Key Colony Beach
The August 8, 1990 Public Hearing/Special Meeting
of the Monroe County Board of County Commissioners continued
and reconvened at 9:00 a.m. on August 14, 1990 at the City
Hall in Key Colony Beach. Present and answering to roll
call were Commissioner Wilhelmina Harvey, Commissioner
Douglas Jones, Commissioner Eugene Lytton, Commissioner
Michael Puto, and Mayor John Stormont. Also present were
Rosalie Connolly, Deputy Clerk; Randy Ludacer, County
Attorney; Tom Brown, County Administrator; Robert Baggs,
Project Manager, and members of the Comprehensive Plan Team;
County Staff; members of the Press and Radio; and the
general public.
Mayor Stormont opened the meeting by discussing the
purpose of the meeting and the provisions of the Florida
Statutes under which it was being held.
Randy Ludacer, County Attorney, addressed the
meeting concerning procedures and the provisions of the law
regarding those who wished to produce a record for possible
appeal.
The Mayor once again advised that the Board would
have to assume the written status of the documents presented
to them and that no changes would be made in those documents
unless officially voted upon by the Board, and Staff was so
directed. The Mayor also stated that the official record of
these proceedings would be that of the Clerk and the Board
recognized that there would be a time delay in provision of
the official Minutes.
FINE ARTS COUNCIL
Motion was made by Commissioner Lytton and seconded
by Commissioner Jones to add to the Agenda an item regarding
the Monroe County Fine Arts Council. Motion carried unani-
mously. Comissioner Lytton advised the Board of an invita-
tion he (as a candidate) had received from the Monroe County
Fine Arts Council to attend an upcoming Candidates Forum
which was being conducted by the Council. He read into the
record Statute 265.32(1). After discussion, motion was made
by Commissioner Lytton and seconded by Commissioner Harvey
that the County Attorney attempt to verify and confirm that
this was sanctioned by the Board of Directors of the Fine
Arts Council and if that is true, that he then take
appropriate measures to notify them officially that such
action is contrary to law and that it will be reviewed at a
future meeting of the Board of County Commissioners. Roll
call vote was unanimous.

LAND USE PLAN
The Board then returned to the Comprehensive Land
Use Plan actions.
The Board was presented with a list of recommended
changes to the proposed Comprehensive Plan by The Audubon
Society. Motion was made by Commissioner Lytton and
seconded by Commissioner Harvey to acknowledge receipt
without action. Motion carried unanimously.
COASTAL MANAGEMENT ELEMENT
GOALS, OBJECTIVES AND POLICIES
Goal 4
Motion was made by Commissioner Lytton and seconded by
Commissioner Jones to reject the Planning Commission's
recommendation to add the following to the end of the sen-
tence: "as long as it does not destroy productive
'nearshore' habitat". Roll call vote was taken with the

Commissioner Jones to reject the Planning Commission's
recommendation to add the following new Policy 2.2.12:
"Monroe County shall not permit any develop-
ment whose existence directly degrades
nearshore waters and living marine resources."

Motion was made by Mayor Stormont and seconded by
Commissioner Lytton to change the last sentence of the top
paragraph so that it now reads as follows:
"Therefore, sloping bank stabilization should
be encouraged over vertical bulkheads for
natural water body shorelines. However,
vertical bulkheads shall be permitted in canal
systems for continuous bulkheading with other
vertical bulkheads and where vertical wall
cuts have occurred."
Motion carried unanimously. Motion was then made by Mayor
Stormont and seconded by Commissioner Puto to add the
following at the end of the second full paragraph:
"The present 'altered' and 'unaltered' shore-
line concepts, particularly without extant
definitions, have contributed to random and
confusing permitting actions, strategies, and
interpretations. This Comprehensive Plan
calls for return to former classifications as
to types of water body frontage (natural or
man-made) interface so as to maintain consist-
ency and continuity in shoreline development
standards. This concept is consistent with
return to former Shoreline Protection Zone
standards in the previous Land Use Plan."

