Ordinance 035-2001Public Works Department ORDINANCE NO 035 - 2001 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, ESTABLISHING A SPEED LIMIT OF 25 MILES PER HOUR ON ALL COUNTY ROADS; PROVIDING FOR EXCEPTIONS TO THE 25 MILE PER HOUR SPEED LIMIT FOR CERTAIN COUNTY ROADS; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE DATE WHEREAS, pursuant to Sec. 316.189(2), FS, the County Engineer undertook an investigation as to the safe and appropriate speed limit for County road; WHEREAS, in conducting the study the County Engineer considered the following factors: 1) right-of-way width 2) lane width ` -n 3) shoulder width and condition o � Q 4) on -street parking Qr, Z rrn 5) lateral clearance c 6) sight distance oc-,• _�J o 7) roadway alignment; ::a 8) pedestriansnY ='o 9) length of the roadway -4,-'> _ n 10) roadway condition > m CD� 11) adjacent land use; and — co WHEREAS, at the conclusion of the investigation, the County Engineer determined that the safe and appropriate speed limit for County roads is 25 miles per hour; now, therefore BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. Sec. 11-1(a), Monroe County Code, is hereby amended to read: Sec. 11-1. Establishment of county speed zones. (a) The speed of twenty-five (25) miles per hour is hereby established for all county roads. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section S. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office.
