Board of County Commissioners
Monday, February 23, 1987
Key West
A Special Meeting of the Monroe County Board of
County Commissioners and the Fine Arts Council convened at
10:00 a.m. on the above date at 310 Fleming Street, Key
West. Present and answering to roll call were Commissioner
William Freeman, Commissioner Eugene Lytton, Commissioner
Michael Puto, Commissioner John Stormont, and Mayor Jerry
Hernandez, Jr. The following members of the Fine Arts
Council were present: Parvan Bakardjiev, Richard Heyman,
and Judge Sandra Fowler. Also present were Danny L.
Kolhage, Clerk1 Lucien Proby, County AttorneY1 Tom Brown,
County Administrator1 County Staff; members of the Press
and Radio; and the general public.
Prior to the beginning of the Special Meeting, Mr.
Brown made some announcements concerning the schedule for
the trip to Washington, D.C. He advised that there would be
a meeting of the Blue Ribbon Committee at 1:30 p.m. on
February 24th at 310 Fleming Street, Key West. Commissioner
Lytton indicated that he would not be present to serve as
Moderator due to an appointment in Tallahassee and asked
that Al Dameron, a member of the committee, serve as
Moderator in his place. Mr. Brown indicated that he had
been advised by DCA that they would be present at the
March 3rd meeting at 3:00 p.m. to discuss the Key Largo
Habitat Proposal and that the new Secretary, Mr. Pelham,
would be present.
Judge Fowler of the Monroe County Fine Arts Council
discussed the Fine Arts Council's role in promoting the arts
in Monroe County and indicated that if the Fine Arts Council
were allowed to administer the Cultural Funds of the Tourist
Development Council, that they could produce matching funds
to support the cultural activities in the Keys. She pro-
posed that the Fine Arts Council assume control of a part of
the Cultural Funds of the TDC which normally were allocated
to tax-exempt non-profit organizations involved in cultural
activities. Judge Fowler also discussed the Administrative
Budget of the Fine Arts Council and administration of any
grant funds. She presented a County Comparison of Cultural
Funding from the Tourist Tax Revenue prepared by the South
Florida Cultural Consortium.
Mayor Hernandez presented a memorandum dated
February 18th from Jeffrey A. Fisher, Monroe County
Extension Director, concerning the Fine Arts Council and
the Tourist DDevelopment Council.
After discussion by the Board, Mayor Heyman and Mr.
Bakardjiev both addressed the Board. Samuel Feiner, Vice-
Chairman of the Tourist Development Council, also addressed
the Board. The County Attorney discussed the State Statute
governing the Tourist Development Council. Bill Sellers,
Cultural Chairman for TDC, addressed the Board. Stan
Becker, member of TDC, discussed the guidelines and laws
concerning TDC funds. The following individuals addressed
the Board: Ron Hammer, resident of Key West; Susan Hawkins,
representing the Red Barn Theater; George Gugliotti,
President of Key West Players; and Michael Whalton, co-
ordinator of various Key West Festivals. Mayor Heyman and

Mr. Bakardjiev again addressed the Board.
Mayor Hernandez then appointed a committee con-
sisting of Commissioner Freeman, Commissioner Stormont, and
Mayor Feiner of Key Colony Beach and a committee consisting
of two members of the TDC and two members of the Fine Arts
Council, with Mayor Feiner serving as Moderator, to review
this issue and make a recommendation to the Board of County
Commissioners concerning the request of the Fine Arts
Council and the appropriate administration of cultural
funds. Jeff Fisher was appointed by Mayor Hernandez to act
as a disinterested observer representing the Board in these
matters. County Attorney Proby was asked to assign a Staff
Attorney to assist the committees in their work. These com-
mittees are to sunset in six months and it is required that
they produce a report to the Board within that period of
time.

A Special Meeting of the Monroe County Board of
County Commissioners convened at 1:30 p.m. on the above date
at 310 Fleming Street, Key West. Present and answering to
roll call were Commissioner William Freeman, Commissioner
Eugene Lytton, Commissioner John Stormont, and Mayor Jerry
Hernandez, Jr. Absent from the meeting was Commissioner
Michael Puto. Also present were Danny L. Kolhage, Clerk;
Lucien Proby, County AttorneY1 Harry Knight, Tax Collector1
Charles Pattison, Director of Planning, Building & Zoning1
Howard Tupper, Development Review Coordinator; Michael
Managan, Assistant County Administrator1 members of the
Press and Radio1 and the general public.
Harry Knight, Tax Collector, discussed problems
that his office was experiencing in the issuance of occupa-
tional licenses in accordance with the new requirements of
the Land Use Plan as interpreted by the Planning, Building &
Zoning Department. Charles Pattison, Director of Planning,
Building & Zoning, discussed the procedures under both the
old and new Plans. This matter was referred back to Mr.
Knight and Mr. Pattison to review the processes and to make
recommendations in order to streamline the process and what-
ever corrective action is necessary to accomplish that, and
to report back to the Board.
Mayor Hernandez then asked that the matter con-
cerning Higgs Beach be placed on the March 17th Agenda at
2:30 p.m. and directed the County Administrator's Office
accordingly.
Al Dameron of Post, Buckley, Schuh & Jernigan
discussed a visit by Public Works Director, Dent Pierce, and
Post, Buckley, Schuh & Jernigan to Higgs Beach scheduled for
tomorrow morning. Motion was made by Mayor Hernandez and
seconded by Commissioner Freeman to direct the County
Administrator to request Post, Buckley, Schuh & Jernigan to
review the conditions of the pier up to the first ladder and
to advise the Board of any temporary corrective measures
which could be taken in order to make the pier safe as soon
as possible. Motion carried unanimously.
The Tax Collector discussed the problem of the
purchase of a tax certificate on a ten-foot roadway by Mr.
Les Hearn, the roadway servicing an island off of Summerland
Key. No action was taken.
There being no further business, the meeting was
adjourned.