the paragraph beginning with the words "Since Table 6....":
"However, current residential docking designs
and constraints continue to increase conflicts
with previously permitted structures in the
same area so as to eliminate reconciliation
between providing individual residential water
access, through docking faclities, and
environmental constraints such as seagrass
protection. These generally should be resolved
on the side of public safety and near shore
systems protection, rather than guaranteed
access. Therefore, limitations should
be placed in future land development regulations
providing for minimum length necessary only to
reach prescribed water depth unless demonstrable
as being in the overriding public interest, per
Florida Outstanding Waters criteria."

already required by existing State law.

quality problems will not be adequately
answered without comprehensive and
dispassionate scientific review and study is

basis for governmental action."

of marina facilities until appropriate analysis

of new marina siting until full utilization of
existing sites has occurred."

storms."

mendation to delete the words "By 1994" and insert the words
"By one year from adoption" in lieu thereof; and then to
delete the end of the sentence after the words "by the
County". Motion carried unanimously.
Policy 2.7.2
Motion was made by Mayor Stormont and seconded by
Commissioner Jones to accept the Planning Commission's
recommendation to delete the words "on Big Pine, Cudjoe, and
Upper Sugarloaf Keys" and to insert the following words in
lieu thereof:
"within or adjacent to any seasonal or permanent
freshwater lens or lens recharge area documented
pursuant to Policy 1.2.1 of the Groundwater
Element" .

lands. Habitat analyses shall be performed
on individual subdivisions and open space
ratios established for individual lots.
The information shall be mapped on the
Geographical Information System."

permitting officials that HEI be conducted only according to

Randy Ludacer, County Attorney, advised the Board
that his office had received a FAX from DCA which denied the

Board at their Special Meeting next week which would show
changes that have been made by the Board.
Rosalie Connolly, Deputy Clerk, advised the Board
that the Clerk's Office could not have all of the Official
Minutes available at the same time as Mr. Baggs' "Errata

Commissioner Jones requested that Staff bring back

restatement of Goals and Objectives in the 1986 Comprehensive
Plan and those regulations which preceded it, involving shoreline
protection zone. It is realized that some are duplicative of
above stated policies, but clarifications can be made after DCA

and implementation of coastal zone protection and

effort to forestall any potential conflicts
and achieve the most efficient and effective
management of coastal resources.

All agencies shall promote cooperation and
coordination between the various local
governmental units and agencies in Monroe
County involved in the management of coastal
resources and/or regulation of land and water
uses.
Goal 12 - Marine Resources
The great value attributed to Monroe County's marine
resources is due to their crucial role in the local
economy, and in providing a wide range of natural
amenities and services. Health and integrity of the
marine system is a fundamental prerequisite if these
resources are to continue to provide social, economic,
and environmental benefits that we have, at times,
taken for granted. Mangroves, seagrasses, and coral
reefs, all of which are susceptible to pollution and
dredging, are extremely important in providing food and
shelter for the myriad forms of marine life, providing
storm protection, and maintaining water quality. If
uses and activities such as dredge and fill,
destruction of natural shoreline vegetation, use of
pesticides and fertilizers, improper sewage and solid
waste disposal continue indiscriminately and
uncontrolled, the ability of the marine system to
function effectively will deteriorate, thereby
resulting in the loss of many natural services and
socio-economic benefits to society. Therefore', it is
imperative that such uses and activities be carefully
regulated so as to insure conservation and protection
of resources and long-term maintenance of their
productivity.

