AN ORDINANCE PROVIDING FOR A NONCRIMINAL CIVIL PENALTY
OF $20 FOR PERSONS PARKING VEHICLES IN VIOLATION OF THE
RESTRICTED PARKING AREAS AT THE KEY WEST COURTHOUSE
COMPLEX; PROVIDING THAT A LAW ENFORCEMENT OFFICER OR
PARKING ENFORCEMENT SPECIALIST MAY HAVE A VEHICLE
PARKED IN VIOLATION OF THE RESTRICTED PARKING AREAS

BE IT ORDAINED BY THE BOARD OF COUNTY CONAgfl-SION S �F
MONROE COUNTY, FLORIDA, that: L' w CD
Section 1 . The noncriminal civil penalty for a violation
of Sec. 2 of Resolution No. 073 -1994, parking in an area at the
Key West Courthouse Complex reserved for employees of the County,
state and constitutional officers and persons summoned for jury
duty, shall be $20 .00 . A law enforcement officer or parking
enforcement specialist who discovers a vehicle parked in
violation of this section may issue a ticket in the form used by
the County for parking violations to the driver or, if the
vehicle is unattended, attach the ticket to the vehicle in a
conspicuous place. The liability for the payment of the parking
ticket shall be pursuant to Sec. 316.1967, Fla. Stat. All
parking ticket penalties collected pursuant to this section shall
be remitted to the County' s general fund.
Section 2. In the case of violators parked in parking
spaces in violation of Resolution No.073-1994, the law enforcement
officer or parking enforcement specialist, in addition to charg-
ing the owner and/or operator with the noncriminal violation set
forth in Sec. 1 , may have the vehicle towed and impounded at the
owner' s expense. The cost of such towing and impoundment shall
be a lien against the vehicle. In the event that the Monroe
County Court determines that the noncriminal violation charged
was invalid:
a) the' vehicle shall be immediately released without
charge and with the lien provided for in this section
automatically extinguished; or
b) if the owner or operator has paid the cost of towing
and impoundment, the amount paid shall be refunded.
Section 3. If any section, subsection, sentence, clause
or provision of this ordinance is held invalid, the remainder of
this ordinance shall not be affected by such invalidity.
Section 4. All ordinances or parts of ordinances in
conflict with this ordinance are hereby repealed to the extent of
said conflict.
Section 5 . The provisions of this ordinance shall be
included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform
numbering system of the Code.
Section 6. This ordinance shall take effect immediately
upon receipt of official notice from the Office of the Secretary

of State of the State of Florida that this ordinance has been
filed with said Office.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 16th day of February , A.D. , 1994.

noncriminal civil penalty of$20 for persons parking vehicles in violation of the
restricted parking areas at the Key West Courthouse Complex; Providing that a Law
Enforcement Officer or Parking Enforcement Specialist may have a vehicle parked in
violation of the restricted parking areas towed and impounded at the owner's expense
and providing for the extinguishment or refund of the towing and impoundment cost if
the vehicle was invalidly towed;Providing for the repeal of all Ordinances inconsistent
herewith;Providing for severability; Providing for incorporation into the Monroe County
Code; and Providing an effective date.
This Ordinance was adopted by the Monroe County Board of County
Commissioners at a Regular Meeting in formal session on February 16, 1994. Please file

NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN that on
Wednesday , February 16 , 1994 , at 9 : 00 A.M. at the Key Largo

ticket shall be pursuant to Sec. 316. 1967 , Fla. Stat. All
parking ticket penalties collected pursuant to this section shall
be remitted to the County' s general fund.
Section 2 . In the case of violators parked in parking
spaces in violation of Resolution No. -1994, the law enforcement
officer or parking enforcement specialist, in addition to charg-
ing the owner and/or operator with the noncriminal violation set
forth in Sec. 1 , may have the vehicle towed and impounded at the
owner' s expense. The cost of such towing and impoundment shall
be a lien against the vehicle. In the event that the Monroe
County Court determines that the noncriminal violation charged
was invalid:
a) the vehicle shall be immediately released without
charge and with the lien provided for in this section
automatically extinguished; or
b) if the owner or operator has paid the cost of towing
and "impoundment, the amount paid shall be refunded.
Section 3. If any section, subsection, sentence, clause
or provision of this ordinance is held invalid, the remainder of
this ordinance shall not be affected by such invalidity.
Section 4 . All ordinances or parts of ordinances in
conflict with this ordinance are hereby repealed to the- extent of _
said conflict.
Section 5 . The provisions of this ordinance shall= be
included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform
numbering system of the Code.
Section 6. - This ordinance shall take effect immediately
upon receipt of official notice from the Office of the Secretary
of State of the State of Florida that this ordinance has been
filed with said Office.
