A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA. DECLARING THAT MOTION PICTURE AND
TELEVISION PRODUCTION ARE NOT DEVELOPMENT; ESTABLISHING
VARIOUS POLICIES CONCERNING THE PRODUCTION OF MOTION
PICTURES AND TELEVISION SHOWS.

Section 1.
Motion picture and television production not development.~'
As long as the production site is restored to its original condition or better, the production
of motion pictures and television shows, and the construction of temporary facilities incidental to
that production, including, but not limited to, sets, stages and tents, are declared not to be
development under the Monroe County Land Development Regulations, any of the various
County building codes or the Monroe County Comprehensive Land Use Plan. Therefore, no
permits, variances, conditional use approvals, or other permit or permission are required from the
County's Division of Growth Management for motion picture and television production in the
unincorporated area of the County.
Section 2.
Policies Adopted.
The following policies covering the production of motion pictures and television shows are
hereby adopted:
aJ For use of any County buildings, parks, beaches, roads or bridges, the II Request for
Use of County Property" form must be obtained, completed and returned to the Facilities
Maintenance Director for approval. The Facilities Maintenance Director may impose reasonable
conditions on the use of the County buildings, parks and beaches to prevent significant
interference with their intended public purpose or use. In the case of County roads and bridges,

the County Engineer may impose reasonable conditions to prevent significant inconvenience to.
the traveling public.
b) When County property is used for motion picture or television production, then,
depending on the subject and use required by the production company, the County
Administrator may require the production company to post a bond in an amount sufficient to
cover the clean-up costs and the repair of any damage to County property in order to protect
the County from incurring any expense in case the production company fails to clean-up or to
repair any damage. The bond must also be in a form satisfactory to the County Attorney.
c) If the motion picture or television show production requires the presence of Sheriff's
officers, Public Works employees, Emergency Medical Services personnel or firefighters, or any of
their equipment, then the production company will be responsible for paying the salaries and
related expenses of the required personnel, and the equipment rental costs involved, if any.

at a regular meeting of the Board held on the 19t1tlayof September ,1996.
