ORDINANCE^1
AN. ORDINANCE: OF THE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA, RESCIND-
ING THEIR ORDINANCE NO. 011-1992 AND ORDI-
NANCE NO. 019-1992 DEALING WITH BUILDING.
PERMITTING PROCEDURES, AND IN ADDITION,
REVISING THOSE .PARTS OF MONROE COUNTY CODE,
WHICH DEAL WITH REQUIREMENTS FOR BUILDING
PERMITS IN UNINCORPORATED MONROE COUNTY,
AND SECTIONS OF 9 . 5-115, MONROE COUNTY CODE
WHICH DEAL WITH THE EXPIRATION OF BUILDING
PERMITS IN UNINCORPORATED MONROE COUNTY;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL OF ALL ORDINANCES INCONSISTENT HERE
WITH; PROVIDING FOR INCORPORATION INTO THE
MONROE COUNTY. CODE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Section 9 . 5-111, Monroe County Code, currently out-
lines the requirements for building permits in unincorporated
Monroe County; _ and
WHEREAS, Section 9 . 5-115, Monroe County Code, currently out-
lines conditions for the expiration of building permits in unin-
corporated Monroe County; and
WHEREAS, the Board of County Commissioners desires to revise
such sections of the Monroe County Code to better outline the
requirements for building permits and their expiration; NOW THERE-
FORE }`
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that:
Section 1 . Sec . 9 . 5-111, Monroe County Code, is hereby
amended to read as follows:
Sec . 9 . 5-111 . Building permits required.
(a) No development shall occur except
pursuant to a building permit.
(b) Under no circumstances shall a
building permit extend for a period
of greater than five years .
(c) Procedures for the issuance of
building permits shall be in
accordance with the provisions of
Chapter 6 of this Code.
Section 2 . Sec. 9 . 5-115, Monroe County Code, is hereby
amended to read as follows:
Sec . 9. 5-115. Expiration of building permit.
(a) All building permits shall
expire in accordance with
the procedures set forth in
Chapter 6 of this Code. How-
ever, under no circumstances
shall a building permit extend
for a period of greater than
five years.
Section 3 . If any section, subsection, sentence, clause,
or provision of this Ordinance is held invalid, the remainder of
this Ordinance shall not be affected by such invalidity.
Section 4. All ordinances or parts of ordinances in con-
flict with this Ordinance are hereby repealed to the extent of
said conflict.

Section 5 . The provisions of this Ordinance shall be
included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform num-
bering system of the Code.
Section 6. This Ordinance shall take effect immediately
upon its approval by the State of Florida Administration Commis-
sion.
Section 7 . The Clerk of the Board is hereby directed to
forward a certified copy of this Ordinance to the Florida
Department of Community Affairs.
Section 8. The Clerk of the Board is hereby directed to
forward a certified copy of this Ordinance to the Secretary of
State of the State of Florida.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 16th day of October , A.D. , 1992 .
