Ordinance 030-1994 ORDINANCE NO 030-1994 AN ORDINANCE AMENDING SECTION 11-1(a), MONROE COUNTY CODE, IN ORDER TO ESTABLISH A SPEED LIMIT OF FIFTEEN MILES PER HOUR FOR SUNRISE DRIVE AND OTHER COUNTY ROADS IN OLD TAVERNIER COVE SUBDIVISION, KEY LARGO; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to Sec. 316.189(2), Fla. Stat., the County Engineer has conducted an investigation, attached as Exhibit "A," and recommends that 15 miles per hour is the appropriate speed for Sunrise Drive, Old Tavernier Subdivision, Key Largo; and WHEREAS, the County Commission desires to implement the County Engineer's recommendation, now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1. Section 11-1(a), Monroe County Code, is hereby amended to read as follows: (a) The speed of thirty (30) miles per hour on county roads is hereby confirmed, according to Florida Statutes section 316.189(2)(a) for all business districts and residence districts, as defined by Florida Statutes section 316.003, with Monroe County. Except, however, the following minimum speed limits are established for certain county roads -n in residence districts: y A rn fl2C C) (1) Trinidad Road and West Indies Drive on Ramrod'}ley-,25 E miles per hour; (2) Sunrise Drive and Tarpon Street, Old Tavernici: ove 17.63 :a Subdivision; Ocean View Trail, Tavernier Heights; Atlantic Circ*Drve ccr and Tavern Drive, Tavernier 2 Subdivision; North Sunrises Drive, Tavemier Trail and Ocean Trail, Singleton's Addition to Tavernier Cove :7) Subdivision, Key Largo, 15 miles per hour. Section 2. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such i invalidity. Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office. Stat., the County Engineer has conducted an investigation, attached as Exhibit "A," and recommends that 15 miles per hour is the appropriate speed for Sunrise Drive, Old Tavernier. Subdivision, Key Largo; and WHEREAS, the County Commission desires to impelment the County Engineer's recommendation, now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1. Section 11-1(a), Monroe County Code, is hereby amended to read as follows: (a) The speed of thirty (30.) miles per hour on county roads is hereby confirmed, according to Florida Statutes section 316.189(2)(a) for all business districts and residence districts, as defined by Florida Statutes section 316.003, with Monroe County. Except, however, the : following minimum speed limits are established for certain county roads in residence districts: (1) Trinidad Road and West Indies Drive on Ramrod Key, 25 miles per hour; (2) Sunrise Drive and Tarpon Street, Old Tavernier Cove Subdivision; Ocean View Trail, Tavernier Heights; Atlantic Circle • ` Drive and Tavern Drive, Tavernier 2 Subdivision: North Sunrise Drive, Tavernier Trail and Ocean Trail, Singleton's Addition to Tavernier Cove Subdivision, Key Largo, 15 miles per hour. Section 2. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said Office.
