A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY. FLORIDA. AUTHORIZING THE COUNTY ADMINISTRATOR TO
EXECUTE THE REQUIRED DOCUMENTS TRANSFERRING THE 25 MOORING
BUOYS AND THE MOORING FIELD IN BOOT KEY HARBOR TO THE CITY OF
MARATHON.
WHEREAS. the Florida Keys Marina at Marathon and Boot Key Harbor were quitclaimed
to the City of Marathon; and
WHEREAS. 25 mooring buoys had previously been placed in the Boot Key Mooring Field.
within Boot Key Harbor; and
WHEREAS, said mooring buoys had been permitted by the Florida Department of
Environmental Protection, Florida Fish and Wildlife Conservation Commission, US Department of
the Army Corps of Engineers and the US Coast Guard; and
WHEREAS, it is in the best interest of the County and the City of Marathon to transfer
all permits from the County to the City; now, therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, that the County Administrator is hereby authorized to sign such letters and
execute such documents as are required by the Florida Department of Environmental Protection,
the Florida Fish and Wildlife Conservation Commission, the US Department of Army Corps of
Engineers, and the US Coast Guard to transfer permits of those agencies to the Ci:fy of

Dear Mr. Kolhage:
We are in receipt of your letter dated December 21, 2001, to Governor Bush, Treasurer Gallagher, and
other government officials. Treasurer Gallagher has asked that I review your letter and the attached Resolution No.
461-2001.
The Deparbnent shares your concern over the continuing rise in insurance premiums associated with the
peril of windstorm. As you know, the most recent rate filing by the Florida Windstorm Underwriting Association
(FWUA) was not approved by the Department, but, rather, an appointed arbitration panel. The Deparbnent has
supported legislation over the past several years that would return the review and final decision on rates to the
Commissioner of Insurance. Your initiative is not inconsistent with our previous efforts.
We will continue to consider and develop efforts to control the rise in rates. The Deparbnent is supporting
legislation this session that would combine the FWUA with the Florida Residential Property and Casualty Joint
Underwriting Association. This final entity will be named the Citizen Property Insurance Company and would
provide a residual market to all insureds that need coverage and cannot secure it in the vohmtary market. The
legislation would assure that final rate approval authority remain with the Insurance Commissioner. Your support of
this legislation would be appreciated.
On behalf of Treasurer Gallagher, let me commend you and Monroe's Board of County Commissioners for
its proactive reaction to the rising rate dilemma facing your community. You may rest assured that we will remain
sensitive to the situation and welcome any suggestions you may have regarding how the Deparbnent may be of
additional assistance.
