FOR APPROVAL; PROVIDING FOR SEVERABILITY; 'AND
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Section 9 . 5-511 (c) , Monroe County Code of Ordinanc-
es (Code) , provides that the land development regulations (Chap-
ter 9 .5 of the Code) , including the land use district maps, may
be amended or changed at any time; and
WHEREAS, Monroe County adopted Ordinance #13-1991, suspending
the rezoning of property until the new comprehensive land use
plan becomes effective; and

WHEREAS, a court order in case #89-20-529-CA-18 from Circuit
Judge Richard G. Payne issued on April 21st, 1992, requires the
County to process this request for a Map and Text Amendment filed
by Holiday Isle Resorts, Inc. ; and
WHEREAS, the Board of County Commissioners on January 23rd,
1986, moved to designate Holiday Isle, Windley Key, South of U.S.
1, MM 84.5 and the adjacent Howard Johnson' s Property, as Destina-
tion Resort (DR) with an Area of Critical County Concern overlay,
and with the additional provision that the property remain Subur-
ban Commercial (SC) if the conditions of the ACCC designation
were not met; and
WHEREAS, the Holiday Isle Resort Area of Critical County
Concern was established for the purpose of linking future growth
and development within that area, with internal and external
circulation, adequate parking, and safe and efficient ingress and
egress without interfering with the functions of U.S .1 as an
arterial road; and
WHEREAS, the El Capitan property was included in the map
amendment application based on the court documents provided; and
WHEREAS, during the amendment process, the Monroe County
Planning Commission, sitting as the local planning agency, after

due notice and public participation in the hearing process, has
reviewed the proposed land use district map changes and has found
such changes to be consistent with the Monroe County Comprehen-
sive Plan and has made a recommendation concerning such changes
to the Monroe County Board of Commissioners; and
WHEREAS, the Monroe County Board of Commissioners, after due
notice and public participation in the hearing process, has re-
viewed the Planning Commission' s recommendation and now legisla-
tively acts thereon; and
WHEREAS, F.S . 380 . 0552 (9) requires that the state land plan-
ning agency must approve all proposed land use district map chang-
es before such changes may become effective; NOW THEREFORE
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF MONROE COUN-
TY, FLORIDA: THAT
Section 1. The Holiday Isle Area of Critical County Con-
cern (ACCC) designation previously adopted is hereby repealed.
Section 2 . The land use district map shall be amended,
changing the land use designation for the property, as shown on
Planning Commission exhibit 1, attached and incorporated by refer-
ence herein; in that the property South of U.S. 1 shall be

changed from Suburban Commercial (SC) with an ACCC overlay to
Destination Resort (DR) without an ACCC overlay and further pro-
viding that the property North of U.S. 1, shall be changed from
Native Area (NA) with an ACCC overlay to Native Area (NA) without
an ACCC overlay.
Section 3 . The entire Land Development Regulation Section
9 .5-480 titled "Holiday Isles Area of Critical Concern" is hereby
repealed.
Section 4 . If any section, subsection, sentence, clause,
item, change, or provision of this ordinance is held invalid, the
remainder of this ordinance shall not be affected by such invalid-
ity.
Section 5 . This ordinance is hereby transmitted to the
state land planning agency for approval or disapproval pursuant
to F.S.380 . 0552 (9) .
Section 6 . This ordinance shall be filed in the Office of
the Secretary of State of the State of Florida, but shall not be
deemed effective until approved by the state land planning agency.

This Ordinance was adopted by the Monroe County Board
of County Commissioners at a Regular Meeting in formal session on
