ITEM BACKGROUND: Monroe County is currently divided into three jury districts, per 16th Circuit Local Rule Number 4. The Lower Keys Jury District consists of voting precinct numbers 1 through 17, which extends from the City of Key West to the west end of the Spanish Harbor Bridge at MM 33. The Middle Keys Jury District consists of precincts 18 through 24, which begins at the west end of the Spanish Harbor Bridge (MM 33 and extending to Snake Creek, at approximately MM 85 V2 in Islamorada. The Upper Keys Jury District consists of precincts 25 to 33, beginning at the west end of Plantation Key and extends up to Ocean Reef as well as mainland Monroe. Florida law requires that each jury district shall have at least 6,000 registered voters. F.S. 40.015(2). That same statute requires the BOCC and the Chief Judge of the Circuit to approve revisions to jury district boundaries. The Court Administrator and the County Attorney have coordinated the presentation of this proposal to the BOCC and the Chief Judge. Juror pools are compiled from residents possessing valid Florida driver's licenses and identification cards, per. F.S. 40.01 and 40.011. Because prospective jurors are summons based upon their zip code and residency within the established jury districts, periodic review and adjustment of district boundaries helps to ensure more reasonable travel requirements and improved public accessibility to a courthouse for jury service. While all three current jury districts meet the statutory minimum threshold of 6,000 registered voters, it is recommended that the current district boundaries be updated to better align jury service locations with county residents' geographic proximity to the three courthouses. Specifically, the proposal would move residents of precinct 16 and 17, which include Big Pine and No Name Key, from the Lower Keys Jury District to the Middle Keys Jury District, and move residents of precincts 24, which includes Craig Key, Lower Matecumbe Key, Upper Matecumbe Key, and Windley Key from the Middle Keys Jury District to the Upper Keys Jury District. Under the current district boundaries, residents living as far north as MM87 must travel more than 36 miles south to fulfill their jury service obligations in Marathon, despite some residents living less than one mile south of the Plantation Key Courthouse. Under the proposed revisions, residents from Craig Key (MM 72) northward will report to jury duty at the Plantation Key Courthouse. For Craig Key residents, their drive will now be approximately 16 miles north to the Plantation Key Courthouse instead of approximately 21 miles south to the Marathon Courthouse. Similarly, residents in Big Pine will have to drive roughly 19 miles north to the Marathon Courthouse instead of 30 miles south to the Freeman Justice Center in Key West. To provide opportunities for public input throughout all three geographic areas of the County, staff has presented this proposal at the May 20, 2026 meeting in Key West and the June 10, 2026 meeting in Key Largo, prior to scheduling this public hearing for the July 15, 2026, meeting in Marathon. If approved by the BOCC, the Chief Judge will enter a new administrative order and rescind the current Local Rule with the Florida Supreme Court. Staff seeks approval of this Resolution. The Board incorporates the above-stated whereas clauses as legislative findings of the Board and are hereby incorporated as if fully set forth herein. SECTION 2. The Board supports three (3) separate jury districts in Monroe County, one for each courthouse location, from which jury lists shall be selected in the manner provided by law: a.® Lower Keys Jury District: prospective jurors from the venire residing in zip codes summonede Freeman Justice Center. b.b. Middle Keys Jury District: prospective jurors from the venire residing zip codes Courthouse. C. Upper Keys Jury District: prospective jurors from the venire residing in zip codes 7, 33070, e summoned to the Plantation Keyse. SECTION 3. All jury trials, including capital cases, will utilize venires drawn from the jury district where the case is to be tried unless modified by a specific order of the Chief Judge. SECTION 4. The manner of selection shall be controlled by Chapter 40, Florida Statutes and Administrative Order 2.089, In re: Jury Selection Plan, entered by the Chief Judge on June 16, 2026. SECTION 5. Amended Local Rule 4, In re: Special Jury Districts for Monroe County, entered by the Monroe County Chief Judge on May 20,2002,and approved by the Florida Supreme Court on February 2, 2003, shall be rescinded on December 31, 2026, and replaced with Administrative Order 2.090,In re: Jury Districts for Monroe County, effective January 1, 2027. SECTION 6. For trials commencing on or after January 1, 2027, the Monroe County Clerk of Court shall summon prospective jurors in accordance with the provisions set forth in Administrative Order 2.090. SECTION 7. Administrative Order No. 2.090 shall not apply to circuit grand jurors or statewide grand jurors selected pursuant to F.S. 905.101 and 905.137, respectively. SECTION 8. This Resolution supersedes and rescinds all prior actions of the Board as to any prior approvals or authorizations established by the Board as to jury districts in Monroe County. SECTION 9. This Resolution shall take effect upon adoption. The approved system for automated selection of jury venires is the Jurymark jury management system. 2. The sources from which names of potential jurors shall be taken are. a. A quarterly updated list of Florida Department of Highway Safety and Motor Vehicle (DHSMV) licensed drivers and identification cardholders, 18 years of age or older, who are citizens of the United States, and legal residents of Florida residing in Monroe County. b. Persons who have filed affidavits pursuant to section 40.011, Florida Statutes. 