Recognizing the crucial role that the marine
environment plays in the local economy, the
protection, conservation, and management of marine
resources will be viewed as an issue requiring the
county's utmost attention.
Policy 12.1.1
In pn effort to protect and conserve marine
resources, Monroe County shall place. maximum
emphasis on protecting the entire marine
system.
Policy 12.1.2
To this end, maintenance of water quality,
protection of marine flora and fauna
including shoreline vegetation, and
preservation of coral reefs shall be regarded
by Monroe County as being absolutely
essential to maintaining the integrity of the
marine system.
Objective 12.2
Utilization of marine resources shall be judged
sound or unsound from the standpoint of whether or
not a permitted use insures conservation and
long-term maintenance of the resource. High
priority shall be given to those uses and
activities which insure conservation and optimum
sustainable productivity of marine resources.
Such uses shall include, but are not limited to,
mariculture, educational and scientific use,
commercial fishing, and recreational uses of the
type and in the magnitude which shall not cause
any significant adverse impact on the marine
environment.
Policy 12.2.1
Monroe County shall encourage research and
development programs designed to ensure
optimum sustainable productivity in the
marine resources industry.
Policy 12.2.2
Monroe County shall support, and, wherever
feasible, aid private and non-profit groups,
as well as public agencies in promoting
mariculture which will be compatible with the
Keys' natural environment.
Objective 12.3
Land and water activities which are incompatible
with the preservation of marine resources because
of their potential adverse effects shall be
prohibited, restricted,Qr carefully regulated
depending upon the nature of activity and the
extent of potential impact.
Policy 12.3.1
Monroe County shall support State and Federal,
policies and regulations concerning dredge
and fill activity and, to the extent legally
practicable, shall prohibit dredging from,
and/or filling of submerged lands, for
development except in proven cases of
overriding public interest.
Policy 12.3.2
Dredging and/or filling associated with
maintenance or water-dependent public
projects shall be minimized and carefully
managed to prevent unnecessary adverse
environmental impact.
Policy 12.3.3
Long-range sewage disposal alternatives,
including recycling of wastes, shall be
carefully reviewed and evaluated to insure
protection of quality of coastal water
resources.
Policy 12.3.4
Monroe County shall seek cooperation of, and
encourage South Florida cities and counties
to improve the existing ocean disposal system
and to eliminate ocean outfalls where they
affect coral reef areas.
Objective 12.4
Monroe County shall develop and enforce stringent
development regulations to minimize pollution from
point and non-point sources in an effort to
improve and maintain quality of coastal waters.
Programs designed to investigate and monitor
nearshore water quality shall be encouraged and
supported.

Marine grass beds! mangrove communities, and
associated shoreline vegetation shall be
preserved to the fullest extent possible.

gradual and dispersed runoff shall be

Direct discharge of runoff from paved areas
into nearshore waters shall be restricted.
Storm runoff from developed areas shall be
minimized and, when possible, contained on
site to filter through vegetation and soil.
Objective 12.5
Land and water activity in the vicinity of stress
areas (coral, grass bed, and inshore water
quality) as identified and illustrated in the
Florida Keys Coastal Zone Management Study and as
may be discovered during any future study shall be
carefully controlled and regulated in an effect to
arrest further deterioration. Research and study
directed toward alleviating the stresses and
restoring their condition to natural healthy state
shall be encouraged and supported.
Objective 12.6
Monroe County shall encourage research to
ascertain physiological stresses of the Keys coral
reefs, as a system.
Objective 12.7
Monroe County shall seek cooperation of
appropriate State and Federal agencies in enacting
regulations to control boat and amphibious
traffic, and marine recreation activities,
whenever necessary, to alleviate erosion,
sedimentation, noise and other environmental
problems, and to prevent destruction of submerged
vegetation and coral reefs.
Objective 12.8
Monroe County shall encourage and assist
appropriate regional, State and Federal agencies
in rigorously enforcing the existing laws and
regulations protecting marine resources, and in
preventing and discouraging illegal and
unauthorized interferences with the resource.
Goal 13 - Shoreline Use priorities and Modifications
Those activities of socio-economic significance to the
Keys that can only function through use of waterfront
property or access to it must have first priority for
inclusion in shoreline areas designated for
development. Of second priority are those activities
that can function inland but a shoreline location
significantly enhances the land use on an economic or
aesthetic basis. Any waterfront use, of course, must
still make every effort to minimize environmental
impact. Land uses not requiring a coastal location or
that not economically or aesthetically enhanced to a
significant degree shall be discouraged from waterfront
locations.
Objective 13 - Bulkheads and Bulkhead Lines
Shoreline generally requires some degree of
modification before it can be utilized for
development of any sort. But such modification,
unless carefully planned, can have adverse effects
far beyond the area directly altered for
development. For this reason, all shoreline

