Ordinance 015-1993 Illif Contractor' s Examining Board ORDINANCE NO. 015 -1993 AN ORDINANCE CREATING SECTION 6-68(D) (5) , SECTION 6-68(D) (6) , AND SECTION 6-68(F) , MONROE COUNTY CODE, IN ORDER TO PROVIDE FOR THE IMPOSITION OF MONETARY FINES UP TO FIVE HUNDRED DOLLARS ($500 .00) FOR VIOLATIONS OF SECTION 6-66 , TO PROVIDE FOR AN ADMINISTRA- TIVE FEE OF TEN PERCENT (10%) OR ONE HUNDRED T� DOLLARS ($100 .00) , WHICHEVER IS MORE .1-7-FOR eD COLLECTING SAID FINES, AND TO PROVIDE GUIDELINES TO BE USED FOR THE IMPOSITIOT&OF o PENALTIES ; PROVIDING FOR SEVERABILItY; PROVIDING FOR REPEAL OF ALL ORDINANCES ! 77 INCONSISTENT HEREWITH; PROVIDING YOR; INCORPORATION INTO THE MONROE COUNTY CODE;; AND PROVIDING AN EFFECTIVE DATE. -, CD a. :_3 BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1 . Section 6-68(d) (5) , Monroe County Code, is hereby added to read as follows : "(5) Imposition of an administrative fine up to but not to exceed Two Hundred Fifty Dollars ($250 . 00) for a first violation or Five Hundred Dollars ($500 .00) for a repeat violation on each of the charges upon which a certificate holder has been found in violation by the board. This penalty may be imposed separately or in addition to the penalties of suspension, revocation and reprimand authorized in Section 6-68(d) (2) , (3) , and (4) above. The payment of such fines shall be made to the Monroe County Building Department within a time specified by the board, but no less than seven (7) days and no more than thirty (30) from the date of imposition. If a certificate holder fails to pay the fine as assessed by the board, the certificate of such person or firm shall be administratively suspended until the fine has been paid, and the certificate holder, the Department of Professional Regulation for the State of Florida and all municipalities within the County shall be so notified, and a certified copy of the order issuing the fine shall be filed in the public records of Monroe County, thereby creating a lien." AIM 1111111 Section 2. Section 6-68(d) (6) , Monroe County Code, is hereby created to read as follows : "(6) Imposition of an administrative fine for all costs incurred by the Monroe County Building Department and the County Attorney' s office in investigating and resolving the complaint or complaints which gave rise to the disciplinary proceeding which administrative fee shall be Ten Percent (10%) of the administrative fine or One Hundred Dollars ($100 . 00) , whichever is greater. " Section 3 . Section 6-68(f) , Monroe County Code, is hereby created to read as follows : "(f) Imposition of penalties pursuant to this section shall be based upon consideration of guidelines duly adopted by the Contractor' s Examining Board, or upon guidelines established by the State Construction Industry Licensing Board." Section 4 . If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 5 . All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 6. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 7 .
