07/19/1987 Public Hearing / Special II 173 Public Hearing/Special Meeting Board of County Commissioners Wednesday, July 29, 1987 Key Colony Beach -- A Public Hearing/Special Meeting of the Monroe County Board of County Commissioners convened at 9:00 a.m. on the above date in the Key Colony Beach City Hall. Present and answering to roll call were Commissioner William Freeman, Commissioner Eugene Lytton, Commissioner Michael Puto, Commissioner John Stormont, and Mayor Jerry Hernandez, Jr. Also present were Danny L. Kolhage, Clerk; Rob Wolfe, Assistant County Attorney; Tom Brown, County Administrator; Charles Pattison and Planning Staff; members of the Press and Radio; and the general public. Amendment t130; 9-302, 9-307, 9-309, 9-401; Pages 155-164 Motion was made by Commissioner Lytton and seconded by Commissioner Stormont to amend Section 9-302 to provide in the I.S. an Allocated Density of 1.0 per standard lot and an OSR of 0.2; to add the word "(Tidal)" after the word "Mangroves" under the NATIVE use; and to insert under IMPROVED SUBDIVISION, "Improved Subdivision-Duplex" with an Allocated Density of 2.0 per lot and an OSR of 0.2. Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Commissioner Lytton to amend the Table in Section 9-309 to include applicable material for Suburban Residential and -- Improved Subdivision and also adding the Staff suggestions as shown on the attached sheet under REQUESTS - STAFF, 9a. Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Commissioner Lytton to amend the Table in Section 9-401 to include the setbacks listed under lOb of the Staff's Request as follows: LAND USE DISTRICT LAND USE FRONT YARD (FT.) Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Commissioner Puto to insert prior to the chart in Section 9-401 the following: II 174 C. Side Yard Exceptions - In any IS, IS-D, IS-M or URM district, any existing lot, platted and recorded prior to May I, 1973 having an average width of less than eighty (SO) feet, or having an area of less than eight thousand (S,OOO> square feet wherein the Planning Director determines that the full setback requirements for those districts cannot be complied with, he shall, administratively, permit said lot to have a side yard of not less than ten (10) per cent of the average lot width; but not less than five (5) feet for an interior side yard, and not less than ten (10) feet for a side yard abutting a road. Motion carried unanimously. Motion was made by Commissioner Lytton and seconded by Commissioner Puto to accept the recommendation of the Planning Commission to change the Allocated Density and Maximum Net Density for campgrounds in all districts which allow this use; to provide IS development units per gross acre in allocated density and IS development units per net buildable acre as a maximum net density; and to change front, rear and side setbacks to five feet. Motion carried unanimously. Motion was made by Commissioner Lytton and seconded by Commissioner Freeman to take no action on the Planning Commission's proposed amendment 2a. Motion carried unani- mously. Motion was made by Commissioner Stormont and seconded by Commissioner Puto to amend Section 9-302 to add the word "(Tidal)" after the word "Mangroves" under the NATIVE use. Motion carried unanimously. No action was required by the Board on Planning Commission's proposed amendments 4a, Sa, and 6a. No action was required by the Board on Staff Request la. Motion was made by Mayor Hernandez and seconded by Commissioner Freeman to accept Staff Recommendation 2a to provide an OSR of 0.50 in the Suburban Commercial and Suburban Residential Limited Districts in Section 9-302. Motion carried unanimously. Motion was made by Commissioner Lytton and seconded by Commissioner Freeman to accept Staff Recommendation to pro- vide an OSR of 0.20 in the Industrial and Maritime Industry Districts in Section 9-302. Motion carried unanimously. Motion was made by Commissioner Lytton and seconded by Commissioner Freeman to accept Staff Recommendation 4a to eliminate the "Rec. Rental" category from Urban Commercial and Urban Residential-Mobile Home Districts in Section 9-307. Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Commissioner Freeman to remove "Hotel" from the SS category in Section 9-307 and correct the chart. During discussion, the motion was withdrawn. II 175 Motion was made by Mayor Hernandez and seconded by Commissioner Stormont to accept Staff Recommendation 6a to remove an asterisk from the "campground" category in Section 9-307 to be consistent with the permissibility of RVs in the district. Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Commissioner Lytton to add "Hotels/Rec. Rental/Campgrounds" to the Parks and Refuge District in Section 9-307. Motion carried unanimously. No action was required by the Board on Staff Request Sa and 9a. No Board action was required on Public Request la and 2a. Curt Blair discussed Public Request 3a and requested that in Section 9-307, the Mixed Use Area and Institutional Residential Area be modified to reflect an Allocated Density of IS and a Maximum Net Density of 24. Motion was made by Mayor Hernandez and seconded by Commissioner Freeman to approve this Public Request 3a. Roll call vote was unani- mous. Motion was made by Commissioner Stormont and seconded by Commissioner Lytton to include the following note at the bottom of the chart in Section 9-307 relative to MU, OR, SR and DR: "Note: Maximum Net Density includes transient residential and employee housing resi- dential units." Motion carried unanimously. Motion was made by Commissioner Lytton and seconded by Commissioner Puto to continue Public Request 4a to July 31, 19S7. Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Commissioner Lytton to accept Staff Request Sa to remove "Institutional" from the chart in Section 9-307 under MU. Motion carried unanimously. Motion was made by Commissioner Lytton and seconded by Commissioner Puto to amend the chart in Section 9-309 to show a Floor Area Ratio under Suburban Residential Institutional of .30. Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Commissioner Puto to amend Section 9-309 to eliminate the words "intensity not specified" under DR. Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Commissioner Freeman to amend Section 9-309 to eliminate the words "intensity not specified" under CFSD t7 and provide - for a Low Intensity of .45, a Medium Intensity of .40, and a High Intensity of .35. Motion carried unanimously. Amendment 117; 9-S09 and 9-SII; Pages 201-202 and 203-214 Motion was made by Commissioner Lytton and seconded by Commissioner Puto to approve proposed Amendment 117 to read as follows: Sec. 9-S09. Open Space Requirements No land shall be developed, used or II 176 l l occupied such that the amount of open space on the parcel proposed for development is less than the following ratios, nor shall open space be cleared or otherwise disturbed including ground cover, understory, midstory, and canopy vegetation, except as provided in Section 3-101 0-3. The amount of open space required on any parcel for development shall be determined according to each land type. Sec. 9-S11 C.4. High Hammock (High Quality) All areas of required open space shall be maintained in their natural condition, including the preservation of midstory and understory vegetation, except as provided in Section 3-101 0-3. Sec. 9-S11 D.3. High Hammock (Moderate Quality) All areas of required open space shall be maintained in their natural condition, including the preservation of midstory and understory vegetation, except as provided in Section 3-101 0-3. Sec. 9-S11 F.2. Low Hammock (High Quality) All areas of required open space shall be maintained in their natural condition, including the preservation of midstory and understory vegetation, except as provided in Section 3-101 0-3. Sec. 9-S11 G.2. Low Hammock (Moderate Quality) All areas of required open space shall be maintained in their natural condition, including the preservation of midstory and understory vegetation, except as provided in Section 3-l01 0-3. Sec. 9-S11 I.2. Palm Hammock All areas of required open space shall be maintained in their natural condition, including the preservation of midstory and understory vegetation, except as provided in Section 3-101 0-3. Motion carried unanimously. Amendment t104; 9-SIIM2c and d; Page 211 Motion was made by Commissioner Lytton and seconded by Commissioner Puto to approve proposed Amendment il04 as follows: Sec. 9-S11 M2c No commercial docking structure shall be located on submerged land which is vegetated with sea grasses, patch reefs, and marine hard bottom communities, except as is necessary to reach waters of at least minus four feet (-4') mean low water level. Residential docking facilities need not meet these criteria if an applicant can demonstrate that none of these communities II 177 exist on site. In no case should any such facility be located at a water depth of less than minus three feet (-3') mean low water, except as provided in Section 9-SIIA. - Sec. 9-SIIM2d No commercial docking facility shall be developed at any site unless a minimum channel of twenty (20) feet in width where a mean low water depth of at least minus four feet (-4') exists. Residential docking facilities need not meet these criteria if an applicant can demonstrate that none of the communities noted in Section 9-SllM2c above is present on the site. In no case should any such facility be located at a water depth of less than minus three feet (-3') mean low water, except as provided in Section 9-SIIA. Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Commissioner Freeman to approve proposed amendment to Section 9-SIIMI as follows: I. Except as provided in Subsection 3, only piers, docks, utility pilings and walkways shall be permitted on submerged lands, disturbed with mangroves and mangroves; - with the same amendment to be carried forward to all approp- riate sections. Motion carried unanimously. Motion was made by Commissioner Puto and seconded by Commissioner Stormont to amend proposed Amendment i104, Section 9-SIIM3, by removing the following sentence: c. the fill does not have a significant adverse impact on natural marine communi- ties; and to re-Ietter the following two sentences. Motion carried unanimously. Motion was made by Commissioner Puto and seconded by Commissioner Freeman to adopt proposed amendment to Section 9-SIIM3 as amended. Motion carried unanimously. Motion was made by Commissioner Stormont and seconded by Commissioner Lytton to approve Section 9-S11M4 as follows: - 4. No fill shall be permitted in any man-made water body unless the applicant demonstrates and the County Biologist determines that the activity will not have a significant adverse impact on natural marine communities; and Motion carried unanimously.