modifications are subject to close scrutiny and
regulation by local, state and Federal agencies.
Policy 13.1.1
Bulkhead lines should be set at, or landward
of, the mean high water line or the landward
boundary of the shoreline protection zone,
whichever is applicable.
Policy 13.1.2
Where possible, sloping rip-rap structures
and coastal vegetation shall be used, rather
than vertical seawalls.
Policy 13.1.3
Bulkhead construction shall avoid sharp-angle
turns that may collect trash or cause
shoaling or flushing problems.
Objective 13.2 - Dredging, Filling and Artificial
Waterways
Policy 13.2.1
Residential developments that are feasible
only tnrough the creation of land by dredging
from and filling of submerged areas shall be
prohibited.
Policy 13.2.2
Proposed upland waterway systems shall be
carefully considered by local regulatory
bodies before submission for State review to
determine the long-term effect upland
development will have on water quality.
Policy 13.2.3
The State shall not approve excavations in
submerged lands or wetland areas for the
purposes of obtaining fill material unless it
is for a necessary public purpose, the
ecological impact can be shown to be minimal
and short-term, and there are no other
suitable alternatives.
Policy 13.2.4
Buffer zones of natural vegetation and
adequate setbacks shall be established
between development and any waterways.
Policy 13.2.5
Waterway connections to open water shall be
located in areas where impact on the littoral
zone will be minimized.
Policy 13.2.6
Artificial waterways shall generally not be
excavated to depths greater than six feet,
mean low water, to allow establishment of
vegetation of the canal bottom.
Policy 13.2.7
The berm of artificial waterways shall be
raised so that there is a gradual slope away
from the canal edge. This will help. prevent
introduction of contaminants into adjacent
water bodies.
Policy 13.2~8
Dredging and filling for public shoreline
projects shall be planned for only if the
activity is water dependent and there are no
feasible alternatives.
Policy 13.2.9
Dredging for navigational access shall be
well planned to prevent unnecessary channels.
Central marina facilities shall be used if
possible rether than providing individual
facilities.
Policy 13.2.10
All maintenance dredging and dredging spoil
materials shall be placed on suitable uplands
rather than into water areas.
Policy 13.2.11
Turbidity control mechanisms shall be used to
protect water quality in adjacent areas
during construction.
Policy 13.2.12
Adequate diking shall be constructed to
contain fill material on upland areas and
allow for settling of fine materials.
Objective 13.3 - Docks and Piers
Policy 13.3.1
Docks and piers shall not hinder navigation
or public use of the waters.

Docks and piers shall be constructed and
maintained in a manner that does not degrade
area aesthetics or conflict with adjacent

Objective 13.4 - Marina Facilities
Policy 13.4.1
Marinas shall be located in areas where
maximum physical advantages exist, and little
impact is foreseen on marine resources.

Marina construction shall not involve
destruction of marsh areas, shellfish beds,
and submerged grasses.
Policy 13.4.4
Turning basins and navigation channels shall
be designed to prevent long-term degradation
of water quality. Dead end or deep canals,
or basins, without adequate flushing shall be
avoided.

Marinas that cater to livaboard craft shall
be equipped with sewege collection systems
for servicing the vessels.

regulatory agencies at the earliest possible
time to prevent unnecessary delays in gaining
approval, however State agencies shall be
required to adhere to local regulations if
more restrictive.

