08/13/1990 Special 55 0 1 8 2 CONTINUATION OF AUGUST 8, 1990 PUBLIC HEARING/SPECIAL MEETING Public Hearing/Special Meeting Board of County Commissioners Monday, August 13, 1990 Key Colony Beach The August 8, 1990 Public Hearing/Special Meeting of the Monroe County Board of County Commissioners continued and reconvened at 9:10 a.m. on August 13, 1990 at the City Hall in Key Colony Beach. Present and answering to roll call were Commissioner Wilhelmina Harvey, Commissioner Douglas Jones, Commissioner Eugene Lytton, Commissioner Michael Puto, and Mayor John Stormont. Also present were Rosalie Connolly, Deputy Clerk; Randy Ludacer, County Attorney; Tom Brown, County Administrator; Robert Baggs, Project Manager, and members of the Comprehensive Plan Team; County Staff; members of the Press and Radio; and the general public. Mayor Stormont opened the meeting by discussing the purpose of the meeting and the provisions of the Florida Statutes under which it was being held. Randy Ludacer, County Attorney, addressed the meeting concerning procedures and the provisions of the law regarding those who wished to produce a record for possible appeal. The Mayor once again advised that the Board would have to assume the written status of the documents presented to them and that no changes would be made in those documents unless officially voted upon by the Board, and Staff was so directed. The Mayor also stated that the official record of these proceedings would be that of the Clerk and the Board recognized that there would be a time delay in provision of the official Minutes. TRAFFIC CIRCULATION ELEMENT Staff made a presentation to the Board. ERRATA SHEET Page I Motion was made by Mayor Stormont and seconded by Commissioner Lytton to accept the recommendation to correct the spelling of the word "policies" in the first paragraph. Motion carried unanimously. Motion was made by Mayor Stormont and seconded by Commissioner Lytton to accept the recommendation to correct the spelling of the word "policies" in the second paragraph. Motion carried unani- mously. Page 6 Motion was made by Mayor Stormont and seconded by Commissioner Lytton to accept the recommendation to revise 55 · 0183 the Jewfish Creek Bridge estimate on Table 2 to $35,538,000. Motion carried unanimously. Page II Motion was made by Mayor Stormont and seconded by Commissioner Puto Lytton to accept the recommendation to add the term "mileage" on Table 5 under the words "Summary of FDOT Functional Classification". Motion carried unani- mously. Page 12 Motion was made by Mayor Stormont and seconded by Commissioner Lytton to accept the recommendation to amend the second paragraph thereof to delete the words "expansion to four lanes" and replace with the words "further expansion". Motion carried unanimously. Page l7 Existing Traffic Circulation Big Pine Key Area Map Motion was made by Mayor Stormont and seconded by Commissioner Lytton to accept the recommendation to show US I on Spanish Harbor Bridge and Spanish Harbor Keys as two lanes, not four lanes. Motion carried unanimously. Policy 1.5.3 Motion was made by Mayor Stormont and seconded by Commissioner Lytton to accept the recommendation to change this Policy so that it now reads: "The land development regulations prepared pursuant to this comprehensive plan shall include regulations to minimize the impacts of signs on the scenic beauty of Monroe County." Motion carried unanimously. Policy 1.6.2 Motion was made by Mayor Stormont and seconded by Commissioner Puto to accept the recommendation to change the Note under the Policy so that it now reads: "Also see policies 1.2.l regarding coordination of LOS analysis on state roads, l.7.l regarding right-of-way protection, and 1.8.l regarding access management." Motion carried unanimously. General Motion was made by Mayor Stormont and seconded by Commissioner Lytton to add page numbers to tables and graphs throughout the comprehensive plan. Motion carried unani- mously. Motion was made by Mayor Stormont and seconded by Commissioner Lytton to add a listing of roads shown on the Future Traffic Circulation Map to the Appendix. Motion carried unanimously. GOALS, OBJECTIVES AND POLICIES Policy l.l.l Motion was made by Commissioner Lytton and seconded by Mayor Stormont to reject the Planning Commission's recommendation 55 0'84 to change LOS standard of "D" to LOS standard of "C". Motion carried unanimously. Objective l.2 Motion was made by Mayor Stormont and seconded by Commissioner Lytton to accept the Planning Commission's recommendation to delete the word "proposed" from the second line. Motion carried unanimously. Policy 1.1.2 Motion was made by Commissioner Puto and seconded by Commissioner Jones to delete "1992" and insert "1993" in place thereof. Motion carried unanimously. Policy 1.2.2 Motion was made by Commissioner Lytton and seconded by Commissioner Puto to replace the current policy with the following policy: "When the cumulative increase in traffic violates the adopted LOS standard by lO%, Monroe County shall postpone approval of the development if no approved funded project exists to alleviate the unacceptable impact." Motion carried unanimously. Policy l.l.l Motion was made by Commissioner Puto and seconded by Commissioner Lytton to change the last phrase thereof to now read "as measured by delay, travel speed and/or traffic volume." During discussion, Commissioner Lytton withdrew his second. Motion died for lack of a second. Policy 1.2.3 Motion was made by Commissioner Lytton and seconded by Commissioner Jones to reject the Planning Commission's recommendation to delete the words "gas taxes and". Motion carried unanimously. Additional Policy 1. 