' ORDINANCE NO. 021 -1994 AN ORDINANCE AMENDING CHAPTER 14, ARTICLE III, CREATING THREE BRANCHES OF THE COMMISSION ON THE STATUS OF WOMEN; REVISING THE APPOINTMENT PROVISIONS OF THE ARTICLE; •PROVIDING FOR BRANCH MEETINGS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Monroe County Commission on the Status of Women was created by Ordinance No. 1-1974 to serve in an advisory capacity to the county commission in respect to all matters pertaining to the status of women; and WHEREAS, the Board of County Commissioners has determined that the Creation of three regional branches would facilitate the ability of the members to carry out their duties , powers and responsibilities ; now, therefore BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1 . Establishment of Commission and Branches . Sec. 14-32, Monroe County Code is hereby amended to read as follows : (a) The Monroe County Commission on the Status of Women is hereby created and established. The commis- sion shall consist of seventeen (17) members appointed by the county commission. (b) There are hereby created three regional branches of the Commission on the Status of Women as follows : (i) The Upper Keys Branch of the Commission on the Status of Women shall serve the area of Monroe County north of Whale Harbor Channel; (ii) The Middle Keys Branch of the Commission on the Status of Women shall serve the area of Monroe County between Whale Harbor Channel and the southernmost point of the Seven Mile Bridge; and (iii) The Lower Keys Branch of the Commission on the Status of Women shall serve the area of Monroe County south of the southernmost point of the Seven Mile Bridge. Section 2. Terms of Members . Sec. 14-33 , Monroe County Code is hereby amended to read as follows : All appointments to the commission created by this article shall be made for a term of two (2) years , to run concurrent with the term of the appointing county commissioner. Appointments to fill any vacancy on the commission shall be for the remainder of the unexpired term of office and shall be made in the same manner as the original appointment. A member may be removed for cause only by a majority vote of the entire membership of the county commission or by absence of any member of the Commission on the Status of Women from three (3) 2 regularly scheduled consecutive meetings or four (4) regularly scheduled meetings in one (1) year. Absence from three consecutive meetings or four meetings in one year, whether the absences be from the commission meetings or the branch meetings or a combination thereof, shall automatically disqualify the member from service and the chairperson shall certify the same to the county commission. Section 3. Qualifications . Sec. 14-34, Monroe County Code is hereby amended to read as follows : Members of the Commission on the Status of Women shall be residents of the county and shall reside or operate a business in the area of the Branch to which they are appointed. Members , while serving, shall not become candidates for election to any public office. In order to secure representative membership upon the board, the county commissioners shall appoint seventeen (17) members which shall be apportioned as follows : five (5) members to the Upper Keys Branch, five (5) members to the Middle Keys Branch, and seven (7) members to the Lower Keys Branch. Each county commissioner shall appoint one member to each branch and the mayor and mayor pro tem shall each appoint an additional member to the Lower Keys Branch. 3 Section 4. Officers and Meetings . Sec. 14-35, Monroe County Code is hereby amended to read as follows : (a) The Commission on the Status of Women shall, by a majority vote of the entire commission, elect the chairperson of the Commission on the Status of Women and any other officers deemed necessary or desirable. Nine (9) members of the Commission shall constitute a quorum necessary to hold a meeting and take any action. Members shall serve without compensation, but shall be reimbursed for necessary expenses incurred in the performance of their official duties upon approval by the county commission. The chairperson may call special meetings of the Commission and the Commission at any meeting may fix and call a meeting on a future date. At the beginning of each fiscal year a regular schedule of meetings shall be established. Minutes shall be kept of all meetings of the Commission. All meetings shall be open to the public, advertised and at least one regularly scheduled meeting shall be held each fiscal year. (b) Each branch shall, by a majority vote of the entire branch, elect a branch chairperson, and such other officers as each branch deems necessary. A simple majority of the full branch shall constitute a quorum necessary to hold a meeting and take any action. Each deputy shall serve without compensation, but shall 4 be reimbursed for necessary expenses incurred in the performance of their official duties upon approval by the county commission. Each deputy may call special meetings of the branch and the branch at any meeting may fix and call a meeting on a future date. At the beginning of each fiscal year a regular schedule of meetings shall be established. Minutes shall be kept of all meetings of the branch. All meetings shall be open to the public, advertised and at least one regularly scheduled meeting shall be held every three (3) months . (c) The Commission on the Status of Women shall delegate to each branch in accordance with the re- sources and abilities of the members such tasks, studies and duties as shall be established form time to time as goals of the commission, and such delegation shall be made in a manner to eliminate or avoid duplication of effort by the different branches . The Commission may also delegate to an individual member a particular task to serve the purposes authorized in this Article. Section 5. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 6. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. 5 • Section 7. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 8. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office. Establishment of Commission and Branches. Sec. 14-32 , Monroe County Code is hereby amended to read as follows : (a) The Monroe County Commission on the Status of Women is hereby created and established,. The commis- sion shall consist of eleven--4,}1} seventeen (17) members appointed by the county commission. (b) There are hereby created three regional branches of the Commission on the Status of Women as follows : (i) The Upper Keys Branch of the Cou,uiission on the Status of Women shall serve the area of Monroe County north of Whale Harbor Channel; (ii) The Middle Keys Branch of the Commission on the Status of Women shall serve the. area of Monroe County between Whale Harbor Channel and the southernmost point of the Seven Mile Bridge; and (iii) The Lower Keys Branch of the Commission on the Status of Women shall serve the area of Monroe County south of the southernmost point of the Seven Mile Bridge. Section 2. Terms of Members. Sec. 14-33 , Monroe County Code is hereby amended to read as follows : All appointments to the commission created by this article shall be made for a term of two (2) years , to run concurrent with the term of the appointing county commissioner. Appointments to fill any vacancy on the commission shall be for the remainder of the unexpired term of office and shall be made in the same manner as the original appointment. Sec. 14-34 , Monroe County Code is hereby amended to read as follows : Members of the eessissiea-ereated- tri-s--er-tiele Commission on the Status of Women shall be residents of the county and shall reside or operate a business in the area of the Branch to which they are appointed. Members , while serving, shall not become candidates for election to any public office. (c) The Commission on the Status of Women shall delegate to each branch in accordance with the re- sources and abilities of the members such tasks, studies and duties as shall be established form time to time as goals of the commission, and such delegation shall be made in a manner to eliminate or avoid duplication of effort by the different branches . The Commission may also delegate to an individual member a particular task to serve the purposes authorized in 5 i.. P this Article. Section 5 . If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 6. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 7. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 8. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office.
