of this project are to assist local communities in developing a Stormwater Master Plan for the purposes of ranking higher in the Community Rating System (CRS) of the National Flood Insurance Program (NFIP) and to increase resiliency in Florida communities. WHEREAS, this project is funded through the Hazard Mitigation Grant Program (HMGP) DR-4673-305-P43 as approved by the Division and the Federal Emergency Management Agency (FEMA) to create and update Watershed Master Plans (WMPs) throughout the State of Florida. WHEREAS, the County received Grant #H1426 from the Division to produce a Stormwater Master Plan (SWMP) for $400,000.00. This project is preceded by the Watershed Master Plan Pilot Program, with Stormwater Master Plans being encompassed in the second round of funding. WHEREAS, the County requested the Consultant who completed the WMP to continue with efforts to complete the SWMP update. The Consultant will utilize the existing stormwater models, evaluations and other relevant data to further the County's effort for developing this SWMP; and WHEREAS, the County will provide the non-federal cost share of$100,000. NOW, THEREFORE, in consideration of the mutual promises, covenants, and agreements stated herein, and for other good and valuable consideration, the sufficiency of which is hereby acknowledged, County and Consultant agree as follows: ARTICLE 1.1 TERMS OF AGREEMENT: This Task Order is effective on July 15t"5 2026, and shall terminate on May 31 St, 2028. ARTICLE II SCOPE OF BASIC SERVICES, PARAGRAPH 2.1.1 IS AMENDED AS FOLLOWS: PROJECT TITLE: Monroe County Stormwater Master Plan Project PROJECT LOCATION: The Project is located within unincorporated Monroe County, Florida. PROJECT DESCRIPTION: The Consultant will complete the Monroe County Stormwater Master Plan Project to include an electronic copy of the completed SWMP (after incorporating comments from the Division, if applicable) and a signed letter from the Monroe County Local Mitigation Strategy (LMS) Chairperson attesting that the completed SWMP shall be adopted and used to update the risk assessment and mitigation strategy during the next LMS plan update; and will provide documentation of WMP submittal to ISO/CRS. The scope is organized into three components: Task 1 fulfills grant-required SWMP tasks; Task 2 updates the County's stormwater policy framework and support documents; and Task 3 provides stormwater utility feasibility decision support. Tasks 2 and 3 are County-requested additions to the grant scope and will be clearly bounded so the overall effort remains consistent with the grant budget. It should be noted that the technical work under Task 1 is a foundation for Tasks 2 and 3 and those tasks cannot proceed until initial modeling and evaluation related to stormwater management is completed under Task 1. TASKS AND DELIVERABLES: Task 1 —FDEM Grant SWMP Requirements (Months 1-26 per Grant Agreement) Create Preliminary Stormwater Master Plan (Draft SWMP): The Consultant will prepare a preliminary SWMP narrative that includes an inventory of existing stormwater systems, the County's existing policies and regulations, identification of known problematic areas and areas with high flood risk, and recommendations for managing stormwater effectively. The Draft SWMP will address Minimum Criteria required for a creditable SWMP under the Data Inventory and Collection and Stormwater Master Plan Criteria categories. The Consultant will leverage existing County datasets and prior work products as the primary basis for the inventory and planning-level/screening-level evaluation consistent with the grant minimum criteria and available data. In addition, the design-level model rebuild is excluded unless added by amendment. Deliverables will include the following: • Draft SWMP for Division/County review • Prepare Final SWMP suitable for submission to the Division • Prioritize planning-level project list (routine maintenance and capital projects) Throughout completion of the grant Task 2 activities, The Consultant will coordinate with the applicable LMS working group to support adoption of the SWMP as an annex in the next LMS update and to inform the County's risk assessment and mitigation strategy. Task 2-Stormwater Policy and Supporting Document Updates (Months 12-26): Task 2 focuses on updating existing County regulatory and support materials, without developing an entirely new program. The County has an existing stormwater manual, layman's brochure, and calculation worksheet resources that will be used as the baseline for updates. Updates will account for recent amendments to Chapter 62-330, Florida Administrative Code and updates to the South Florida Water Management District (SFWMD) Environmental Resource Permit (ERP)Applicant's Handbook (Volumes 1 and 2). 2.1 Recommendations for Code Revisions: The Consultant will provide recommended amendments to the Monroe County Land Development Code Sections 114-2(a)(5) and 114-3 (Surface Water Management) and Chapter 122 (Floodplain Management) in strike-through/underline format. Recommendations will include stormwater management criteria for placement of fill material on private residential property and internal consistency between stormwater and floodplain provisions. 2.2 Updated Stormwater Manual and Layman's Brochure: Based on the code revision recommendations, The Consultant will update the County's Stormwater Manual and associated Layman's Brochure. Deliverables will be prepared for electronic use (County website) and print. The Consultant will provide 75 hard copies of the Stormwater Manual and 75 hard copies of the Layman's Brochure, in addition to digital versions. 