Monroe County Commission ORDINANCE NO. 002 -1993 AN ORDINANCE OF THE BOARD OF COUNTY COMMIS- SIONERS OF MONROE COUNTY, FLORIDA, ESTABLISH- ING A SPECIAL MUNICIPAL SERVICES TAXING UNIT, FOR THE PURPOSES OF REPAIRING AND IMPROVING STREETS AND ROADS, WHICH ENCOMPASS THE AMENDED PLAT. OF WINSTON WATERWAYS AND MORE PARTICULARLY THE PLATTED LOTS BORDERING; ca VALENCIA ROAD SOUTH OF MAHOGANY DRIVE, 1S7- co --9 LANE, 2ND LANE, 3RD LANE AND 4TH LANES �; = PROVIDING A PURPOSE; PROVIDING FOR GOVERNING CO ;1; BODY; PROVIDING FOR THE IMPOSITION AlV " ' N --, COLLECTION OF A NON-AD VALOREM ASSESSMENT 2 n PROVIDING FOR SEVERABILITY; PROVIDING FOI. ." , REPEAL OF ALL ORDINANCES INCONSISTENT HERE- C'> = m WITH; PROVIDING FOR INCORPORATION INTO TIC ' QD o MONROE COUNTY CODE; AND PROVIDING AN EFFEC- TYJ TIVE DATE. � cn WHEREAS, the residents of Amended Plat of Winston Waterways bordering certain improved and unimproved private streets have- expressed a desire for the establishment of a taxing/special assessment district for the improvement of those certain streets with intent to convey such streets to Monroe County for ultimate perpetual maintenance, and WHEREAS, the 24 property owners constituting ownership of the 33 adjacent lots and parcels of property have expressed themselves through written instrument as to the desire and necessity for such improvements , and WHEREAS, Seventy-five percent (75%) of those property owners responded in writing as being in favor of the creation of a special taxing/assessment district for such improvements, and WHEREAS , the Board of County Commissioners of Monroe County, Florida, believes that such improvements would serve a valid public purpose of the County, but would most directly and substantially benefit the property owners of the affected prop- erties , and WHEREAS, each platted lot in the subdivision is of approxi- mately the same size which means that the benefit derived from the road improvements will be equally distributed among all lot owners ; and WHEREAS, it is fitting and appropriate that those persons who most directly and substantially derive benefit from the roadway improvements bear the financial burden of such improve- ments in proportion to the respective benefits received, on a per lot basis, by such property owners , now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1 . Establishment Pursuant to the provisions of Sec. 125 .01(q) , Fla. Stat. , there is hereby established a Munici- pal Service Taxing Unit ("MSTU") , for a five year period, com- prised of the area shown on the Amended Plat of Winston Waterways as recorded in Plat Book 4, Page 121, and adjacent to Valencia Road south of Mahogany Drive, or 1st Lane, 2nd Lane, 3rd Lane and 4th Lane. Section 2. Purpose The purpose of this MSTU is to provide road and street facilities and more particularly to reconstruct, repair and pave Valencia Road south of Mahogany 2 Drive, 1st Lane, 2nd Lane, 3rd Lane and 4th Lane of the Amended Plat of Winston Waterways . Section 3. Governing Body The governing body of the MSTU established herein shall be the Board of County Commission- ers of Monroe County, Florida. Section 4. Powers and Duties. The Board of County Commissioners of Monroe County, acting as the Governing Body of the District, shall have the following powers and duties : a. The Governing Body may advertise for bids and let contract or contracts for the repair or reconstruction of the streets and roads within the District in conformance with the standards and requirements for public streets and roads within the County. b. 1) The cost of repair or reconstruction of the streets and roads in the District shall be paid from the proceeds of a non-ad valorem assessment authorized by this ordinance and Sec. 197.3632, Fla. Stat. , and with funds otherwise designated for the use of the District, but the cost shall not be paid for with other tax revenues generated by the County of Monroe or the State of Florida. 2) The County Engineer' s estimate the cost of the road and street improvements is $101, 000.00 , which includes the engineering, surveying, planning and permitting costs . The Governing Body, pursuant to the procedure set forth in Sec. 197.3632, Fla. Stat. , is authorized to impose a non-ad valorem assessment based on a per platted lot rate whereby each platted 3 ' lot shall bear an equal share of the County Engineer' s estimate of the cost of improvements . If during the course of planning, permitting, or constructing the road improvements , the County Engineer' s estimate of the cost to completion exceeds $101, 000 .00, the Governing Body may adopt the new estimate as the basis for calculating the non-ad valorem special assessments by amending this Ordinance in the same manner by which it was originally adopted. The Governing Body may spread the assess- ments out over a period of years , not to exceed five. The Governing Body may issue anticipation warrants or notes to be paid from the assessments hereby authorized, in accordance with the general law, in order to fund the repair, repaving or recon- struction of the streets and roads in the District. Except, however, no District funds shall be spent on the street and road improvements until such time as the streets or roads described in Section 2 of this ordinance have been conveyed to Monroe County or an easement executed dedicating the streets and roads to Monroe County for use as public thoroughfares . 3) If upon completion of the street and road improve- ments and the retirement of any outstanding anticipation warrants or notes there are any remaining unused funds of the District, the funds shall be refunded to the lot owners , as reflected in the most current records of the Property Appraiser, by dividing the amount remaining by the number of platted lots . The County Engineer shall prepare the list of the lot owners and the amount of their refund and shall submit the list to the Clerk who shall then distribute the refunds . In calculating the remaining funds 4 eligible for distribution, the Clerk shall first be entitled to deduct an amount sufficient to cover his costs of distribution. c. In addition to other powers enumerated in this Ordi- nance, the Governing Body is empowered to: (1) sue and be sued. (2) enter into all contracts necessary to accomplish district purposes (3) receive grants and other revenues other than that enumerated to subsection (b) of this Ordinance on behalf of the District for District purposes ; (4) acquire by gift, purchase, or the exercise of the right of eminent domain, lands , any other property, real or personal, tangible or intangible, necessary to accomplish district purposes . d. All invoices and requests for payment of work or services authorized by this Ordinance are to be paid upon receipt of a payment voucher request that shall be verified by the Governing Body as proper expenditures provided for herein, and shall otherwise comply with all requirements of general law concerning the expenditure of municipal service taxing district funds . Section 5. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 6 . All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 7. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and 5 111.1 shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 8. This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
