A Special Meeting of the Board of County
Commissioners convened at 11:05 a.m. on the above date at
the Stock Island Chapel, Public Service Building, Key West.
Present and answering to roll call were Commissioner
Wilhelmina Harvey, Commissioner Douglas Jones, Commissioner
Eugene Lytton, Commissioner Michael Puto, and Mayor John
Stormont. Also present were Danny L. Kolhage, Clerk: Randy
Ludacer, County Attorney: Tom Brown, County Administrator:
County Staff: members of the Press and Radio: and the
general public.
All stood for the Invocation and Pledge of
Allegiance.
Mayor Stormont discussed the call for the meeting.
Commissioner Lytton discussed the proposed legislation which
would allow the State to impose a six percent surcharge on
all County trust funds. Motion was made by Commissioner
Lytton and seconded by Commissioner Jones to add con-
sideration of this item as Item B-3 to the agenda. Roll
call vote was unanimous.
County Attorney Randy Ludacer discussed the pro-
posed H.R. Bill 3719, "Florida Keys National Marine
Sanctuary Act of 199011. The Board individually discussed
their positions on the Bill. Motion was made by
Commissioner Jones and seconded by Commissioner Harvey to
allow public input, not to exceed two minutes per person.
Motion carried unanimously. The following individuals
addressed the Board concerning House Bill 3719: Nick Riggio,
Pat Yananton, Bob Allison, Adam Kaminskas, Richard
MacKinnon, Shirley Mart Benson, Jim McLernan, Henry Feddern,
Vern Pokorksi, Deevon Quirolo of Reef Relief, Ed Crusoe,
George Halloran, Simon Stafford, Bill Moore, John D.
Sahagian, H. T. pontin, Dan Vaherga, Cathy Clarke, Peter
Bacle, and David Paul Horan. Motion was made by
Commissioner Jones to reject any Bill creating a Sanctuary
within the limits of State waters. During discussion,
motion was withdrawn. Commissioner Lytton discussed his
proposed Resolution concerning the Sanctuary Bill. He
advised for the record that his definition of "Maritime
Industries" included commercial fishing, sports fishing,
recreational fishing, tropical fish harvesting, snorkeling
activities, dive boats, salvage operations, nurseries, mari-
culture and freedom of transit governed by Admiralty Law and
the Constitution. Motion was made by Commissioner Lytton
and seconded by Commissioner Puto to adopt the following
Resolution, declaring that the Board of County Commissioners
of Monroe County, Florida, reluctantly cannot support the
proposed Marine Sanctuary Act unless the Board receives
assurance that existing Maritime Industries will not be
banished or displaced for such a period of time to result in
their economic destruction and to add as Section l-(c), "the
preservation and security of any and all ports, port facili-
ties, areas and auxilIary anchorages". During discussion,
motion was made by Commissioner Harvey and seconded by
Commissioner Lytton to amend to add as Section lCd) the
request that the Statute be called a "Buffer Zone Act" and

that the word "sanctuary" not be used. The amendment was
adopted unanimously. Roll call on the Resolution as amended
was taken with the following results:

Motion was made by Commissioner Harvey and seconded
by Commissioner Lytton to authorize Commissioner Jones to
travel to Washington to present the Board's position con-
cerning the Sanctuary Bill in accordance with its actions on
this date, and that he read the Resolution adopted by the
Board concerning this matter into the Congressional Record.

As a Point of Personal Privilege, Commissioner
Harvey advised that the Florida Federation of Women's Clubs
had selected her as the Number One Woman in Government in
the State of Florida.
Commissioner Lytton discussed the proposal by the
Governor to impose service charges on various County trust
funds. He indicated that this would result in the loss of
revenues to a county in excess of $1,000,000.00. Motion was
made by Commissioner Lytton and seconded by Mayor Stormont
to adopt the following Resolution urging all involved par-
ties to abandon House Bill 2917 and Senate Bill 582 and to
abandon the concept of raiding the funds of the counties for
the purpose of financing other state projects for which the
State had adequate authority to levy taxes: and to direct
the County Attorney to immediately fax this Resolution to
Representative Saunders, Senator Plummer, the Speaker of the
House, the President of the Senate, the Governor and the
Cabinet. Motion carried unanimously.