2.3 Stormwater Calculation Worksheets: The Consultant will update electronic stormwater calculation worksheets for applicants to assist in determining required stormwater management volumes, including: (a) Single Family Residential worksheets (b) Multi-Family & Non-Residential worksheets and (c) Exfiltration Trench worksheet. The recommended deliverable format is a fillable PDF. Deliverables will include the following: • Strike-through/underline draft code amendment package (Ch. 114- 2(a)(5), 114-3, and Ch. 122) • Updated Stormwater Manual (digital and print-ready) • Updated Layman's Brochure (digital and print-ready) • Seventy-five (75) hard copies of the Stormwater Manual and seventy-five (75) hard copies of the Layman's Brochure • Updated stormwater calculation worksheets: Single-Family, Multi- Family/Non-Residential, and Exfiltration Trench (fillable PDFs) Task 3-Stormwater Utility Feasibility and Decision Support (Months 14-26)1: Task 3 will provide the County with decision-support information needed to evaluate establishing a stormwater utility for the unincorporated County based on geographic units as directed by the County. This includes development of alternative level-of-service (LOS) approaches, a costed project list tied to LOS assumptions, a rate methodology, and a draft ordinance framework. This work will be completed at a planning level and is intended to inform County decision-making and legal review, not to establish final adopted rates or produce design-level engineering. 3.1 Feasibility Study and Data Collection: The Consultant will use the system inventory from Task 1 to identify service gaps, evaluate current maintenance programs, and confirm flood "hot spots." The Consultant will identify regulatory and compliance needs relevant to stormwater program funding (including Section 403.0893, Florida Statutes). The Consultant will perform an impervious area analysis using GIS, aerial photography, and Property Appraiser data to support development of billing units and user fee approaches. 3.2 LOS Alternatives, Rate Methodology, and Financial Planning: The Consultant will define a baseline ("existing") stormwater program condition and one to two (1-2) improvement alternatives for County evaluation based on geographic units as directed by the County. For each alternative, The Consultant will identify a planning-level list of priority projects and timelines for routine maintenance and capital improvements. The Consultant will define an Equivalent Residential Unit (ERU) methodology, calculate a preliminary ERU basis, and develop planning-level revenue requirements estimate to support fee calculations and revenue needs evaluation, develop non- residential rate approaches based on impervious area, and outline credit/offset concepts for onsite stormwater controls. The Consultant will identify billing mechanism options, including non-ad valorem assessment approaches. 3.3 Draft Stormwater Utility Ordinance Framework: The Consultant will prepare a draft stormwater utility ordinance framework aligned with the LOS and rate methodology, including one (1) consolidated round of County staff comments and a second draft. The ordinance framework will include utility purpose, definitions, rate and billing framework concepts, and implementation considerations, including careful delineation of stormwater program use-of- funds relative to tidal/compound flooding considerations based on geographic units as directed by the County. Deliverables will include the following: • Impervious area analysis summary sufficient to support ERU basis development It is anticipated that an internal County discussion with the consultant team will occur prior to the initiation of this Task to confirm direction of the assessment program. • Baseline ("existing") service characterization and one to two (1-2) LOS alternative definitions • Planning-level project list tied to LOS alternatives, including planning-level cost opinions and assumptions • Draft rate methodology (ERU definition, preliminary ERU value, and planning-level fee calculations) • Draft credit/offset framework concepts for onsite stormwater controls (utility fee credits) • Draft stormwater utility ordinance framework (initial draft) and a second draft incorporating one (1) consolidated set of County comments • Draft and final utility feasibility memorandum/report summarizing LOS options, costs, and rate implications Scope Intent and Exclusions This scope is intended to meet the grant criteria, update existing County stormwater policy documents, and provide utility decision support. The following items are explicitly not included unless added by amendment: • Full update, re-write, or re-formatting of the entire 2001 Stormwater Management Master Plan document and all appendices. • Re-design or detailed engineering updates of the specific stormwater retrofit project concepts contained in the 2001 appendices, including updating those concept-level designs and cost tables to current dollars. • Development or implementation of a site-specific stormwater nutrient credit program (the 2001 appendix includes a nutrient credit concept memorandum; this LOI includes only planning-level discussion of credit/offset concepts for a utility, not creation of a regulatory credit trading program). • Design-level hydrologic/hydraulic modeling rebuild, field survey, pond bathymetry, geotechnical investigations, or permitting and final design services. • Expanded public outreach beyond the capped meetings identified in this scope. • Preparation of a CRS/ISO credit submittal package. Article VII, Paragraph 7.1.1 is amended to include the following: The Consultant shall be paid Four Hundred Thousand and Zero cents ($400,000.00) on a lump sum basis for the services described above.
