03/08/1990 Regular RR 1 1 5 **CONTINUATION OF REGULAR MEETING OF MARCH 7, 1990 Board of County Commissioners Thursday, March 8, 1990 Key Colony Beach A CONTINUATION of the March 7th Regular Meeting of the Monroe County Board of County Commissioners convened at l:30 p.m. on the above date in the City Hall at Key Colony Beach. Present and answering to roll call were Commissioner wilhelmina Harvey, Commissioner Douglas Jones, Commissioner Eugene Lytton, Commissioner Michael Puto, and Mayor John Stormont. Also present were Danny L. Kolhage, Clerk; Randy Ludacer, County Attorney; Tom Brown, County Administrator; County Staff; members of the Press and Radio; and the general public. BOARD OF APPEALS The Board of County Commissioners sat as the Board of Appeals to consider the appeal by The State of Florida, Monroe County, Florida Keys Community Environment, Inc., and Marathon Community Theatre, Inc. of the Planning Commission's decision to deny a height variance for a pro- posed Regional Service Center on property located on part of Government Lot 1, Section 9, Township 66S, Range 32E on Key Vaca. Mayor Stormont, County Attorney Randy Ludacer, and the Board discussed the procedure to be used in the conduct of the appeal hearing. Motion was made by Commissioner Harvey and seconded by Commissioner Lytton to authorize one half hour for each of the appellants for the presentation of their appeal. Motion carried unanimously. Steve Matthews, attorney for the State Department of General Services, addressed the Board concerning the appeal on behalf of the State of Florida. County Administrator Tom Brown, representing Monroe County, addressed the Board and discussed the County's position in the appeal. Mr. Brown read from the application for variance and discussed the action of the Planning Commission. Ken Carter of Marathon Community Theatre, Inc. addressed the Board concerning the appeal. Jim Lewis of Florida Keys Community Environment, Inc. also addressed the Board concerning the appeal. After discussion by the Board, motion was made by Commissioner Harvey and seconded by Commissioner Puto to overturn the decision of the Planning Commission and to grant the variance. Roll call vote was taken with the following results: Commissioner Harvey Commissioner Jones Commisisoner Lytton Commissioner Puto Mayor Stormont Yes No Yes Yes No Motion carried.
