Resolution 003-1995 " Planning Department RESOLUTION NO. 003 -1995 A RESOLUTION CONFIRMING THE ADMINISTRATIVE BOUNDARY INTERPRETATION OF THE PLANNING DIRECTOR IN LAND USE DISTRICT MAP BOUNDARY INTERPRETATION NUMBER 94, PART LOT 8, SEC- TION 23, TOWNSHIP 63, RANGE 37, WINDLEY KEY, (RE: #00094120), MONROE COUNTY, FLORIDA, APPROXIMATELY MILE MARKER 85. WHEREAS, the property described as Part Lot 84 Sectio~ 2~~ L3- ~ ;:= Township 63, Range 37, Windley Key, (RE: #000941~~)~ Monroe~oun- ;:::C-" ..'n ., 0 ty, Florida, is currently zoned Suburban Residential (SR~ and2_~Urban I --, ~ .,'''-,,, Mobile Home Residential (URM); and -0 r-ll .b. ~~ WHEREAS, the Planning Department recommends approval~f tle boundary changes as indicated in Staff Recommendation dated January 4, 1995, to Urban Mobile Home Residential (URM); and WHEREAS, the staff recommends that the boundary discrepancy of the property lines as shown on the current Land Use District Maps, attachment 1, be corrected as shown on attachment 2; and WHEREAS, the new map drawing corrects the Land Use District of Urban Mobile Home Residential for the above described property; and WHEREAS, the new map drawing correctly shows the property lines which were incorrectly drawn on the Craig Maps; and retains the zoning as adopted by the Board of County Commissioners on February 28, 1986; and WHEREAS, the current Land Use district boundaries which indi- cate that the property is Suburban Residential (SR) and Urban Mo- bile Home Residential (URM), were placed in error with the Land Development Regulations (effective September 15, 1986), and there- fore the subsequent maps were also in error, as they did not follow the previously demarcated RU-5P boundary; and NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT: 1) The action of the Planning Director, which recommends approv- al of a boundary change and map correction of property lines (attachment #2) in Land Use District Map Boundary Interpretation Number 94, dated January 4, 1995, is hereby found to be in conformance with the standards set forth in Section 9.5-3(m), Monroe County Code and is therefore approved; and that 2) The above described property should have been originally designated as Urban Mobile Home Residential (URM) and not Suburban Residential (SR) and Urban Mobile Home Residential (URM) as current- ly indicated; and that 3) The above conclusion of law, is predicated upon the finding of facts and conclusions outlined in the staff recommendation which this Board hereby adopts as its own. 2 " 4) The Clerk of the Board is hereby directed to forward a certified copy of this Resolution to the Monroe County Planning Department. 5) The Clerk of the Board is hereby directed to forward a certified copy of this resolution to the Florida Department of Community Affairs.