3. The scope of this document includes the algorithms and methods used to: Create and maintain a master candidate table. Select a set of names from the master candidate table to create a jury pool. Also included in the scope is a description of the equipment, operating system and programming software, methods, and modes of operation to be used in the jury selection process. Sufficient detail will be provided to satisfy the statutory condition of selection "by lot and at random" and of due process as required by chapter 40,Florida Statutes, a. JuryMark runs within a High Availability VMWare ESX Virtual Server Clustered Environment. The operating system is Windows Server 2016 Standard Edition and utilizes a SQL database running Microsoft SQL 2016 CU15 + Security Update. The server is located within the Monroe County Clerk of the Circuit Court"s on-site Data Center(Data Center), a secured facility under the control of the Monroe County Clerk of the Circuit Court's IT Department. The primary JuryMark web/application server will be located within the Data Center. This server is also running with the High Availability VMWare ESX Virtual Server Clustered Environment, running Windows Server 2016 Standard Edition. c. The main JuryMark database and web/application servers are replicated to a secondary VMWare ESX virtual environment at a colocation data center in Miami, FL. The replicated server operating system is Windows Server 2016 Standard Edition and utilizes a SQL database running Microsoft SQL 2016 CU 15 + Security Update. In the event of a system failure, the JuryMark client software can be reconfigured to point to the replicated web/application server. d. In the event of a network failure, users in the Monroe County Clerk of the Circuit Court and Courthouse are on the local LAN and will have direct access to the on-site servers. In the event of a local LAN failure, users will utilize either an encrypted IPSec VPN tunnel or VPN client connection to access the JuryMark application on the replicated servers residing at the colocation in Miami. e. The JuryMark database will be backed daily using Veeam Backup & Replication software. Monthly, the DHSMV sends an electronic file of licensed drivers and identification cardholders to the Florida Association of Court Clerks (FCCC). Additionally, we receive a deceased list twice a month from DHSMV, The FCCC places all the files on our server to be imported. b. JuryMark application is used to load the new FCCC file and merge and match the data with existing juror records stored in the JuryMark database. The JuryMark database includes juror personal data, service history and excusal status. Jurors that are temporarily or permanently excused are flagged as ineligible, but not deleted from the database. cm The records from the FCCC file are compared to the existing juror records in the JuryMark database using driver's license numbers. where a match is found,the addresses are 4 compared and, if different, the DHSMV address replaces the JuryMark address. Records that exist in the FCCC file but not the JuryMark database, are added to the JuryMark database. Records that exist in the JuryMark database but not the FCCC file, are flagged as inactive in the JuryMark database unless they were created as a result of the filing of an affidavit pursuant to F.S. 40.011. Records that are flagged as inactive remain in the JuryMark database indefinitely but are bypassed by the system during the jury pool selection process. d. JuryMark contains a status field in the juror table that determines whether the juror is qualified for service. The Clerk can use the JuryMark application to change the status of a given juror as needed. The regular loading of jurors into the database does not alter this column so the exclusion status is preserved. e. Maintenance is conducted monthly, to update the JuryMark juror records in accordance with F.S. 40.022 (e.g., identifying convicted felons, deceased persons and legally incapacitated persons, and processing them according to statute). New maintenance procedures will be developed and employed to comply with other relevant statutes when implemented, assuming that data and/or processes from external agencies are available. f. The selection of candidates for weekly petit jury pools is done three (3)weeks in advance of the reporting date. For Grand Jury, the selection of candidates is done twice a year, three weeks in advance of the reporting date. b. Using JuryMark, the Jury Pool Manager/Grand Jury Clerk or their respective designees, enter the jury pool location and the number of jurors required (minimum of 250 per F.S. 40.02)for the serve date specified. No other information is supplied by the user.JuryMark will select and summons the number of jurors requested and data associated with the selection of a juror pool (e.g., date, number of jurors requested) is stored for future retrieval andreporting. c. Prior to invoking the process for randomly selecting jurors, JuryMark determines the number of jurors previously postponed, deferred or re-summoned to the serve date specified and subtracts this number from the total number requested. The result is the number of jurors that JuryMark must randomly select from the juror database. Microsoft's System Security Cryptography RNG Crypto Service Provider is the most cryptographically strong random number genera t or available on the Windows platform. In Microsoft's CSPs'the CryprGenRondom function uses the same random number generator used by other security components.This allows numerous processes to contribute to a system-wide seed. CryptoAPI stores an intermediate random seed with every user.To form the seed for the random number generator, a calling application supplies bits it might have-for instance, mouse or keyboard ' timing input-that are then combined with both the stored seed and various system data and user data such as the process ID and thread ID,the system clock,the system time,the system counter., memory status,free disk clusters,the hashed user environment block.
