RE-UV' Public Works Director 44 NOV -4 P70'A!INANCE NO. 027 -1994 AN ORD'I!NANCEL PROVIDING FOR A NONCRIMINAL CIVIL PENALTY OF $20CGRCPERSONS PARKING VEHICLES IN VIOLATION OF THE RES'ifigttEDO TATti.G AREAS ON STICKNEY LANE, KEY WEST, FLORIDA; PROVIDING THAT A LAW ENFORCEMENT OFFICER OR PARKING ENFORCEMENT SPECIALIST MAY HAVE A VEHICLE PARKED IN VIOLATION OF THE RESTRICTED PARKING AREAS TOWED AND IMPOUNDED AT THE OWNER' S EXPENSE AND PROVID- ING FOR THE EXTINGUISHMENT OR REFUND OF THE TOWING AND IMPOUNDMENT COST IF THE VEHICLE WAS INVALIDLY TOWED; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCOR- PORATION INTO THE MONROE COUNTY CODE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1 . The noncriminal civil penalty for a violation of Sec. 2 of Resolution No. 345-1994, parking on Stickney Lane in the vicinity of the Public Works garage in Key West reserved for County employees, is $20 .00 . A law enforcement officer or parking enforcement specialist who discovers a vehicle parked in violation of the Resolution and this section may issue a ticket in the form used by the County for parking violations to the driver or, if the vehicle is unattended, attach the ticket to the vehicle in a conspicuous place. The liability for the payment of the parking ticket is pursuant to Sec. 316.1967 , Fla. Stat. All parking ticket penalties collected pursuant to this section must be remitted to the County' s general fund. Section 2. In the case of violators parked in violation of Resolution No. 345-1994, the law enforcement officer or parking enforcement specialist, in addition to charging the owner or operator with the noncriminal violation set forth in Sec. 1 , may have the vehicle towed and impounded at the owner' s expense. The cost of such towing and impoundment area lien against the vehicle. If the Monroe County Court determines that the noncrim- inal violation charged was invalid: a) the vehicle must be immediately released without charge and with the lien provided for in this section automatically extinguished; or b) if the owner or operator has paid the cost of towing and impoundment, the amount paid must be refunded. Section 3. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 4. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 5 . The provisions of this ordinance must be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and may be appropriately renumbered to conform to the uniform numbering system of the Code. Section 6 . This ordinance will take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with that Office. . BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1. The noncriminal civil penalty for a violation " of Sec. 2 of Re~olution No. -1994, parking on Stickney Lane in the vicinity of the Public Works garage in Key West reserved for County employees, is $20.00. A law enforcement officer or parking enforcement specialist who discovers a vehicle parked in violation of the Resolution and this section may issue a ticket in the form used by the County for parking violations to the driver or, if the vehicle is unattended, attach the ticket to the vehicle in a conspicuous place. The liability for the payment of the parking ticket is pursuant to Sec. 316.1967, Fla. Stat. All parking ticket penalties collected pursuant to this section must be remitted to the County's general fund. '.~ Spction 2. In the case of violators parked in violation -1994, the law enforcement officer or of Resolution No. . r parking enforcement specialist, in addition to charging the owner or operator with the noncriminal violation set forth in Sec. 1 , may have the vehicle towed and impounded at the owner' s expense. The cost of such towing and impoundment area lien against the vehicle. If the Monroe County Court determines that the noncrim- inal violation charged was invalid: a) the vehicle must be immediately released without charge and with the lien provided for in this section automatically extinguished; or b) if the owner or operator has paid the cost of towing and impoundment, the amount paid must be refunded. Section 3 . If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 4 . All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 5. The provisions of this ordinance must be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and may be appropriately renumbered to conform to the uniform numbering system of the Code. Section 6.
