08/08/1990 Special SS' 0167 Public Hearing/Special Meeting Board of County Commissioners Wednesday, August 8, 1990 Big Pine Key A Special Meeting/Public Hearing of the Monroe County Board of County Commissioners convened at 5:05 p.m. on the above date at the Parish Hall of St. Peter's Church on Big Pine Key. Present and answering to roll call were Commissioner Wilhelmina Harvey, Commissioner Douglas Jones, Commissioner Eugene Lytton, and Commissioner Michael Puto. Mayor John Stormont arrived at approximately 5:15 p.m. and assumed the Chair. Also present were Rosalie Connolly, Deputy Clerk; Randy Ludacer, County Attorney; Tom Brown, County Administrator; Robert Baggs, Project Manager, and members of the Comprehensive Plan Team; County Staff; mem- bers of the Press and Radio; and the general public. Robert Baggs, Comprehensive Plan Team Manager, addressed the Board concerning the purpose of the hearing. Mayor Stormont discussed the procedures to be followed to meet the requirements of the law and introduced the proof of publication of the hearing into the record. Randy Ludacer, County Attorney, addressed the meeting concerning procequres and the provisions of the law regarding those who wished to produce a record for possible appeal. Motion was made by Commissioner Lytton and seconded by Commissioner Jones to allow three minutes for each speaker. During discussion, Commissioner Lytton amended his motion in order to allow five minutes for each speaker. The amendment was accepted by the seconder. Motion as amended carried unanimously. Commissioner Lytton read into the record Section 163.3167(2)(b) of the Florida Statutes. Motion was made by Commissioner Lytton and seconded by Commissioner Jones to petition, by FAX, the Governor and Cabinet for a minimum six-month extension for transmission of the Monroe County Comprehensive Land Use Plan based upon the fact that the submission may be properly delayed because the County is still designated an Area of Critical State Concern under Section 163.3167(2)(b). Motion was then made by Commissioner Harvey to amend to set out that this extension be granted without sanctions. The amendment was accepted by the maker and seconder. The motion as amended was carried unanimously. The Deputy Clerk was directed to provide the County Attorney with a copy of this motion first thing Thursday morning and the County Attorney was then directed to FAX this motion to the Governor and Cabinet and DCA and to then back up the FAX with a confirming Registered Letter, Return Receipt Requested. Mayor Stormont read an August 8, 1990 memo from Assistant County Attorney Rob Wolfe advising that language similar to the following ought to be placed on the maps: "The future land use maps shall not be construed to render any existing use or structure non-conforming and 55 I 0168 shall not control new development, until such time as land development regulations, including zoning maps, are adopted which implement future land use maps." The following individuals addressed the Board: Ramon Rodriguez, Miriam Bernstein, Garland Smith, Eugene Dwyer, John Scharch, Robert Skerrit, Pat Saunders, Findlay Sinclair, Vern Pokorski. Motion was made by Commissioner Puto and seconded by Commissioner Jones to add to the Agenda the question of resolution of impact fees and certificate of occupancy for the Middle Keys Guidance Clinic. Motion carried unani- mously. David Paul Horan, attorney, addressed the Board. After discussion, motion was made by Commissioner Puto and seconded by Commissioner Jones that the County Commission will accept as impact fees on the project services to the value of $19,000.00 to be rendered in-kind by the applicant. Motion carried unanimously. Motion was then made by Commissioner Puto and seconded by Commissioner Jones to adopt the following Resolution to refund this $19,000.00 to the Middle Keys Guidance Clinic. Motion carried unani- mously. RESOLUTION NO. 377-1990 See Res. Book No. 92 which is incorporated herein by reference. Motion was made by Commissioner Lytton and seconded by Commissioner Jones to add to the Agenda a discussion regarding the use of a public ombudsman for the current Comprehensive Land Use Plan. During discussion, motion was withdrawn. Motion was then made by Mayor Stormont and seconded by Commissioner Lytton to consider as an add-on to the Agenda, to act on appropriately at Friday's meeting, consideration of someone like an ombudsman to buffer between government and citizens to permit a clearer and simpler clarification of problems. Motion carried unanimously. The following individuals addressed the Board: Shirley Mart Benson, Norine Meng, George Kundtz, R. J. Johnson, Don Meng, Dennis Henize, Al Perkins, Nick Riggio, Al Damron, Joan Tucker, Joyce Newman, Simon Stafford, William Devitt, Rob Devitt, George Eager, Mary Sukup, Debbie Pearl, Bill Moore, Joseph Fisher, Bill Cullen, Donna Merritt, Katha Sheehan Stone, Jerry Barnett, Attorney Dave Horan representing Peter Bacle, Marie Shinkevich, Warren Pappatelli, Terry Jordan, Stan Becker, Jerome Baker, Gary Sievers, Joel Rosenblatt, Dennis Thompson and Terry Thomas. Motion was made by Commissioner Harvey and seconded by Commissioner Lytton to continue this Public Hearing/Special Meeting to Plantation Key at 5:00 p.m. on Thursday, August 9, 1990, at the Plantation Key Government Center in Courtroom A. Motion carried unanimously. There being no further business, the meeting was adjourned. * * * * *
