ITEM BACKGROUND: This property is vacant land, located at Parcel ID 00312010-000000 on Minorca Drive in Big Pine Key. The BOCC approved litigation to enforce the County's code and an outstanding lien stemming from Code Compliance Case CE21020146 on February 15, 2023. Monroe County filed suit against the former property owner on June 20, 2023. Following a default judgment, an Amended Final Judgment of Foreclosure was entered on January 23, 2025. On May 14, 2025, Monroe County purchased the property at auction for $100. Certificate of Title granting ownership to Monroe County was recorded on June 23, 2025. Taxes are due and owing to redeem tax certificates for 2022, 2023 and 2024, in the amounts of $545.15, $623.57, and $603.37 respectively. There are also additional outstanding taxes for 2025 in the amount of$551.55. Together the taxes due on the property total $2,323.64. The funds are to be paid out of Fund 316. The property was added to the inventory of Monroe County Conservation Lands on September 10, 2025, by Resolution 307-2025. PREVIOUS RELEVANT BOCC ACTION: Approval for litigation 2/15/23. Current Version:TS 2026 June.Minor.006 Manage Page Permissions RESOLUTION No. 307-2025 A RESOLUTION of THE BOARD of COUNTY COMMISSIONERS of MONROE COUNTY, FLORIDA, RATIFYING THE ADDITION of CERTAIN PROPERTIES To THE INVENTORY of PROPERTIES OWNED BY THE BOARD OF COUNTY COMMISSIONERS To BE DESIGNATED AND MANAGED AS MONROE COUNTY CONSERVATION LANDS IN ACCORDANCE WITH MONROE COUNTY ORIDINANCE No. 005-2023 AS CODIFIED AT SECTION 2-424-427.5 of THE MONROE COUNTY CODE of ORDINANCES. WHEREAS, on May 17, 2023, the Board of County Commissioners (BOCC) adopted Ordinance No. 008-2023, otherwise referred to as the "Land Stewardship ordinance"; and WHERES, ordinance No. 008-2023 has been codified at Sections 2-424 et seq. of the Monroe County Code of ordinances; and WHEREAS, the Land Stewardship ordinance established a definition of"Monroe County Conservation Lands" and a process to add County-owned properties to the inventory of Monroe County Conservation Lands; and WHEREAS, in accordance with the Land Stewardship ordinance, Monroe County Conservation Lands include properties owned by the BOCC that have been acquired through the Rate of Growth ordinance (ROGO) land dedication process for conservation purposes, properties owned by the BOCC that have been dedicated for conservation through the Transferable Development Rights procedure, properties acquired using grant funding where the terms of the grant require long-term conservation of the property, and other properties owned by the BOCC that have been designated as conservation; and WHEREAS, in accordance with Resolution 149-2022, the Monroe County Environmental Land Management and Restoration Fund (Fund 1601 the Fund) is the funding source for the management of Monroe County Conservation Lands and may only be used for the management of said lands; and WHEREAS, in order for the Land Stewardship Program to manage appropriate properties as Conservation Lands utilizing funding from Fund 160, the properties must be designated as "Monroe County Conservation Lands"; and WHEREAS, the Land Stewardship ordinance states that the BOCC shall ratify, by resolution, an inventory of Monroe County Conservation Lands; and WHEREAS, the BOCC ratified the initial list of Monroe County Conservation Lands at their July 19, 2023 meeting through Resolution 251-2023; WHEREAS,the Land Steward has proposed the addition of certain property to the inventory of Monroe County Conservation Lands, included as Attachment A; and WHEREAS, the property listed in Attachment A meets the definition of the term "Monroe County Conservation Lands" as set forth in Section 2-426 (1) of the Monroe County Code. NOW, THEREFORE, 'BE IT RESOLVED BY'. To the extent that any person or entity has taken the Subject Property after the filing of Plaintiff's Lis Pendens in this matter, such parties' interests, if any, are also foreclosed by this Final Judgment of Foreclosure. 5. The Final Order sued upon by Plaintiff in this case, issued by the Special Magistrate in Monroe County Code Enforcement case CE21020146, and attached to the Complaint filed in this matter as Exhibit F, was recorded in the Official Records for Monroe County, and constitutes a lien against the land on which the violation existed and upon any other real or personal property owned by the violator, per F.S. 162.09. 