AGENDA ITEM WORDING: Approval for one Affordable Housing Deed Restriction for four dwelling units from
Hawks Cay Investors Ltd.
ITEM BACKGROUND: On June 11,2003 and January 28,2004 the Planning Commission approved in total four
allocation awards for the applicants listed below provided the applicants' Affordable Housing Deed Restriction is
approved by the BOCC. Hawks Cay Investors Ltd. submitted the Restrictive Covenant to Monroe County. The
applicants are receiving a dwelling unit allocation award for the year ending July 13,2003, have filed the document
in accordance with Ordinance No. 47-1999.
PREVIOUS RELEVANT BOARD ACTION: On November 11,1999, the BOCC adopted Ordinance No. 047-
1999.

Notice is hereby given that:
I. IlWe, Hawk's Cay Investors LTD., a Florida limited partnership, the
undersigned is/are the sole owner(s) of certain real property, situated,
lying and being in Monroe County, State of Florida, described as follows:
Lots: 2 Block: ~ and Lots 2, 3, 4, & 5 Block 1.

II. Board of County Commissioners Resolution 037-2002 approved
Amendments to the Development Of Regional Impact (DRI) Development
Order, Resolution No. 365-1986, and Modifications to the Major
Development approval for the Hawk's Cay Expansion DRI; providing for
an effective date.
III. The following is a list of the four employee residential units Building Permit
Numbers: 03-2-0031,03-2-0032,03-2-0033, and 03-2-0034,.
IV. Under the affordable housing provisions set for in Chapter 9.5 of Monroe
County Code, the owner or owners of the above-described real property
have been exempted from payment of "Fair Share Impact Fees" for four
(4) residential units to be constructed for Hawks Cay Employees on said
real property.
V. The annual adjusted gross income for the fou~mPIOyee housing
units for Hawks Cay Employee households do not exceed the adjusted
gross annual income limits for affordable housing within Monroe County
as defined in Chapter 9.5, Monroe County Code and as amended from
time to time.

VI. The rent (Hawks Cay employee housing/tenant) will not exceed thirty (30)
percent of the median adjusted gross annual income divided by 12 for
households within Monroe County.
VII. Under Monroe County Code Section 9.5-266, the fou.affordabie
housing/Hawks Cay employee housing dwelling unit is restricted to a
maximum of one thousand three hundred (1,300) square of feet habitable
space for a period of at least thirty (30) years.
VIII. The applicant(s) have used the affordable housing program to gain
additional points in the permit allocation system pursuant to Monroe
County Section 9.5-122.3(6).
IX. The covenants shall be effective for thirty (30) years, but shall not
commence running until a certificate of occupancy has been issued by the
building official for the dwelling unit(s) to which the covenant or covenants
apply. This deed restriction shall remain in effect for thirty (30) years
regardless of the owner(s) or occupant(s) ability to comply or re-qualify on
an annual basis or as otherwise may be required.
X. All of the restrictions herein shall be binding upon any transferees,
lessees, heirs, assigns or successors in the chain of title.
XI. Monroe County may enforce this affordable housing deed restriction
through any legal procedure available. whether at law or equity.

9.5 as may be amended from time to time.
