Approval of a Resolution setting forth exemptions related to previous votes for Canal Restoration
Projects to exempt Canals 105, 255, 293, 295, 297, 299, 315, and 474 from the requirements under the
proposed Municipal Service Benefit Unit Residential Neighborhood Improvement Program Ordinance.
ITEM BACKGROUND: The Board of County Commissioners is in the process of adopting a
Residential Neighborhood Improvements Ordinance (Proposed Ordinance). The Proposed Ordinance
will allow neighborhood groups to initiate and fund improvement projects, as approved by a majority
(50%plus 1) of property owners in their respective neighborhoods, through Municipal Service Benefit
Unit (MSBU) Special Assessments. The Special Assessments will fund projects that are beyond the
core services provided by the County. Certain exemptions to the new Ordinance are being authorized
for Canal Restoration Projects where the voting process has already taken place and which employed a
procedure that differs from the voting process specified in the MSBU Ordinance. The design and
permitting of those canal restoration projects are already underway.

RESOLUTION NO. -2026
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY,
FLORIDA, SETTING FORTH EXEMPTIONS
RELATED TO PREVIOUS VOTES FOR CANAL
RESTORATION PROJECTS TO THE
REQUIREMENTS UNDER THE MUNICIPAL
SERVICE BENEFIT UNIT RESIDENTIAL
NEIGHBORHOOD IMPROVEMENT PROGRAM
WHEREAS, the County/Board of County Commissioners is in the process of
adopting a Residential Neighborhood Improvements Ordinance (Proposed Ordinance)
that will allow neighborhood groups to initiate and fund improvement projects, as
approved by a majority (50% plus 1) of property owners in their respective
neighborhoods, through Municipal Service Benefit Unit (MSBU) Special Assessments
for projects that are beyond the core services provided by the County; and
WHEREAS, certain exemptions to the new Ordinance are being authorized for
canal restoration projects where the voting process has already taken place and
employing a procedure that differs from the process specified in the MSBU Ordinance;
and
WHEREAS, it is necessary to specify and document those canal restoration
projects where voting has already occurred and restoration plans are currently in process
based on the votes previously received and recorded.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Monroe County, Florida, that the following canal restoration projects
are exempt from the new voting requirements under the proposed MSBU Residential
Neighborhood Improvement Program:
1. The foregoing recitals are true and correct and are
incorporated by reference herein.
2. The following canal restoration projects have previously received a majority of
"yes" votes from benefitted property owners, based on the number of responses
received, for an assessment to fund the operations and maintenance of an air
curtain for the canal restoration project and are therefore exempt from the
proposed MSBU Neighborhood Improvement Ordinance:
a) Canal #105 (Tavernier)
b) Canal #255 (Big Pine Key)
c) Canal #293 (Big Pine Key)
d) Canal #295 (Big Pine Key)

3. Real Property Owners whose real property is subject to special assessments
imposed under the canal restoration program may participate in the proposed
Financial Hardship Deferral Program if they meet the low-income threshold
financial and asset requirements, as specified in the Financial Deferral Program.

County, Florida at a regular meeting of said board on the 15th day of July 2026.