Spoil disposal areas shall be designed and
obtained prior to initial development of
marina facilities.
Policy 13.4.9
Evaluation of potential marina sites in the
Keys, as contained in the Florida Keys
Coastal Zone Management Study, shall be given
careful consideration prior to approval or
disapproval of any proposed development of
marina facilities.
Policy 13.4.10
Applicants for development approval of
commercial or residential marinas containing
3 or more slips on state-owned submerged
lands shall additionally meet the
requirements of the FloridaKeys Marina and
Dock Siting policies and Criteria, Chapter
16Q-21,041, Florida Administrative Code.
Policy 13.4.11
For marina and docking facilities not subject
to Rule 16Q21.041, Florida Administrative
Code, the following criteria shall apply:
a) No docking facility shall be approved
which required dredging or filling to
provide access. This restriction shall
also apply to the widening or deepening
'~
of any canal, channel, or basin, but not
to regular maintenance dredging of
canals, basins or channels, provided
such maintenance does not exceed
acceptable water depths.
b) No new or expanded marina or docking
facility shall be located in waters of
less than -4 feet mean low water or
directly over any grass bed, reef or
patch reef except for a main accessway
necessary to reach vessels docked in
waters of at least -4 feet mean low
water in order to allow for a minimum
clearance of one foot between the
deepest draft and the bottom.
c) When applying for docking facilities
or marinas, applicants are required to
use coordinated permit review
procedures, recognizing that local, more
stringent regulations are applicable.
Objective 13.5 - Natural Landforms and
Features Management policies
Policy 13.5.1
Efforts shall be made to ensure that no
representative natural eco-system or a
special natural feature presently
existing in the Keys is extirpated from
the area through unwise land use or
management practices.
Policy 13.5.2
Monroe County shall encourage and
support scientific studies and
investigations of the Keys geological
and hydrological resources.
Policy 13.5.3
Devcelopment in both the public and
private sector shall be required to take
into consideration protective measures
for natural landforms and features
during the planning process so as to
minimize modification of the
hydrological regime and natural
landscape.
Policy 13.5.4'
Mud "banks, shoals and islands in the
surrounding waters of Florida Bay and
Hawk Channel shall be preserved to the
greatest degree possible. Modification
of these environmental units ~hall be
considered only in the case of
over-riding public interest and in
conformance with prevailing State and
Federal regulations, as well as ,local
regulations which may be more stringent.
Policy 13.5.5
Development activities shall be required
to protect tidal flushing and
circulation patterns. Any project which
may produce changes in circulation
patterns shall be approved only after
sufficient hydrographic information is
available to allow an accurate
evaluation of the possible impacts of
the project. Previously existing
manmade alterations shall be evaluated
so as to determine whether more
hydrological benefits will accrue
through their removal as part of the
project.
Policy 13.5.6
Existing spoil islands shall be
protected and maintained to serve as
green areas, bird roosting, nesting, and
feeding areas and/or water oriented
recreation areas not requiring major
expenditure of public funds. Planting
with native vegetation shall be
encouraged whenever possible.
Policy 13.5.7
priorities shall be established for the
use of the shoreline. All proposed
shoreline uses shall be analyzed with
respect to the biophysical character of
the area to be modified and any adverse
socio-economic and environmental impacts
of permissible uses shall be minimized.
Development practices which have the
potential of causing erosion of the

increase in the gas tax revenues of the Road and
Bridge Fund. Card Sound Bridge tolls and MSD

