06/27/1988 Regular LL153 Special Meeting Board of County Commissioners Tuesday, June 27, 1988 Key West A Special Meeting of the Monroe County Board of County Commissioners convened at 2:00 p.m. on the above date at 310 Fleming Street in Key West. Present and answering to roll call were Commissioner William Freeman, Commissioner Jerry Hernandez, Jr., Commissioner John Stormont, and Mayor Eugene Lytton. Absent from the meeting was Commissioner Michael Puto. Also present were Danny L. Kolhage, Clerk: Lucien Proby, County Attorney: Randy Ludacer, Assistant County Attorney: Tom Brown, County Administrator: Attorney David Paul Horan: County Staff: members of the Press and Radio: and the general public. All stood for the Invocation and Pledge of Allegiance to the Flag. Mayor Lytton discussed the purpose of the meeting. Motion was made by Commissioner Hernandez and seconded by Commissioner Freeman to declare an Emergency Meeting for the purpose of considering a Proposed Stipulated Settlement in the case of Monroe County v. Graham. Motion carried unani- mously. Mayor Lytton discussed the $4.95 Million State appropriation for the Land Authority. He indicated that it was in the current State Budget which expired June 30th and that the Land Authority had, by Resolution No. 12-1988, exe- cuted the Contract which would obligate and protect those funds and had forwarded the same to DCA for their execution during May. Mayor Lytton, the Board members, and Staff then proceeded to a discussion of the negotiations concerning the Proposed Stipulated Settlement Agreement with DCA regarding Monroe County v. Graham. TOm Pelham, Secretary of the Department of Community Affairs, entered the meeting. During discussion, Commissioner Stormont objected for the record to the proposed use of the 1979 Principles. Secretary Pelham discussed the proposed Agreement. Motion was made by Mayor Lytton and seconded by Commissioner Freeman to approve the Proposed Settlement Agreement between Monroe County and the Department of Community Affairs and the dismissal of the Monroe County v. Graham lawsuit. Roll call vote was taken with the following results: Commissioner Freeman Commissioner Hernandez Commissioner Stormont Mayor Lytton Yes Yes No Yes ~,.~--- Motion carried.