6. Defendant has failed to take any action in this case and has failed to deny any of the allegations set forth by the Plaintiff in the Complaint or raise any written defenses to the allegations. On March 28, 2024, a Clerk's Default was entered against Defendant John B. Baillie. 7. The lien, which has not been satisfied by Defendant, constitutes a valid lien on real property owned by Defendant, located in Monroe County, Florida, described as: Page 2 of 6 Lot 14, in Block 6, of DOCTOR'S ARM SUBDIVISION, FIRST ADDITION, according the the [sic] plat thereof as recorded in Plat Book 4, Page 149, of the Public Records of Monroe County, Florida. There is due and owing to Plaintiff from Defendant the following sums: Code enforcement fines through 01/03/2025: $113,000.00 Costs $2,283.51 TOTAL: $115,283,51 9. Interest. The grand total amount referenced in Paragraph 6 shall bear interest from this date forward against the Defendant at the prevailing legal rate of interest which is currently 9.46% per annum or . 000258470% per day from the date of the judgment until paid. 10.Lien on Property. Plaintiff, Monroe County, Florida, holds a lien for the total sum specified in Paragraph 8 herein. The lien of the Plaintiff is superior in dignity to any right, title, interest or claim of the Defendant and all persons, corporations, or other entities claiming by, through, or under the Defendant, or any of them, and the property will be sold free and clear of all claims of the Defendant, with the exception of any assessment that is superior pursuant to Florida Statutes, Section 718.116. The Plaintiff's lien encumbers the subject property located in Monroe County, Florida and described in Paragraph 7 above. Page 3of6 11.Sale of Property. If the grand total due (described in Paragraph 8) with interest (at the rate described in Paragraph 9) and all costs accrued subsequent to the judgment are not paid, the Clerk of this Court shall sell the property at public sale on Tuesday, March 11, 2025 to the highest bidder for cash, except as prescribed in Paragraph 12, at the courthouse located at 530 Whitehead Street in Monroe County, Florida, in accordance with section 45.031, Florida Statutes, at 530 Whitehead Street, Key West, Florida 33040, beginning at 11:00 a.m. on the prescribed date. 12.Costs. Plaintiff shall advance all subsequent costs of this action and shall be reimbursed for them by the Clerk if Plaintiff is not the purchaser of the property for sale, provided, however, that the purchaser of the property for sale shall be responsible for the documentary stamps payable on the certificate of title. If Plaintiff is the purchaser, the clerk shall credit Plaintiff's bid with the total sum with interest and costs accruing subsequent to this judgment, or such part of it as is necessary to pay the bid in full. 13.Distribution of Proceeds. On filing the certificate of title, the Clerk shall distribute the proceeds of the sale, so far as they are sufficient by paying: first, all of Plaintiff's costs; second, documentary stamps affixed to the certificate; third, the total sum due to Plaintiff, less the items paid, plus interest at the rate prescribed in Paragraph 9 from this date to the date of the sale; and by retaining any remaining amount pending further order of this Court. On filing the certificate of sale, Defendant, and all persons claiming under or against Defendant since the filing of the Notice of Lis Pendens in this case shall be foreclosed of all estate or claim in the subject property, and Defendant's right of redemption as prescribed by Section 45.0315, Florida Statutes, shall be terminated, except as to claims or rights under Chapter 718 or Chapter 720, Florida Statutes, if any. Upon the filing of a certificate of title, the person named on the certificate of title shall be let into possession of the property, subject to the rights of a tenant occupying residential premises pursuant to Section 83.561, Florida Statutes. 15.Jurisdiction Retained. Jurisdiction of this action is retained to enter further orders that are proper, including, but not limited to, a deficiency judgment and writ of possession. 16.NOTICE PURSUANT TO AMENDMENT TO SECTION 45.031, FLA.