The preliminary assessment indicates that the
Road and Bridge Fund will provide sufficient
revenue to fund County road improvements over the
five-year period. However, without revenue
increases, the Card Sound Bridge Fund will
experience a shortfall in fiscal years 1991 and
1992, due to the $7 million Card Sound Road
project. Likewise, the MSD Fund will experience a
shortfall over the entire five-year period,
barring revenue increases.
To remedy the shortfalls identified in the
Card Sound Bridge Fund, the County will increase
tolls and issue revenue bonds to complete the Card
Sound Road improvements. A preliminary analysis
indicates that an increase in tolls from $1.00 to
$2.00 per vehicle would be sufficient to service
the twenty-year debt from a $7 million bond issue,
while still maintaining sufficient operating
revenues. This analysis assumes 900,000 vehicles
per year, an annual debt service of $720,500, and
an elasticity factor of 0.95. Furthermore, the
Card Sound Road proj ect will be postponed one
year, due to permitting delays. To remedy the
shortfalls identified in the MSD Fund, the
necessary revenue will be obtained through
increased user fees. Table incorporates these
actions into a final fiscal assessment. Note that
both the Card Sound Bridge and MSD Funds show a
balance of zero or greater for each of the five
years.

Timing of Concurrency Review For all development
approvals issued as-of-right, the test for
concurrency shall be met at the time the building
permit is issued. For all other development
approvals, as well as approvals leading to
increases in development potential such as
subdivision and zoning approvals, the test for
concurrency shall be met at the initial approval
stage.
Annual Concurrency Assessment The County shall
prepare an annual assessment of public facilities
capacity addressing road, park, sewer, solid
waste, potable water, and drainage facilities.
The assessment shall identify areas of inadequate
facility capacity, which are those areas served by
facilities that fail to meet the adopted level of
service standard ( s) referenced in Policy 1.4.1.
The assessment shall also identify areas of
marginally adequate facility capacity, which are
those areas served by facilities operating at the
adopted level of service standard(s) or which are
projected to reach inadequate capaCity within the
next twelve (12) months.
Areas of Inadequate Facility Capacity The County
shall not issue development approvals within areas
served by inadequate facilities, as identified in
the annual assessment of public facilities
capacity, except where:
a) the development will not reduce the capacity of
the facility; or
b) the necessary facilities and services are in
place at the time a development permit is
issued; or
c) the development permit is issued subject to the
condition that the necessary facilities and
services will be in place when the impacts of
the development occur; or
d) the necessary facilities are under construction
at the time a permit is issued; or
e) an enforceable development agreement guarantees
that the necessary facilities and services will
be in place when the impacts of the development
occur. An enforceable development agreement
may include, but is not limited to, development
agreements pursuant to section 163.3220, F.S.,
or an agreement or development order issued
pursuant to Chapter 380, F.S.
In areas served by inadequate transportation
facilities, development may be approved, provided
that:
f) the development, in combination with all other
development permitted by the County, will not
increase traffic volumes by more than five (5)
percent above the volumes reported in the most
recent annual assessment of public facilities
capacity; or
g) the necessary facilities are included in the
first three years of the adopted FDOT Five Year
Work Program.
Areas of Marginally Adequate Facility CapaCity
Within areas of marginally adequate facility
capacity, as identified in the annual assessment
of public facilities capacity, the County shall
continue to approve development in accordance with
the Monroe County Comprehensive Plan and Land
Development Regulations. When the estimated
impacts of a proposed development are expected to
violate a level of service standard referenced in
Policy 1.4.1, the County shall either deny the
development approval or condition the approval so
that the adopted level of service standards are
not violated, in accordance with the gUidelines
established for areas of inadequate facility
capaCity."

Monroe County shall continue to require adequate
public or private facilities prior to the issuance
of building permits, in accordance with Section
9.5-291 et seq. of the Monroe county Land

accordance with Section 9.5-292(b)(3) of the
Monroe County Land Development Regulations.
Further, Monroe County shall provide public
facilities in accordance with the Five Year

identified in Table 1, the Five Year Schedule of
Capital Improvements is consistent with the
individual elements of the comprehensive plan.
Figure illustrates the general location of these
capital-improvement projects. In addition to the
activities identified in the Evaluation and
Monitoring Implementation Matrix, the Capital
Improvements Element shall be reviewed on an
annual basis."