2.5 Motion was made by Commissioner Puto and seconded by Commissioner Jones to deny the Planning Commission's recom- mendation to add the following Policy 1.2.5: "By 1995, Monroe County shall complete a study of potential actions to redirect and redistribute travel demand on US l, including the use of transportation system management (TSM) techniques and alternative modes of transportation." During discussion, motion was withdrawn. Motion was then made by Commissioner Lytton and seconded by Commissioner Puto to accept the Planning Commission's recommendation to add the above Policy 1.2.5 except that the word "complete" in the first line should be deleted and replaced with the word "consider". Motion carried unanimously. Policy 1.3.2 Motion was made by Mayor Stormont and seconded by Commissioner Jones to deny the Planning Commission's recom- mendation to add the words "in each of the three impact fee districts" to the end of the sentence. Motion carried una- nimously. New Policy l.4.2 Motion was made by Mayor Stormont and seconded by Commissioner Puto to insert a new Policy 1.4.2 (same as Planning Commission's recommended l.4.3) to read as follows: "The capacity of US I in unincorporated Monroe County shall be limited to four lanes." Policy 1.8.1 Motion was made by Commissioner Lytton and seconded by Commissioner Jones to reject the Planning Commission's recommendation to delete the words "conform with" and replace them with the word "complement". Motion carried unanimously. Policy l.6.2 Motion was made by Commissioner Jones and seconded by Commissioner Lytton to change the wording of this policy so that it now read as follows: "By 1993, Monroe County shall initiate interlocal agreements with Key West, Key Colony Beach, and Layton for the purpose of coordination of concurrency management." Motion carried unanimously. New Policy 1.4.3 Motion was made by Mayor Stormont and seconded by Commissioner Lytton to insert a new Policy l.4.3 to read as follows: "By 1992, evaluate origin and destination characteristics of transportation users." Also, land purchased by these entities is removed from the ad valorem tax roll, thus causing an increase in assessment on remaining land." The Monroe County Tourist Development Council has determined that 71-73 percent of all Keys visitors go to Key West regardless of where they are lodging in the Keys." These sites will be located adjacent to significant permanent resident populations. These units, having been permitted enclosures for habitation if appropriately above flood elevations, currently are providing rentals to service industry personnel, as well as extra income seasonal rentals for dwelling owners. "Relaxation of regulations to recognize these existing sources of rental housing, and permission in regulations to permit owner-occcupied dwellings to construct such habitation, under incentives and dwelling owner control, should provide a viable source of affordable housing. "Such source would be in conformance with reduction of urban sprawl, infill and mitigation of costs to the public sector." Motion carried unanimously. Fascell, and Senators, the Honorable Bob Graham and Connie Mack, to direct the National Academy of Sciences to create a task force, composed of qualified but disinterested academic scientists, to: (a) examine all data and research regarding the submerged marine resources and water quality in the Florida Keys; (b) develop a detailed scope of research, and appropriate timetable and budget, to carefully and thoroughly document the existing state of these resources and water I 55 0203 quality to provide a baseline of information from which future monitoring can be measured; and to identify what, if any problems exist, and make specific, measurable, policy recommendations for their correction; and (c) serve as the oversight committee for the execution of this research, hiring qualified but disinterested scientists, supervising data collection, and ensuring all scientific and professional standards of quality control are met. "Monroe County will also formally request that the Congress of the United States allocate the necessary funds to the National Academy of Sciences to convene this scientific task force and allow them to develop the scope of work, timetable, and budget. At that point, funding sources will be sought to assure the entire scope of work is completed, under the task force's supervision. Results of the research will then provide an appropriately professional basis for developing policies and guidelines for further water quality management practices, both for local and state government, and for the Florida Keys National Marine Sanctuary."
