(L~ 'i=? :"'J f""l _L.,; Q.. :1- ,-..r.~ Lt"'I '::) I A RESOLUTION BY THE MONROE COUNTY BOARD OF COMMISSIONERS APPROVING AN EXEMPTION FROM THE NONRESIDENTIAL PERMIT ALLOCATION SYSTEM FOR KEY HAVEN PARK AND RECREATION, INC. FOR PROPERTY DESGRIBED AS LOTS 9 AND 10, KEY HAVEN SUBDIVISION NINTH ADDITION, SECTION 26, TOWNSHIP 67 :SOUTH, RANGE 25 EAST, TALLAHASSEE MERIDIAN, RAC6DON KEY, MONROE COUNTY, FLORIDA, MILE MARKER 6.:-::=; ". Ei . ."'- :3 ~REkS-,~:i the Building, Planning and Environmental ReSour~s Departments have approved a permit application filed b~-Key Haven ~ark and Recreation, Inc. for property described as Lots 9 and 10, Key Haven Subdivision Ninth Addition, Section 26, Township 67 South, Range 25 East, Tallahassee Meridian, Raccoon Key, Monroe County, Florida, Mile Marker 6; and c. WHEREAS, the proposed development construction of a 576 sq. ft. pavillion; and involves the WHEREAS, Policy 101.3.4 of the Year 2010 comprehensive plan, allows the Board of County Commissioners to exempt federally tax-exempt nonprofit organizations from the nonresidential permit allocation system after a finding by the Planning Commission that such activity will not adversely affect the hurricane evacuation objectives of the comprehensive plan; and WHEREAS, Key Haven requested an exemption allocation system; and Park from and the Recreation, Inc. has nonresidential permit WHEREAS, on September 5, 1996, the Planning Commission heard the request of Key Haven Park and Recreation, Inc. for an exemption and recommended approval of the request to the Board of County Commissioners based on the following findings of fact: 1. Based on Article II.B. of the Articles of Incorporation, we find that Key Haven Park and Recreation, Inc. operates as a federally tax exempt non-profit organization; and 2. Based on the staff report, we find that the pavillion will serve the existing residents of Key Haven who have been counted in the original study of hurricane evacuation times; and 3. Based on the staff report, use of the park is limited to members who must be residents of Key Haven, therefore, we '. find that new park patrons are hereby required to either live in a pre-owned home which has already been counted in the hurricane evacuation clearance time study or they must submit an application to build a new home under the permit allocation system, in which case they will be accounted for in the ROGO reserve clearance time allocations; and Therefore, we conclude that the application, as conditioned, will not adversely affect the hurricane evacuation objectives of the comprehensive plan; and WHEREAS, the Board of County Commissioners has considered the recommendation and findings of fact of Planning Commission and adopts the findings of fact as own; NOW THEREFORE, duly the its BE IT RESOLVED BY THE MONROE COUNTY BOARD OF COMMISSIONERS, that the preceding Findings of Fact support their decision to APPROVE the request filed by Key Haven Park and Recreation, Inc., a federally tax exempt institution, for exemption to the nonresidential permit allocation system. PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the 16th day of October, A.D., 1996.
